Johnson, Commission Secretary CONSENT CALENDAR Mr. Jeffry Rice, Principal Planner noted that Conditional Use Permit No. 00-11 should have been reflected as a Consent Calendar item and he informed the Commission that staff would like to request a continuance of the Appeal of the Planning Manager's Decision No. 00-07. A. Approval of the Minutes from the regular meeting of July 24, 2000. RECOMMENDATION: Approve the minutes from the meeting of July 24, 2000. B. CONDITIONAL USE PERMIT NO.00-11 Filed by Mr. Michael Cho to upgrade a Type 41 Alcohol Beverage Control License to a Type 47 in order to sell beer, wine, and distilled spirits for on-premise consumption at the Emerald Bay restaurant located at 5015 West Edinger Avenue, Suite V. RECOMMENDATION: Receive and file the staff report approving Conditional Use Permit No. 00-11 as conditioned. CI C. APPEAL OF THE PLANNING MANAGER'S DECISION NO.00-07 Filed by Mr. Thomas Childress to appeal the Planning Manager's decision to requiring a lot consolidation to permit the construction of a new food court located at 1204 South Bristol Street. (Continued by the Planning Commission July 24, 2000 to August 14, 2000) RECOMMENDATION: 2 Continue Appeal of the Planning Manager's Decision No. 00-07 to September 11, 2000. ***** END OF CONSENT CALENDAR ***** Motion to approve Consent Ca/endar. SECONDED: Doughty Mr. Gerardo Mouet, Senior Management Assistant, provided an overview of the City's web page and discussed with the Commission the history of the creation of the web page and future plans for the web page. ZONING ORDINANCE AMENDMENT NO.00-09 Filed by the City of Santa Ana to amend various sections of Chapter 41 of the Santa Ana Municipal Code to allow banquet facilities as conditionally permitted uses citywide. LEGALLY NOTICED: July 24, 2000 RECOMMENDATION: Recommend that the City Council adopt an ordinance approving Zoning Ordinance Amendment No. 00-09. Mr. Verny Carvajal, Associate Planner, presented the staff report, provided an overview of the proposed ordinance, and staff recommendation. ' Commissioner Solorio commented regarding the strict security guard requirement for some of the banquets, especially children's events. Mr. Kenneth Adams, Acting Executive Director, noted that the Commission had the authority to amend any condition of approval pertaining to banquet facilities at its discretion. Chairman Mondo opened the public hearing at 7:20 p.m. There were no public comments. Chairman Mondo closed the public hearing at 7:20 p.m. Motion to recommend that the City Council: 1) approve and adopt the Negative Declaration for Environmental Review No. 00-123; and 2) adopt an ordinance approving Zoning Ordinance Amendment No. 00-09. ZONING ORDINANCE AMENDMENT NO. 00-0$ Filed by the City of Santa Ana to amend various sections of Chapter 41 of the Santa Ana Municipal Code to modify language concerning child care facilities; regulate adult day care facilities as an ancillary use to churches and school facilities subject to a conditional use permit in the Single-Family Residential (R1), Limited Multiple-Family Residential (R2), Medium Density Multiple Family Residential (R3), Specific Plans, and Specific 4 Developments; and as conditionally permitted uses in the Professional (P), Community Commercial (C1), General Commercial (C2), Planned Shopping Center (C4), and Arterial Commercial (C5) zoning districts. LEGALLY NOTICED: July 24, 2000 RECOMMENDATION: ' Recommend that the City Council adopt an ordinance approving Zoning Ordinance Amendment No. 00-09. Chairman Mondo closed the public hearing at 7:29 p.m. Motion to recommend that the City Council: i) approve and adopt the Negative Declaration for Environmental Review No. 00-122; and 2) adopt an ordinance approving Zoning Ordinance Amendment No. 00-08. MOTION: Nalle SECONDED: Solorio AYES: Mondo, Nalle, Solorio, Doughty, Verino, and Cribb NOES: None ' ABSENT: Richardson ABSTENTION: None Commissioner Solorio commented that he was excited about the proposed ordinance to assist with childcare facilities and that the ordinance was a positive step for the City of Santa Ana. 3. ZONING ORDINANCE AMENDMENT NO.00-07 Filed by the City of Santa Ana to amend Chapter 41, Section 871 to establish permit regulations for temporary signage for businesses citywide. LEGALLY NOTICED: July 24, 2000 RECOMMENDATION: Recommend that the City Council adopt an ordinance approving Zoning Ordinance Amendment No. 00-07. Mr. Bob St. Paul, Associate Planner, presented the staff report, provided an overview of the proposed temporary signage regulations, and staff recommendation. Chairman Mondo opened the public hearing at 7:35 p.m. There were on public comments. Public Comments (for items not on the agenda). ' There were no public comments. 5. Comments from the Acting Executive Director. Mr. Kenneth Adams, Acting Executive Director, apprised the Commission that an overview of the commercial vehicle ordinance would be presented at the next Planning Commission meeting; that additional ordinances concerning shopping carts and vending machines would be reviewed by the Commission in the near future; and he would be providing an overview of the new SAPIN System to the Commission. 6. Comments from staff. There were no comments. 7. Comments from the Assistant City Attorney. There were no comments. 8. Comments from the Planning Commission. Commissioner Cribb • Reported that there were additional illegal shed displays at the Tuff Shed site adjacent to the 55 Freeway and requested staff initiate code enforcement activity; • Reported that the landscaping was not being watered and maintained at the Guaranteed Chevrolet at Santiago Street, the northeast corner of Edgewood and Main; • Reported illegal signage at the Ralph Allen building at Santa Ana Boulevard and Main Street; • Reported that the parking lot area behind Abbey Rentals was dilapidated and need of maintenance at Williams and Seventeenth Street; and • Requested a discussion regarding the landscaping requirements at an upcoming Planning Commission meeting. Commissioner Nalle ' Questioned staff regarding the south side of east First Street zoning. Mr. Adams informed the Commission that a formal request had been presented and approved by the Planning Commission to rezone the area Professional. However, the City Council only approve the General Plan to Professional and did not act upon rezoning the area Professional and therefore, there was an inconsistency with the south side zoning. In addition, Mr. Adams informed the Commission that there had not been, to his knowledge, a formal submittal for the Memphis restaurant and discussions. Mr. Jeffry Rice, Principal Planner indicated to his knowledge, 6 only and alcohol beverage control license application had been formally submitted. Commissioner Verino • Commented that the City was contributing funds for the project and asked if the City would be holding the funds until the plans were reviewed and approved. Mr. Adams responded that the Downtown Development would ' be processing the application. Commissioner Mondo • Reported landscaping maintenance was needed at the hotel and apartments on the north side of Segrestrom, east of Bristol and requested staff verify whether or not the area was on public property or private property. 9. Excuse of absences. Commissioner Doughty moved to excuse the absence of Commissioner Richardson. Commissioner Verino seconded the motion and the motion unanimously passed. 10. Adjournment.
