CALIFORNIA MINUTES OF THE REGULAR MEETING CITY OF SANTA ANA, CALIFORNIA PLANNING COMMISSION JANUARY 27, 1997 The Regular Meeting of the Santa Ana Planning Commission was called to order by Madam Chair Brown at 7:05 p.m. in the City Council Chambers, located at 22 Civic Center Plaza, Santa Ana, California. Other Commissioners present included: Nalle, Doughty, Mondo, Oliver, and Pedroza. Also in attendance were: Robyn Uptegraff, Executive Director; Kenneth Adams, Planning Manager; Gary Sheatz, Deputy City Attorney; Jeffry Rice, Senior Planner; Charles View, Senior Planner; Sergio Xlot z, Associate Planner; Maya DeROea, Environmental Coordinator; Lynnette Perry, Assistant Planner II; Marta Crane, Assistant Planner II; Pamela Lucado, Public Works Agency; Mike McCoy and Yolanda Pena, Police Department; and Sharon McCain-Johnson, Recording Secretary. PLEDGE OF ALLEGIANCE TO THE FLAG: The Pledge of Allegiance was led by Madam Chair Brown. PROCEDURAL RULES: The procedural rules for the session were read by Madam Chair Brown. A. Approval of the Niautes from the Regular Meeting of January 13, 1997. RECOMMENDATION: Approve the Minutes of the Regular Meeting of January 13, 1997. B. Reconsideration of actions taken at the previous meeting. None. C. MINOR E%CEPTION NO. 95-03 (Lynnette Perry) Status compliance of conditions for All Plastic Surgery located at 817 Weat Seventeenth Street. (Continued by the Planning Commission Janvary 13, 1997 to January 27, 1997) RBCOMMENDATION: Receive and file the staff report for Minor Exception No. 95-03. D. CONDITIONAL USE PERMIT NO. 96-30 (Larry Yenglin) ' Status compliance of conditions of approval for Yum Yum Donuts located at 320 East Seventeenth Street. Comments from the Executive Director. (Robyn Uptegraff) There were no comments. F. Comeats from the Planning Manager. (Kenneth Adams) Mr. Adams informed the Commission that two members would be joining the Planning Commission: Mr. John Hanna and Mr. John McDowell. The new Commissioners would replace Madam Chair Brown and Commissioner Segura. An upcoming introductory study session would be provided by staff for the new Commissioners. G. Comments from the Planning Commission. Commissioner Doughty expressed her appreciation to Madam Chair Brown. She commented that she believed Madam Chair Brown was always prepared for each meeting and stressed her unhappiness to see her leave the Commission. Commissioner Pedroza commented that it was a pleasure serving on the Commission with Madam Chair Brown. Commissioner Na11e commented that he was sorry to see Madam Chair leave and expressed his appreciation to her. Commissioner Mondo commented that he would miss Madam Chair Brown. Commissioner Oliver expressed his appreciation to Madam Chair Brown and thanked her £or her service as a Commissioner. In addition. Commissi~niar Commissioner Oliver expressed his appreciation to Madam Chair Brown and thanked her for her service as a Commissioner. In addition, Commissioner Oliver asked staff to investigate the traffic on Bristol Street between Memory Lane and the 22 Freeway. He commented that the traffic in that location is extremely congested and he believed mitigation measures could be taken to improve the area. Madam Chair Brown thanked staff for their efforts and hard work throughout the year and thanked her colleagues on the Commission. H. Recess. There was no recess taken. PLANNING COMMISSION MINOTES 2 DECEMBER 9, 1996 PUBLIC HEARINGS PUBLIC HEARINGS 0 PUBLIC HEARINGS. 7:00 p.m. 1. OENBRAL PLAN AMENDMENT NO. 96-09 AND AMENDMENT APPLICATION NO. 96-12 (Sergio Klotz) Filed by the City of Santa Ana to rezone property from General Commercial (C2) to Open Space (O) and redesignate property from District Center (DC) to Open Space (O). (Continued by the Planning Commission November 25, 1996 to January 27, 1997) LEGAL NOTICE: November 10, 1996 PUBLIC NOTICSD: November 13, 1996 RECONMENDATION: 1. Recommend that the City Council adopt a resolution approving General Plan Amendment No. 96-09 to amend the Land Use Element of the General Plan. 2. Recommend that the City Council adopt an ordinance approving Amendment Application No. 96-12. Mr. Sergio Klotz, Associate Planner, presented the staff report. Commissioner Mondo asked if there would be landscaping at the site; who owned the property; and if the owner is aware of the rezoning. Mr. Klotz responded that no landscaping would be at the site; CalTrans owned the property; and CalTrans had been made aware of the rezoning approximately one year ago. Commissioner Oliver asked if MainPlace mall had expressed any interest in the site and if there was any other way to rezone the property in order to achieve the City's objective. Mr. Klotz responded that he had been in contact with MainPlace mall but no interest was expressed in the parcel. However if someone came along with a proposal, rezoning could be done if appropriate. Commissioner Nalle indicated that he felt this was the appropriate zoning for this property. DRAFT ENVIRONMENTAL INPACT REPORT NO. 96-01 (Maya DeRosa) To receive public comments for the Draft Environmental Impact Report and potential environmental effects for the Discovery Science Center located at 2522 North Main Street. LEGAL NOTICE: January 12, 1997 PUBLIC NOTICED: January 15, 1997 RECO}IIQENDATION: Receive public comments. Ms. DeRosa presented the staff report and indicated that staff would not respond to any comments at this meeting. Ms. Rim Sinclair, Floral Park, expressed concern regarding: 1. Parking spaces provided in Phase I and II of the project. 2. The entire site being underparked due to an overflow of vehicles from Red Roof Inn, Kaplana, and Park Santiago. 3. Bus parking. Where would the parking be located? 4. Impacts to the bike path. What is staff's position? 5. The 70 foot high cube impacting the nearby neighborhoods. Ms. Sinclair further commented that the EIR should not list parking as unavoidable and requested staff to encourage a smaller cube for the project. PLANNING COMMISSION MIND'f'ES 3 DECEMBER 9, 1996 Mr. Mel Vernon expressed his support for the Discovery Science Center but had concerns regardino: Mr. Mel Vernon expressed his support for the Discovery Science Center but had concerns regarding: 1. Its fencing. It may provide a false sense of security from the problems associated with Santiago creek. 2. Inadequate parking for the site as well as for the employees of the Discovery Science Center. 3. Bua parking. Who would monitor parking and what type of enforcement would take place for the area? How would the buses travel from the site? In addition, Mr. Vernon corruoented that the traffic figures did not address the Shimizu project; that there would be 16 intersections that would be impacted with the project. Ms. Michelle Morrieey, Floral Park, echoed Ms. Sinclair's concerns and expressed concern regarding: 1. The 70 foot cube impacting the area. She requested staff to limit the height. 2. Limit the types of messages and the hours of the messages on the cube. 3. The circulation plan. What would staff or City Council do to limit traffic congeation7 In addition, Ma. Morrieey emphasized that she believed the 70 foot cube would create glare into the nearby neighborhood. Mr. Adams noted that he anticipated changes and a possible resubmittal for the cube. 3. ORAL COMMUNICATIONS - COMMENTS FROM THE PUBLIC. (For matters not oreviously listed on the Aaenda) Mr. Adams informed the Commission that Dr. Miskinyar would like to speak regarding the Minor Exception on the Consent Calendar. Dr. Miskinyar presented some brochures and indicated that he had not been using the third floor of the building as a medical facility but was using the area as a lounge. In addition, he commented that he felt using the area for massages was not a medical use; there were plenty of parking spaces on-site; and he believed someone who was working on the top floor of the building used his name on a brochure to try to destroy his business. 4. E%CUSE OF ABSENCES. Commissioner Nalle moved to excuse the absence of Commissioner Segura. The motion was seconded by Commissioner Pedroza and unanimously passed. 5. ADJOURNMENT.
