CONSENT CALENDAR. ROOM 147 A. B. C. D. Approve the Minutes of the Regular Meeting of September 22, 1997. Reconsideration of actions taken at the previous meeting. VARIANCE NO. 97-10 (Sergio Klotz) Filed by Mr. Richard A. Gregory to allow a reduction in the industrial landscape setback to facilitate a bus storage yard located at 628 East Washington Avenue in the Heavy Industrial (M2) zoning district. RECOMMENDATION: Continue Variance No. 97-10 to November 10, 1997. CONDiTiONAL USE PERMIT NO. 97-16 (Lynnette Perry) Filed by Mr. Jorge Clemente to allow a Type 41 Alcohol Beverage Control license in order to sale beer and wine for on-premise consumption at the Antojitos Clemente Restaurant located at 210 West First Street, Suite 111 in the Specific Development 40 zoning district. RECOMMENDATION: Receive and file the staff report approving Conditional Use Permit No. 97-16 as conditioned. ***END OF CONSENT*** MOTION: Approve Consent Calendar with the modifications noted for the minutes of September 22, 1997. COUNCIL CHAMBERS COUNCIL CHAMBERS ROLL CALL PLEDGE OF ALLEGIANCE E. ORDINANCE AMENDMENT NO. 97-04 Filed by the City of Santa Ana to revise Chapter 30 of the Santa Ana Municipal Code regarding historic structures and amend the Santa Ana Register of Historic Properties. 1 (Continued by Planning Commission September 8, 1997 to October 13, 1997) LEGALLY NOTICED: August 15, 1997 RECOMMENDATION: 1. Recommend that the City Council adopt an ordinance approving Ordinance Amendment No. 97-04, 2. Recommend that the City Council adopt a resolution amending the Santa Ana Register of Historical Property. Commissioner Hanna indicated that due to an apparent conflict of interest, upon the advice by the City Attorney's Office, he would abstain from taking action on the item. Mr. Larry Yenglin, Associate Planner, provided a brief overview of the staff report and indicated revisions to the proposed ordinance. The following public members spoke in favor of the ordinance: Diane Marsh Jeff Dickman Tim Rush Jim Marquez Ginelle Hazdy Lazry Hanes Archie Berry The following public members expressed opposition to the proposed ordinance: Peter Wernikie Suzanne Wernike Betty Biner MOTION: Approve Ordinance Amendment No. 97-04 with the exclusion ofthe Prebble House from the Historical list and modification. MOTION: MacDowell SECOND: Solorio In addition, Commissioner Oliver requested staff to notify the property owners of the Planning Commission decision and the properties listed on the Historical Register. Specifically, the seven property owners that requested their property be removed from the historical list. Mr. Adams indicated that the property owners would be notified of the public heazings when a property was being considered for the historical list. 0 Commissioner Oliver indicated that he would like the property owners to be notified once a property was nominated to be included on the Historical list or register. Chairman Nalle requested a modified motion to include notification of the property owners once a nomination on the historical register occurs as well as notification of the Planning Commission decision regarding their property. AMENDED MOTION: Approve Ordinance Amendment No. 97-04 with the exclusion ofthe Prebble House from the Historical list; with the modification that the owner of the property(s) must be notified of its nomination upon receipt of an application by the Planning and PLANNING COMMISSION MINUTES 2 OCTOBER 13, 1997 Building Agency; and upon adoption and placement of the property on the register, Building Agency; and upon adoption and placement of the property on the register, such designation is to be placed on the title of the property to provide notification of future property owners of said designation. VARIANCE NO. 97-12 Filed by Alevy and Associates to permit two 15 feet freestanding signs and relief from parking requirements located at 5015-5127 West Edinger Avenue in the Community Commercial (C1) zoning district. LEGALLY NOTICED: September 28, 1997 PUBLICLY NOTICED: September 29, 1997 RECOMMENDATION: Adopt a resolution approving Variance No. 97-12 as conditioned. Mr. Charles View, Downtown Development Manager, provided an overview of the staff report, recommendation, and the modified plan for the Valley Center shopping center. Mr. David Kracoff, representing the applicant, spoke in favor of the project. MOTION: Approve Variance No. 97-12 as conditioned. ORAL COMMUNICATIONS -COMMENTS FROM THE PUBLIC. tFor matters not previously listed on the Aaendal There were no oral comments. The afternoon session resumed. F. Comments from the Planning Manager. Mr. Adams invited the Planning Commission to the next City Council study session and informed the Commission that staff would be discussing: 1) MacArthur Place; 2) the First Street corridor; and 3) 2828 North Bristol. G. Comments from the Planning Commission. Commissioner Hanna requested staff to conduct a study session at the next upcoming Planning Commission meeting regarding the Koo's Cafe. 7:00 p.m. Commissioner Solorio stated that he was happy to attend the meeting and he looked forward to his service as a Commissioner. Commissioner Oliver requested staff to conduct a study session regarding the Bristol Street traffic problems at the next Planing Commission meeting. In addition, he indicated that he would like measures taken in order to prevent car stacking and the installation of permissive left turn lanes. Commissioner Oliver also indicated that he believed the historical ordinance was a good idea, however, there seemed to be loop holes within the ordinance. Commissioner MacDowell congratulated Chazles View on his promotion to Downtown Development Manager. EXCUSE OF ABSENCES. Commissioner Oliver excused the absence of Commissioner Doughty seconded the motion and the motion was unanimously passed. 4. ADTOURNMENT.
