CALIFORNIA MINUTES OF THE REGULAR MEETING CITY OF SANTA ANA, CALIFORNIA PLANNING COMMISSION MARCH 10, 1997 n i ~~ The Regular Meeting of the Santa Ana Planning Commission was called to order by Chairman Halle at 6:05 p.m. in the City Council Chambers, Room 1478, located at 22 Civic Center Plaza, Santa Ana, California. Other Commissioners present included: Oliver, Mondo, Doughty, MacDowell, and Hanna. Also in attendance were: Robyn Uptegraff, Executive Director; Kenneth Adams, Planning Manager; Gary Sheatz, Deputy City Attorney; Charles View, Senior Planner; Linda Hale, Senior Planner; Jeffry Rice, Senior Planner; Thomas Childress, Associate Planner; Marvin Ellenbecker, Associate Planner; Kevin Joe, Assistant Planner II; Pam Lucado, Public Works Agency; Mike McCoy and Yolanda Pena, Police Department; and Sharon McCain-Johnson, Acting Recording Secretary. HISTORICAL PROJECT REVIEW NO. 96-13 (Kevin Joe) Filed by Mr. Guillermo Garibay to legalize interior and exterior alterations and repair and restore work to two existing duplex units located at 433, 435, 435A, 435B South Broadway in the Specific Development 40 zoning district. RECOMMENDATION: Approve Historical Project Review No. 96-13. AMENDMENT APPLICATION NO. 96-15 (Sergio Klotz) Filed by the City of Santa Ana to rezone property generally bounded by Dorman Street, Fairmont Street, and Lincoln Avenue from Two-Family Residences (R2) to Single-Family Residence (R1). Properties affected: 806, 810, 902, 906, 910, 914, 1002, 1006, 1010, 1014, and 1018 East Dorman Street; 1503, 1507, 1511, 1517, 1523, 1538, 1542, and 1546 North Fairmont Street; and 1520 and 1530 North Lincoln Avenue. ZONING ORDINANCE AMENDMENT NO. 97-02 (Marvin Ellenbecker) Filed by the City of Santa Ana to amend the Water Conservation Ordinance to exempt required landscape areas of less than 2,500 square feet from the ordinance requirements. RECOMMENDATION: Recommend that the City Council Approve Zoning Ordinance Amendment No. 97-02. Mr. Marvin Ellenbecker, Landscape Associate, presented staff report and staff recommendation. CONDITIONAL USE PERMIT NO. 95-37 (Thomas Childress) Filed by the City of Santa Ana to begin revocation proceedings due to noncompliance with the conditions of approval for Donut Depot located at 3119 South Main Street. RECOMMENDATION: Direct staff to begin revocation proceedings for Conditional Use Permit No. 95-37. Mr. Thomas Childress, Associate Planner, presented staff report and indicated staff was requesting revocation proceedings due to noncompliance of the conditions of approval. Discussion of Discovery Museum Entitlements. (Marta Crane) Mr. Adams informed the Commission that the Discovery Science Center project would come before the Commission for review on March 24, 1997 for formal action. Ma. Marta Crane, Assistant Planner II, provided a model of the proposed Discovery Science Center and discussed with the Commission the two phases of the project, architecture design, and land use issues. Mr. Adams informed the Commission that staff would be meeting with the neighborhood members to discuss possible issues or concerns. He also noted that the sign program would not come before the Commission on March 24, 1997 but would be reviewed by the Commission at a later date. Commissioner MacDowell asked staff if the images on the proposed cube would be informational and draw patrons off of the freeway. Mr. Adams responded that the proposed cube would not have images due to financial restraints. However, the proposals for the cube did involve accent lighting although it had not been finalized. J. Comments from the Planning Commission. Commissioner Doughty asked for an update of 2828 North Bristol. Mr. Adams responded that he had not received any new information regarding the site. Ms. Uptegraff stated that she would drive by to view the site on the following day to observe any code violations. M. Recess. PLANNING COMMISSION MIIJUTES 2 MARCH 10, 1997 PUBLIC HEARINGS PUBLIC HEARINGS ROLL CALL: The Regular Meeting of the Santa Ana Planning Commission was called to order and conducted by Vice Chairman Oliver in the City Council Chambers, 22 Civic Center Plaza, Santa Ana, California. Roll call was answered by Commissioners Doughty, Mondo, Hanna, and MacDowell. Also in attendance were: Robyn Uptegraff, Executive Director; Kenneth Adams, Planning Manager; Gary Sheat z, Deputy City Attorney; Charles View, Senior Planner; Linda Hale, Senior Planner; Melanie McCann, Assistant Planner II; Larry Yenglin, Associate Planner; Pam Lucado, Public Works Agency; Mike McCoy and Yolanda Pena, Police Department; Sharon McCain-Johnson, Acting Recording Secretary. PLEDGE OF ALLEGIANCE TO THE FLAG: Oliver. The Pledge of Allegiance was led by Vice Chairman PROCEDURAL RULES: The procedural rules for the session were read by Vice Chairman Oliver. PUBLIC HEARINGS, 7:00 n.m. 1. CONDITIONAL USE PERMIT NO. 97-04 (Melanie McCann) Filed by Pulaski Arita Ols son, Inc. to allow a retail thrift store in an existing 15,400 square foot vacant building located at 2416 South Main Street in the General Commercial ( C2) zoning district. LEGAL NOTICED: February 23, 1997 PUBLIC NOTICED: February 25, 1997 Approve Conditional Use Permit No. 97-04 as conditioned and adopt the findings as submitted by staff. Ma. Melanie McCann, Assistant Planner II, presented the staff report, displayed slides of the project, and indicated staff's recommendation. Mr. Bruce Arita, representing buyer and seller, indicated that the buyer accepts the conditions of approval established by staff. Mr. Robert Brown, applicant, explained the functions and processes of the thrift store. ' Commissioner Oliver asked if any shopping carts would be used at the store. Mr. Brown indicated that shopping carts would be used at the store, however due to the costs of the carts, the carts would not be allowed beyond the inside premises of the store. Commissioner Oliver asked what type of window displays would be at the thrift store and if the operation would be conducted like the Salvation Army. Mr. Brown indicated that there would be no window displays and that the operation would be different than the Salvation Army; items would be individually marked and furniture sales would be limited. The public would not be able to drop off items for the thrift store. lYotion to approve Conditional Use Permit No. 97-04 with the added condition of approval that aZ2 signage on the premises comply with the City's sign ordinance. APPEAL OF THE ZONING ADMINISTRATOR'S DECISION NO. 97-O1 (Larry Yenglin) Filed by Mr. Vaskin Koshkerian to appeal the Zoning Administrator's decision not to allow a Type 20 Alcoholic Beverage Control License at an existing Chevron service station located at 2650 North Grand Avenue in the Arterial ' Commercial (CS) zoning district. PLANNQ.'G COMMISSION MINUTES 3 MARCH 10, 1997 Commissioner Hanna asked if the applicant could apply again for an ABC linenae if AonioA anA if There were anv ainnificant channac ainre the lost Commissioner Hanna asked if the applicant could apply again for an ABC license if denied and if there were any significant changes since the last request. In response, Mr. Yenglin indicated that this was the applicant's second time requesting an ABC license and there were no changes. Mr. Vaskin Koshkerian, applicant, indicated that he believed his service at at ion was a benefit to the community and it had some of the lowest prices in town. He was only requesting three doors in the mini market for alcoholic beverages. In addition, Mr. Koshkerian indicated that he had a good reputation with the City and he believes the City should take into considerations the operations of facilities when ABC licenses are requested. Mr. Koshkerian further indicated that he had planned to spend approximately ' $3 million on Fourth Street and Tustin Avenue, however due to the City's treatment with the small businesses like himself, he would not invest in that location. The following people expressed opposition and concern regarding Asc license, the liquor sales being in close proximity to the school, and concern for the children's benefit: Edelia Parada, Carver School parent Oliva Godinez, Carver School parent Lenka Hovorka, Communities in Prevention Commissioner Mondo indicated that he believed that the Chevron station was the best looking site in the area, however the operation of the service station was not the issue at hand. The license would not benefit the community and there were three additional alcoholic licenses within 1,000 feet of the Chevron station. Commissioner Mondo also noted a Lotto sign in front of the mini mart and requested Mr. Koshkerian to ensure that that sign was in agreement to the conditions of approval per the original Conditional Use Permit. Commissioner Hanna indicated that he concurred with Commissioner Mondo and noted that the Planning Commission's decision would be a public policy issue. A denial decision did not indicate an anti business position, but the Commission was considering the community's best interest. Commissioner Oliver indicated that the Chevron service station was one of the more successful service stations and well run station in Santa Ana. lYOtion to deny appeal No. 97-OZ. (For matters not previously listed on the Agenda) There were no comments. 7. ERCUSE OF ABSENCES. Commissioner MacDowell moved to excuse the absences of Commissioners Nalle and Pedroza. The motion was seconded by Commissioner Doughty and unanimously passed. B. The meeting adjourned at 7:35 p. m.
