C. GENERAL PLAN AMENDMENT NO.00-01
Filed by the City of Santa Ana to update the Housing Element of the General Plan.

D. ZONING ORDINANCE AMENDMENT NO.00-O1
Filed by the City of Santa Ana to modify various sections of Chapter 41 of the Santa Ana Municipal Code
to establish regulations for fence construction and front yazd fence design standards in residential zones
citywide.

E. APPEAL OF THE PLANNING MANAGER'S DECISION NO.00-04
Filed by Opera Pacific to allow the use of a portion of an industrial building in order to permit combined
rehearsals, opera orchestra, chorus, and cast four times a yeaz for four consecutive weeks located at 600
West Warner Avenue in the Light Industrial (Ml) zoning district.
RECOMMENDATION:
I. Receive and file the Categorical Exemption for Environmental Review No. 00-45.
2. Adopt a resolution denying Appeal of the Planning Manager's Decision No. 00-04.
Mr. Bob St. Paul, Associate Planner, provided a sumtnary of the issues and staff recommendation.
Mr. Martin Hubbard, representing the applicant, provided an overview of the operations of the Opera
Pacific.
Commissioner Solorio inquired as to the Opera Pacific working with the local schools or with children.
Mr. Martin responded that the company currently had 200 performances at schools and that they could
intended to continue this partnership.
Commissioner Nalle inquired as to the applicant applying for a parking vaziance. Mr. Hubbard responded
that applying for a variance would presume that there would be a pazking problem at the site and he
reiterated that he did not foresee any parking problems with the production company. In addition, he stated
that the additional time to apply for a variance and the time it would take to go through the discretionary
process they would forfeit their deposit for the purchase of the building.
After further discussions regarding operations of the Opera Pacific, there was a motion to overturn the
Planning Manager's Decision.
Motion to approve Appeal of the Planning Manager's Decision No. 00-04 and directing the applicant to
' apply for a parking variance with the occupancy approval indicating that no performances are allowed
and no sublease of the rehearsal space to other users was permitted.
MOTION: Nalle SECOND: Doughty
No vote took place.
Mr. Rubin, representing the applicant, spoke in favor of the applicant's request and stressed to the
Commission that it was necessary to get an approval action by the Commission. He further assured the
Commission that there would be no performances at the location, therefore it did fall under the usual
categories of churches or theater uses as described in the Industrial (Ml) zoning district.
Substitute motion to approve Appeal of the Planning Manager' Decision No. 00-04 with the condition
that there was to be no assembly use at the location and no sublease of the rehearsal space to other users
was permitted.

E. Discussion of Housing Element (General Plan Amendment No. 00-O1).
Ms. Melanie McCann, Associate Planner, provided an overview of the proposed Housing Element, goals
and policy framework of the Element.
Ms. Pat Whitiker, Community Development Agency, provided an overview of the Draft Consolidated Plan.
The Commission and staff further discussed the Regional Housing Needs Assessment and the assessed
housing needs for the City.
Commissioner Solorio requested staff provide all REHNA information to the Commission so it can be
reviewed prior to taking an action on the Housing Element.

I. Comments from the Assistant City Attornev.

Commissioner Doughty requested staff provide her the number to report graffiti.
Commissioner Mondo requested staff provide a beeper number for code enforcement for reporting issues
during the weekends.

Chairman Mondo stated the applicant had withdrawn item number one, Conditional Use Permit No. 00-03;
therefore, the Commission would not be taking any action regazding the item.

Filed by CarrAmerica to allow the construction of a 60 foot tall monopalm within an existing development
located at 1942 East Deere Avenue in the Professional (P) zoning district.

RECOMMENDATION:
1. Recommend that the City Council approve and certify the Negative Declaration for Environmental
Review No. 99-169.
2. Recommend that the City Council adopt an ordinance approving Zoning Ordinance Amendment
No. 99-09.
Mr. Chazles View informed the Commission that the staff report had been presented at a previous meeting.
Staff was continuing to recommend that drive-through facilities be prohibited in the downtown azea due to
the incompatibility with pedestrian traffic.
Mr. Marvin Jarmin, Developer, indicated that he believed the proposed ordinance was discriminatory and
that his client's business fronted on First Street which was primarily vehicular oriented. In addition, he
' requested that the Commission consider allowing drive-through facilities with a conditional use permit.
Motion to recommend that the City Councill: 1) approve and certify the Negative Declaration for
Environmental Review No. 99-169; and 2) adopt an ordinance approving Zoning Ordinance
Amendment No. 99-09.

3. ZONING ORDINANCE AMENDMENT NO. 00-02, CONDITIONAL USE PERMIT NO. 00-02,
AND MINOR EXCEPTION NO.00-02
Filed by the Roman Catholic Bishop of Orange to amend the Harbor Specific Plan in order to permit a new
church and to share parking with an exiting hall located at 285 South Harbor Boulevard in Specific
Development 2.

1. Recommend that the City Council approve and certify the Negative Declaration for Environmental

as conditioned.
4. Recommend that the City Council adopt a resolution approving Minor Exception No. 00-02.
Mc Jeffry Rice, Principal Planner, provided an overview of the applicant's request, presented the staff
report and recommendation.
Commissioner Cribb inquired regarding the project affecting the entertainment zone for Harbor Boulevard.
Mr. Rice responded that the zoning ordinance amendment would allow church uses subject to a conditional
use permit.
Commissioner Solorio asked if the surrounding property owners were informed of the proposed project and
if any correspondence had been received. Mr. Rice stated that there had been several meetings with the
public and no correspondence had been received.
' Mr. Frank McNamara spoke in support of the project and provided an overview of the church activities,
vehicular traffic and pazking access.
Mr. Dave Lopez, Riverview West Neighborhood Association, stated that the association had a recent
meeting and that approximately 75 percent of the neighborhood was in favor of the project with the other
25 percent non supportive. He further expressed that several local church sites in the City had trash
problems and illegal sales activities. He requested that conditions address these issues.
Mr. Bri Arri, introduced himself as the Pastor of the Church, and assured the Commission that the church
site would be always in a clean state. He further provided an overview of some of the operations at the
church and commented that he encouraged fellowship and activities for children during and after mass.
Commissioner Cribb asked if the landscaping at the site would be mature and consist of palm trees as
depicted on the renderings. Mc Jeffry Rice responded that palm trees were not allowed in the pazking lot
areas per the Santa Ana Municipal Code, however, the landscaping proposed met or exceeded the code
requirements. Commissioner Cribb further commented that he believed when renderings provided
illustrations of mature landscaping and the intention was not to place mature landscaping it was a
misrepresentation and that in the future he would prefer renderings display the accurate size and type of
landscaping.
Motion to recommend that the City Council: 1) approve and certify the Negative Declaration for
Environmental Review No. 99-179 with modij"cations to the construction hours on Saturday(s); 2) adopt
' an ordinance approving Zoning Ordinance Amendment No. 00.02; 3) adopt a resolution approving
Conditional Use Permit with modifcations to the conditions of approval; and 4) adopt a resolution
approving Minor Exception No. 00-00 with madifccations to the conditions of approval.
