RECOMMENDATION: Approve the Minutes of the Regular Meeting of July 14, 1997. Reconsideration of actions taken at the previous meeting. VARIANCE NO. 97-06 (Vince Fregoso) Filed by Alevey and Associates to grant relief from parking requirements in order to facilitate re-use of the existing Valley Center located at 5015-5127 West Edinger Avenue in the Community Commercial (C1) zoning district. LEGALLY NOTICED: July 27, 1997 PUBLICLY NOTICED: July 28, 1997 (Continued by the Pimrning Commission July 14, 1997 to Judy 28, 1997) D. E. RECOMMENDATION: Continue Variance No. 97-06 to August 25, 1997. CONDITIONAL USE PERMIT NO. 95-03 (Vince Fregoso) Filed by the City of Santa Ana to conduct a review of the conditional use permit and to modify the conditions of approval for the Main Ranch Market located at 1303 North Main Street in the Specific Development 3 (SP3) zoning district. RECOMMENDATION: Adopt a resolution confirming the Zoning Administrator's decision approving the modified conditions of approval for Conditional Use Permit No. 95-03. NEIGHBORHOOD PROTECT REVIEW NO. 97-03 (Lynnette Perry) Filed by Mr. Kris Kakkar to allow a new detached two car gazage and facade renovations located at 506 South Broadway in the Heninger Park Historical district. RECOMMENDATION: Adopt a resolution approving Neighborhood Project Review No. 97-03 as conditioned. F. Chairman Nalle removed item D from the Consent Calendar. Commissioner Oliver amended the minutes for the July 14, 1997 meeting. MOTION: Approve the Consent Calendar with the amended minutes for the July 14, 1997 meeting. MOTION: Oliver SECOND: Mondo AYES: Nalle, Oliver, Mondo, Verino, and Hanna NOES: None ABSENT: Doughty and MacDowell CONDITIONAL USE PERMIT NO. 95-03 Mr. Mehdi Zadeh spoke regarding the conditions of approval and provided the Commission with a list of trash enclosure violations of various sites in the City. In addition, Mr. Zadeh indicated that he would comply with the trash enclosure condition but requested to be allowed to sell 32 and 40 ounce individual cans and/or bottles of beer. Commissioner Hanna requested staff to provide a correlation between individual bottle sales versus six pack sales and provide data indicating the applicant's position on the original conditions of approval for Conditional Use Permit No. 95-03 MOTION: Set the matter concerning Conditional Use Permit No. 95-03 for public hearing on August 25, 1997. MOTION: Oliver SECOND: Hanna AYES: Nalle, Oliver, Verino, and Hanna NOES: Mondo ABSENT: Doughty and MacDowell ZONING ORDINANCE AMENDMENT NO. 96-07 (Thomas Childress) Filed by the City of Santa Ana to revise the City's recycling regulations citywide. LEGALLY NOTICED: July 27, 1997 PUBLICLY NOTICED: July 28, 1997 RECOMMENDATION: Recommend that the City Council approve Zoning Ordinance Amendment No. 96-07. Mc Thomas Childress, Associate Planner, presented the staff report and recommendation. Ms. Beth Beeman, Vice President, Local Government California Grocers Association, spoke in favor of the neighborhood recycling coalition. MOTION: Approve Zoning Ordinance Amendment No. 96-07 with the modifzcation to re- evaluate the recycling regulations to six months instead of 12 momhs from adoption of the ordinance. (Lenka Hovorka) Due to the lack of time, the Commission continued the presentation to August 25, 1997. I. ZONING ORDINANCE AMENDMENT NO. 97-03 (Bill Apple) Filed by the City of Santa Ana to modify the procedures for the Alcohol Beverage Control License process. LEGALLY NOTICED: July 27, 1997 RECOMMENDATION: Approve Zoning Ordinance Amendment No. 97-03. Due to the lack of time, the Commission continued Zoning Ordinance Amendment No. 97-03 to August 25, 1997. d• Comments from the Executive Director. (Robyn Uptegraff) Ms. Uptegraff informed the Commission of the second annual Planning Directors Association seminaz and discussed the Shimizu project that was in the LA Times newspaper. K. Comments from the Acting Planning Manager. {Linda Hale) There were no comments made. L. Comments from the Planning Commission. Commissioner Nalle once again informed staff that the Plaza where the State, Federal, and County Law Library buildings were located was unsightly, had empty tar bottom fountains which leaked water, and requested that staff take appropriate measures to restore and make the area more attractive. VARIANCE NO. 97-10 (Sergio Klotz) ' Filed by Mr. Richazd A. Gregory to allow a reduction in the industrial landscape setback and to allow tandem pazking to facilitate a bus storage yard located at 628 East Washington Avenue in the Heavy Industrial (M2) zoning district. LEGALLY NOTICED: July 27, 1997 PUBLICLY NOTICED: 7uly 3Q 1997 RECOMMENDATION: Adopt a resolution denying Variance No. 97-10. Chairman Nalle stated that due to a conflict of interest, he would abstain from taking action on Variance No. 97-10. Mr. Sergio Klotz, Associate Planner, presented slides, provided an overview of the staff report and recommendation. Mr. Richard Gregory, Applicant, requested the Commission approve the plan as submitted to staff. The following persons spoke in support of the applicant's project: Roderick Bradfield David Nickey ' Commissioner Mondo requested staff to confirm with the Fire Department acceptance of staff's position. Commissioner Hanna requested pictures of the six foot landscaping, clarification of the square footage of landscaping, and clazification of safety from other agencies concerning staff's proposed single driveway. Commissioner Verino requested that the site plan review be completed and visual pictures of the site be provided to the Commission.
