B. C. D. Approval of the Minutes from the Regular Meeting of June 9, 1997. RECOMMENDATION: Approve the Minutes of the Regular Meeting of June 9, 1997. Reconsideration of actions taken at the previous meeting. ZONING ORDINANCE AMENDMENT NO. 97-03 (Bill Apple) Filed by the City of Santa Ana to modify the procedures for the Alcohol Beverage Control Licenses processes. LEGAL NOTICED: June 13, 1997 RECOMMENDATION: Continue Zoning Ordinance Amendment No. 97-04 to July 28, 1997. VARIANCE NO. 97-06 (Charles View) Filed by Alevey and Associates to grant relief from parking requirements in order to facilitate re-use of the existing Valley Center development located at 5015-5127 West Edinger Avenue in the Community Commercial (C1) zoning district. LEGAL NOTICED: March 30, 1997 PUBLIC NOTICID: March 31, 1997 (Continued by the Planning Commission May 12, 1997 to July 14, 1997) RECOMMENDATION: Continue Variance No. 97-06 to July 28, 1.997. ***END OF CONSENT*** Commissioner Hanna removed the minutes from Consent Calendar and noted a vote correction for Variance No. 97-04. MOTION: Approve Consent Calendar with amended minutes for the June 9, 1997 meeting. MOTION: MacDowell SECOND: Hanna AYES: Nalle, Oliver, Mondo, Verino, Hanna, and MacDowell NOES: None ABSENT: Doughty E. APPEAL OF THE PLANNING MANAGER'S DECISION NO. 97-03 (Vince Fregoso) E. APPEAL OF THE PLANNING MANAGER'S DECISION NO. 97-03 (Vince Fregoso) Filed by Ms. Mary McClellan to overturn the Planning Manager's decision to deny the request to allow a detached entertainment room located at 2117 North Victoria Drive in the Single-Family Residence (Rl) zoning district. RECOMMENDATION: Deny the Appeal of the Planning Manager's Decision No. 97-03. Mr. Adams informed the Commission that the applicant was not present at the meeting and requested a continuance. MOTION: Continue Appeal of the Planning Manager's Decision No. 97-03 to August 11, 1997. (Robyn Uptegraft) Ms. Uptegraff indicated that tenants would be soon occupying their buildings for the Center on Seventeenth Street. However, there would be a formal ceremony once the mazket opened. Grading from across Center on Seventeenth Street would be beginning soon. The home on the lot would be relocated to French park for a proposed Parish home for St. Joseph. G. Comments from the Planning Manager. (Kenneth Adams) Mr. Adams informed the Commission that a conceptual proposal had been submitted for the Shimizu site from Hopkin's Development. The project would be required to come before the Planning ' Commission and Ciry Council for formal action. On or about August 1, 1997, MacArthur Place would be submitting along-term site plan proposal. H. Comments from the Planning Commission. Commissioner Hanna thanked staff for providing the brochure on Conflict of Interest. Commissioner Mondo informed the Commission that he had recently been to the downtown Riverside azea and had seen a vast improvement in the downtown area. He encouraged staff and other Commissioners to visit the downtown area to see if any of the ideas successfully used in Riverside would apply in Santa Ana. I. Recess. CONDTTIONAL USE PERMIT NO. 97-13 (Lazry Yenglin) Filed by Mc Jose Meza to allow after hour operations at the El Corral Restaurant located at 1515 East First Street in the Community Commercial (C2) zoning district. LEGAL NOTICED: June 29, 1997 PUBLIC NOTICED: July 1, 1997 RECOMMENDATION: Adopt a resolution approving Conditional Use Permit No. 97-13 as conditioned. Mr. Larty Yenglin, Associate Planner, provided an overview of the staff report and recommendation. Mr. Jose Meza, applicant, stated that he had been operating at El Corral for approximately one yeaz and had not experienced any problems and requested approval of the request. Commissioner Verino asked Mr. Meza if he had reviewed the conditions of approval. Mr. Meza indicated that he had reviewed the conditions of approval and was in agreement with the conditions. Commissioner MacDowell requested staff to provide a history of the operations at the EI Corral restaurant on Seventeenth Street. Mr. Mike McCoy, Police Department, indicated that the Seventeenth Street restaurant had had a high ' percentage of police service calls between the hours of 12:00 a.m. and 5:00 a.m. However, the restaurant was presently closed due to a fire. MOTION: Adopt a resolution approving Conditional Use Permit No. 97-13 as conditioned. 1997. Commissioner MacDowell indicated that he was opposed to the recommendation and the 24 hour operations of the EI Corral restaurant. In addition, he expressed his concerns regazding the applicant's track record with the EI Corral restaurant on Seventeenth Street and the high level of prostitution on First Street. Commissioner Oliver indicated that he was also opposed to the recommendation and believed the applicant did not act in good faith at the El Corral restaurant located on Seventeenth Street. CONDITIONAL USE PERMIT NO. 97-14 (Lynnette Perry) Filed by El Gallo Giro to allow after hour operations at the El Gallo Giro restaurant located at 1442 South Bristol Street in the Arterial Commercial (CS) zoning district. LEGAL NOTICED: June 29, 1997 PUBLIC NOTICED: July 1, 1997 RECOMMENDATION: Adopt a resolution approving Conditional Use Permit No. 97-14 as conditioned. Ms. Lynnette Perry, presented the staff report and recommendation Mr. Pedro Matra thanked staff for their assistance with the project and indicated that he would always try to comply with the requests of the Commission. Mr. Adams indicated that there would be a six month review and if the condition had not been completed, the Commission could take the necessazy action to revoke the conditional use permit. After further discussion, the Commission directed staff to provide the applicant with an additional plan indicating the azeas on the site that needed landscaping and to ensure that the applicant understood what was necessary for compliance with the condition of approval related to landscaping, and to make cleaz it was the applicant's duty, not the landlord's to comply with the conditions. MOTION: Adopt a resolution approving Conditional Use Permit No. 97-14 as conditioned. 1997. MOTION: Doughty SECOND: Verino AYES: Nalle, Oliver, Mondo, Doughty, Verino, Hanna, and MacDowell NOES: None ABSENT: None CONDITIONAL USE PERMIT NO. 96-32 (Larry Yenglin) Filed by the City of Santa Ana to revoke Conditional Use Permit No. 96-32 allowing a rock crushing and material storage facility located at 4127 West MacArthur Boulevard in the Light Industrial (Ml) zoning district. (Continued by the Planning Commission May 27, 1997 to June 9, 1997) 4. LEGAL NOTICE: May 14, 1997 PUBLIC NOTICED: May 15, 1997 RECOMMENDATION: Adopt a resolution revoking Conditional Use Permit No. 96-32. Mr. Yenglin submitted pictures of the site, presented the staff report, and provided an update as to the status of compliance of the conditions of approval. Ms. Tamaza Stein, Attorney representing the applicant, submitted an addendum, and discussed conditions of approval that the applicant believed had been completed. In addition, she indicated that staff had not provided any guidance or direction as to how the applicant could satisfy the condition related to asbestos sampling. MOTION: Corainue Conditional Use Permit No. 96-32 to August 25, 1997. (For matters not previously listed on the Agendal Mr. James Kendrick indicated that he was excited to learn of the construction proposal for the Shimizu site on Main Street and requested the Commission to require a quality project and not ' approve a Center such as the Center on Seventeenth site. In addition, he expressed concern with the City allowing the Hopkins Development company and warned staff and the Commission to be cautious in their dealings with the company. 5. EXCUSE OF ABSENCES.
