PROCEDURAL RULES Planning Commission Minutes 1 September 24, 2012 PUBLIC HEARING 1. VARIANCE NO. 2012-07 Arshia Mahmoodi of Void Inc., representing Metro Star LLC, is requesting approval of a variance to allow a reduction in landscaped setbacks and to allow the construction of a new 6,000 square foot commercial building at 2702 North Bristol Street, located in the Community Commercial (Cl) zoning district. ' PUBLISHED IN THE ORANGE COUNTY REPORTER: September 14, 2012 PUBLICLY NOTICED: September 13, 2012 RECOMMENDATION: Adopt a resolution approving Variance No. 2012-07 as conditioned. Principal Planner Vince Fregoso presented the staff report and recommendation. No written communications were received. The public hearing was opened. Julie Stroud, Riverview Neighborhood resident, and Richard Tucker, managing property owner/partner, spoke in support of the project. Applicant Arshia Mahmoodi spoke in support of the project. Commissioner Yrarrazaval asked the applicant if he would be opposed to a condition requiring signage to prohibit overnight parking. Mr. Mahmoodi concurred. Glen Stroud, Riverview Neighborhood resident, inquired about use of u -turns travelling eastbound on Memory Lane at Bristol Street. Principal Civil Engineer Higgins explained why the u -turns would not be feasible. The public hearing was closed. MOTION: Adopt a resolution approving Variance No. 2012-07 as conditioned. Planning Commission added the following modifications: Item A3 Prior to submittal into planning plan check, a detailed landscaped plan (working drawings) shall be submitted to staff for review. The plan shall note that trees will not be planted immediately adjacent to the multi -family residential buildings. Police Item B1 — Lighting standards amended to read must incorporate shields to prevent light intrusion on the adjacent multi -family residential buildings. Commission also added Police condition to add signs to be posted on the property prohibiting overnight parking.
