HomeMy WebLinkAbout20130522_ZA2013-05_2201WFirstUnitAROH - 05/22/13 RESOLUTION NO. 2013-05 A RESOLUTION OF THE ZONING ADMINISTRATOR OF THE CITY OF SANTA ANA APPROVING CONDITIONAL USE PERMIT NO. 2013-09 AS CONDITIONED TO ALLOW A LAUNDROMAT FOR THE PROPERTY LOCATED AT 2201 WEST FIRST STREET, SUITE A BE IT RESOLVED BY THE ZONING ADMINISTRATOR OF THE CITY OF SANTA ANA AS FOLLOWS: Section 1. The Zoning Administrator of the City of Santa Ana hereby finds, determines and declares as follows: A. The applicant is requesting approval of Conditional Use Permit No. 2013- 09 to operate a laundromat for the property located at 2201 West First Street, Suite A. B. Conditional Use Permit No. 2013-09 came before the Zoning Administrator of the City of Santa Ana for a duly noticed public hearing on May 22, 2013. C, Santa Ana Municipal Cade Section 41-199 requires a conditional use permit for establishments that operate as laundromat facilities in a General Commercial (C-2} zoning district. D. Santa Ana Municipal Code Section 41-638 authorizes the Zoning Administrator to approve a conditional use permit upon making certain findings: 1. Will the proposed use provide a service or facility which will contribute to the general well being of the neighborhood or community? The proposed laundromat will contribute to the general well- being of the community by providing a basic community service to individuals who live and work in the area. Moreover, improvements to the building and surrounding project area will enhance the overall site by adding pedestrian walkways, improving landscaping, and contributing to architectural improvements along the West First Street corridor. Finally, conditions have been placed on the laundromat, which will mitigate any potential impacts Resolution No. 2013-05 Page 1 of 7 created by the use and ensure that the use will not negatively affect the surrounding community. 2. Will the proposed use under the circumstances of the particular case be detrimental to the health, safety or general welfare of persons residing or working in the vicinity? The proposed laundromat will nat create any negative or adverse impacts to the surrounding community because the use will comply with all the adopted regulations intended to ensure that new Laundromats will be safe, well maintained and will not result in a demand for Police Department calls for service. Moreover, conditions are imposed to mitigate any potential impacts that could otherwise affect the health, safety, or general welfare of persons residing or working in the vicinity. 3. Will the proposed use adversely affect the present economic stability or future economic development of properties surrounding the area? The site as developed is suitable for the proposed use. The laundromat use will generate city tax revenue and additional employment opportunities in the community. In addition, the use will provide a tenant to a previously vacant suite and an additional service to the community, thereby enhancing rather than adversely affecting the economic stability of surrounding properties in the area. 4. Will the proposed use comply with the regulations and conditions specified in Chapter 41 far such use? As conditioned, the proposed project will be in compliance with all applicable regulations and conditions imposed on Laundromats pursuant to Chapter 49 of the Santa Ana Municipal Code. 5. Will the proposed use adversely affect the General Plan or any specific plan of the City? The proposed use will not adversely affect the General Plan. Laundromats are permitted within the General Commercial (GC) General Plan designation and the General Commercial (C-2) zoning district. Policy 2.2 of the Land Use Element encourages land uses that accommodate the City's needs for goods and services. 'C'~f. _ . ~~.~~ ~ ~, ~a~e ~ ~ ~'. ~~. ~~ -'~.` ~; 4 Conditions for Conditional Use Permit No. 2013-09 Conditional Use Permit No. 2013-09 is approved subject to compliance, to the reasonable satisfaction of the Planning Manager, with all applicable sections of the Santa Ana Municipal Code, the California Administrative Code, the California Building Standards Code and all other applicable regulations. The applicant must comply in full with each and every condition listed below rim or to exercising the rights conferred by this conditional use permit. The applicant must remain in compliance with all conditions listed below throughout the life of the conditional use permit. Failure to comply with each and every condition may result in the revocation of the conditional use permit. A, Plannin Division 1. All proposed site improvements must conform to the Site Plan Review approval of DP No. 2012-38. 2. Any amendment to this conditional use permit must be submitted to the Planning Division and Police Department for review. At that time, staff will determine if administrative relief is available or the conditional use permit must be amended. 3. Prior to the issuance of a certificate of occupancy, an 18-inch-tall seat wall with decorative cap that complements the proposed exterior materials and design must be installed to separate the proposed outdoor seating area from the landscape strip adjacent to the proposed relocated driveway. This seat wall is to begin at a paint approximately 95 feet north of the southern edge of the proposed walkway along the west side of the building and follow the length of the curve of the proposed outdoor seating area until its ending at the first parking space, 4. All roof-mounted equipment must be screened from public view in a manner that is architecturally compatible with the existing building. 5. All requirements set forth in Section 41-999 of the Santa Ana Municipal Code shall be incorporated herein. 6. A full time attendant shat{ be required during all hours of operation of the facility. 7. The Voluntary Lot Merger shall be approved prior to issuance of the building permit. 8. All signage must comply with the provisions of Sign Program No. 2007-02. Continuation of the stone veneer with cap or ledge around the entire building. 11. Prior to entering into plan check, submit an interior finish detail package (counters, flooring, ceiling, etc.). 12. Prior to entering into plan check, submit an exterior plaza detail package (tables, decorative pavement, etc.}, B. Police Department 1. Storefront windows must be of full-length type. The vertical plane of the glazing should extend from the top of the floor or bulkhead to the top of the finished ceiling height. Bulkheads, if provided, shall be a maximum of one {1}foot in height above the finished floor level. The horizontal plane should extend completely across the storefront except where shear panels are required by the building code. 2. Glazing material must be approved by the Planning Division and the Police Department for color and tint. Tint must not exceed ten (10) percent. Re#lective glass will not be permitted. 3. Interior lighting must be approved by the Police Department. The minimum level shall be one {1) faotcandle per City Code, 4. All service counters, seating areas, service sinks and coin-operated dispenser machines must not create an obstructed view of the entire interior assembly space. No displays, posters or other obstructive material shall be installed on or near the storefront windows. 5, No public telephones shall be located within the laundromat. 6. No electronic video games, billiard games or other gaming devices shall be allowed within the laundromat. No laundromat use may be initiated within three hundred {300) feet of any individual tenant space having more than five (5} percent of its floor area used for electronic video games or other gaming devices. 7. Public restrooms shall be locked at all times and available only through the request of the attendant on duty. EXhiblt A ResoEutian No. 2013-05 Page 2 of 3 Page 6 of 7 8. Service corridors shall be locked during all normal business hours. Storagelaccess doors shall be one and three-quar#er (1 3/4) inches thick and secured with an approved dead bolt and nonremovable hinge pins. 9. Rear exits are prohibited unless required by either the building code or the fire code. When required, rear exit doors shall be kept in a locked closed position and shall have panic hardware. 10. Hours of operation shall be restricted to 7:00 a.m, to 10:00 p.m. 11. A sign prohibiting loitering on the premises in accordance with Santa Ana Municipal Code Section 10-96 shall be kept posted on the premises at all times. 12. The exterior parking area must be illuminated to a minimum of one (1) footcandle for sixty (60) feet horizontally in all directions from the laundromat tenant space. 13. One (1}uniformed employee shall be present during the hours of operation. 14. Provide a conceptual lighting plan, including photometrics, to show compliance with the required 1 footcandle. Light standards cannot be located in landscaped areas to avoid direct conflict with mature canopy growth of trees. Bollards cannot be utilized to gain the 1 footcandle compliance.
