Set Public Hearing For_ CONTINUED TO FILE NUMBER Direct the City Attorney to prepare and authorize the City Manager and Clerk of the Council to execute an amendment to the agreement with Sapphire Technologies, subject to non-substantive changes approved by the City Manager and City Attorney, in an amount not to exceed $192,000. DISCUSSION The technological advances being implemented by the Fire Department has created the need for expert staffing in the field of information technology and computer support services. In July 2006, the City Council approved an agreement with Sapphire Technologies, and has amended the agreement each fiscal year since then. The Fire Department continues to have a need for the computer support services that Sapphire Technologies provides and is recommending approval of an amendment to the agreement for FY 2011/12 in the amount not to exceed $192,000. FISCAL IMPACT Funds are budgeted in the Fire Department, Fire Information Technology, Contract Services - Professional account (account no. 0111534062300). APPROVED AS TO FUNDS AND ACCOUNTS: D6VI-d Thomas Francisco Gutierrez Fire Chief Executive Director Fire Department Finance & Management Services Agency 25D-1 25D-2 SIXTH AMENDMENT TO AGREEMENT THIS SIXTH AMENDMENT TO AGREEMENT is made and entered into this 1 ST day of July, 2011 by and between SAPPHIRE TECHNOLOGIES LLC, a Delaware corporation ("Consultant") and the City of Santa Ana, a charter city and municipal corporation of the State of California ("City'). RECITALS: City and Consultant entered into Agreement N-2006-055, dated June 6, 2006, (hereinafter "said Agreement") by which Consultant has provided information systems and technology staffing services to the City's Fire Department. 2. In accordance with the terms and conditions of said Agreement, the parties wish to increase compensation to provide continuous uninten•upted services by Consultant. WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all the terms and conditions of said Agreement, except those amended in this Sixth Amendment to Agreement, the parties agree as follows: Section 2, COMPENSATION, shall be amended to increase compensation by $192,000.00 to pay for information systems and technology staffing services during the 2011-2012 fiscal year. Consultant shall continue to perform those services and accept payment as set forth in Appendix A of said Agreement. Except as herein amended, all terms and conditions of said Agreement shall remain in full force and effect. IN WITNESS WHEREOF, City and Consultant have executed this Fifth Amendment to Consultant Agreement on the day and year first set forth above. ATTEST: Maria D.
