ELECTION OF OFFICERS RECOMMENDATION 1. Elect a Chairperson of the Historic Resources Commission for the year 2013. 2. Elect a Vice Chairperson of the Historic Resources Commission for the year 2013. COMMISSIONER COMMUNICATION DISCLOSURE (REGARDING AGENDIZED PROJECTS) None PROCEDURAL RULES PUBLIC HEARING 1. HISTORIC REGISTER NO. 2013-01-RML (Item continued by the Historic Resources Commission: March 7, 2013 to a date uncertain) Filed by Chan and Quynh Kieu to allow the removal of the Maharajah House (Landmark) located 2221 North Heliotrope Drive from the Santa Ana Register of Historical Properties. PUBLISHED IN THE ORANGE COUNTY REPORTER PUBLICLY NOTICED: April 12, 2013 April 11, 2013 RECOMMENDATION: Adopt a resolution denying Historic Register No. 2013-01-RML (removal) to remove the Maharajah House categorized as Landmark, HRC No. 2003-34 and HRCA No. 2003-30 from the Santa Ana Register of Historical Properties. Historic Resources Commission Minutes 2 April 25, 2013 Associate Planner Hally Soboleske presented the staff report and recommendation noting the property owner is requesting to be removed from register, provided the history of the property, and alterations made to the exterior of the property. Written communication received from Diane Dunn in support of removing the property from the register; Toni Kimball of the Santa Ana Historical Preservation ' Society, Barbara Warnock, Leslie Kato, David Rance, Anne Etheridge and Mike Albanese in opposition to the removal of the property from the register. The public hearing was opened and the following speakers addressed the Commission on the matter: James Gartner spoke in opposition to the removal of the property from the register. • Dianne Dunn spoke in support of removing the property from the register. • Maxine Schmidt, representing the Santa Ana Historical Preservation Society, spoke in opposition to the removal of the property form the register. • George Herlihy spoke in opposition to the removal of the property form the register. • Leslie Kato spoke in opposition to the removal of the property from the register. • Ellen Koldewey spoke in opposition to the removal of the property from the register. • Molly Doughty spoke in opposition to the removal of the property from the register. • Janelle McLoughlin spoke in opposition to the removal of the property from ' the register. • Mark McLoughlin spoke in opposition to the removal of the property from the register. • Sonja Melching spoke in support of removing the property from the register. • Angel Barnes spoke in opposition to the removal of the property from the register. • Kim Sinclair spoke in opposition to the removal of the property from the register. • Linda Nelessen spoke in opposition to the removal of the property from the register. • Quan Dinh spoke in support of removing the property from the register noting the condition of the home. • Quynh Kieu, property owner, spoke in support of removing the property from the register noting respect for the history of the home adding she is ready to maintain the look of the home, noted the difficulties of the living conditions adding the house is cold and has mold, commented on the problems with the roof and the high cost to replace the steel windows and for the upkeep of the exterior, noted she is willing to work with the Commission, but should be given options. • Ricki Older spoke in opposition to the removal of the property from the register. The Public Hearing closed at 6:37 p.m. Commissioner Mill inquired if there are tax benefits for properties listed on the register and if so, did the property owners take advantage of this benefit. Ms. Soboleske noted there is a potential to save from the property taxes with the Mills Historic Resources Commission Minutes 3 April 25, 2013 Act agreement, but added the property owners have lived in home for 25 years and the tax base would be lower than what the Mills Act would be able to save them and would not be a benefit to the property owners. Commissioner Rosas inquired on the legal ramifications on keeping the property on the register. Mr. Hodge answered the city does have the legal authority to enforce historic preservation standards. Commission discussion ensued on property owner's rights, the historical and architectural significance of the Maharajah House, the repair of the roof, and the removal of the steel windows. MOTION: Adopt a resolution denying Historic Register No. 2013-01-RML (removal) to remove the Maharajah House categorized as Landmark, HRC No. 2003-34 and HRCA No. 2003-30 from the Santa Ana Register of Historical Properties. EXCUSE OF ABSENCES Motion by Commissioner Bustamante seconded by Commissioner Garcia to excuse the absence of Commissioner Christy and approved unanimously by a vote of 6:0.
