RECOMMENDATION:
Instruct the Commission Secretary to enter into the minutes that pursuant to the
Brown Act, the September 6, 2007 Agenda for the Regular Meeting was posted
on the door of the City Hall Council Chambers at 22 Civic Center Plaza on
August 31, 2007 at 9:54 a.m.

C. HISTORIC PROPERTY PRESERVATION AGREEI'AENT NO. 2007-06
Filed by the City of Santa Ana to execute an a reement with Troy and Kim
Leaming for the structure at 2140 North Ross Stree~(Fuller-Utt House)
RECOMMENDATION:
Recommend that the City Council direct the City Attorney to prepare and
authorize the City Manager and Clerk of the Council to execute an agreement
with Troy and Kim Leaming for the structure at 2140 North Ross Street (Fuller-Utt
' House), Santa Ana, CA 92706.
Due to abstention from Commissioner O'Callaghan and resulting in lack of
quorum, the item will be continued to November 1, 2007.
D. HISTORIC PROPERTY PRESERVATION AGREEMENT NO 2007-07
Filed by the City of Santa Ana to execute an agreement with Alfonso and Patricia
T. Bustamante and Laurie Hampton and Joel Torres for the structures at 2201
North Broadway (Patricia Apartments).
RECOMMENDATION:
Recommend that the City Council direct the City Attorney to prepare and
authorize the City Manager and Clerk of the Council to execute an agreement
with Alfonso and Patricia T. Bustamante and Laurie Hampton and Joel Torres for
the structures at 2201 North Broadway (Patricia Apartments), Santa Ana, CA
92701.
E. HISTORIC PROPERTY PRESERVATION AGREEMENT NO. 2007-08
Filed by the City of Santa Ana to execute an agreement with Alfonso and Patricia
T. Bustamante of the Bustamante Family TrusU2006 for the structure at 819
North Spurgeon Street (Dr. Wehrly House).
RECOMMENDATION:
Recommend that the City Council direct the City Attorney to prepare and
authorize the City Manager and Clerk of the Council to execute an agreement

2. HISTORIC EXTERIOR MODIFICATION APPLICATION NO 2007-03
Filed by Drs. Chan and Quynh Kieu, to allow a decorative cornice line and
balcony rail at the historic structure located in the Single Family Residence (R1)
zoning district at 2221 North Heliotrope Drive (Maharajah House).

RECOMMENDATION:
Adopt a resolution denying a Certificate of Appropriateness for Historic Exterior
Modification Application No. 2007-03.
Associate Planner Hally Soboleske presented the staff report and
recommendation.
The public hearing was opened.
Written communications were received from Alex L. Hart, Dr. Quynh Kieu and
Richard Dodd.

Richard Dodd spoke in support of the project.
Commission discussion ensued regarding the original material for coping and
cornice detail and subsequent appropriateness of this modification.
Dr. Quynh Kieu spoke in support of the project and provided pictorial
documentation regarding the Art Deco styled architecture.
Sandra De Angelis spoke in support of the project.
SAPPHOS Environmental Consultant Leslie Heumann expanded on her 31 years
cultural resources background as an independent consultant. Debbie Howell-
Ardilla provided a 1940 photograph of the structure at 2221 North Heliotrope that
showed the original cornice and balcony design.

Commission suggested continuation to November 1, 2007 to allow the absent
commissioners to provide input.
MOTION: Continue the public hearing to November 1, 007 and provide additional
photos.
Associate Planner Hally Soboleske stated that Mr. Dodd met with staff to discuss an
appropriate compromise in order to meet the Secretary of Interior Standards. She
indicated the applicants would be out of town and not available during November 1,
2007.
' Commissioner Mill withdrew the motion.
Chair Schaefer recommended that Consultant Heumaron and staff work with the
applicant's architect Richard Dodd to modify the cornice balcony detail. Agreement was
voiced by homeowners, Drs. Kieu.
SUBSEQUENT MOTION: Approve Historic Exterior Modification Application No.
2007-03 with modification to reduce the size of the coping at balcony level and
the coping at the top of the building to be smoothed out and the texture removed
and repainted accordingly.

Commissioner Mill made a motion to excuse the absences of Commissioners
