HomeMy WebLinkAbout20090722_2009-07_1626EFourthSt• bk:7/15/09 RESOLUTION NO. 2009-07 A RESOLUTION OF THE ZONING ADMINISTRATOR OF THE CITY OF SANTA ANA ADOPTING MINOR EXCEPTION NO. 2009-04 TO PERMIT A FIVE PARKING SPACE MINOR EXCEPTION FOR THE PROPERTY LOCATED AT 1626 EAST FOURTH STREET BE IT RESOLVED BY THE ZONING ADMINISTRATOR OF THE CITY OF SANTA ANA AS FOLLOWS: Section 1. The Zoning Administrator of the City of Santa Ana hereby finds, determines and declares as follows: A. The applicant is requesting approval of a minor exception to allow the development of an existing office building into its new headquarters. Approximately three-fourths of the building (8,484 square feet) will be utilized by The Cambodian Family, with the remaining area (2,212 square feet) to be occupied by the existing office tenant. The applicant proposes to convert the first floor into a child care center with a maximum enrollment of 64 children split into two sessions and locate its offices on the second • floor. An outdoor child play area is proposed that if constructed would take up five existing parking spaces. B. Under the Santa Ana Municipal Cade 31 parking spaces are required and 26 would be provided under the applicants plan. C. Minor Exception No. 2009-04 came before the Zoning Administrator of the City of Santa Ana for a public hearing on July 22, 2009. D. Santa Ana Municipal Code Section 41-134 would bar the proposed expansion unless 31 parking spaces could be provided. E. Santa Ana Municipal Code Section 41-638.1 authorizes the Zoning Administrator to grant a minor exception upon making certain findings. 1. That the granting of a minor exception to allow two or more independent uses to share the required parking stalls will not result in a conflict between parking for one use and parking for another due to differences in time of primary utilization of parking. The granting of the minor exception will not result in a conflict between the parking for the different users on the site. A parking study was prepared that shows that 27 parking • spaces would accommodate all users; however, the loss of a single additional parking space as approved in this resolution is superior to the site plan with 27 parking spaces because it Resolution Na. 2009-07 Page 1 of 4 • will serve to improve site circulation and eliminate a potential blind spot in the children's playground. Conditions of approval have been imposed to ensure that the parking demand will remain constant, ensuring ample supply. In addition, testimony at the hearing from the seller, who will lease back twenty-five percent (25%) of the building, was that it had reached agreement with the adjacent property owner to park on its property. If it were allowable for the parking study to take this fact into account, it would support a much higher reduction from the parking requirement than five (5) spaces. 2. That the granting of a minor exception will not substantially increase difficulties of vehicle maneuverability or traffic congestion on the project site. The existing on-site parking will be sufficient to accommodate the proposed child care use, despite the fact that it proposes one additional space beyond that identified as optimal in the parking study. Loss of one additional parking space will provide the site with an improved circulation design that will be maintained at all times. F. In accordance with the California Environmental Quality Act, the recommended • action is exempt from further review. Categorical Exemption Environmental Review No. 2009-60 will be filed for this project. Section 2. The Zoning Administrator of the City of Santa Ana hereby, approves Minor Exception No. 2009-04 as conditioned in Exhibit A attached hereto and incorporated herein. This decision is based upon the evidence submitted at the abovesaid hearing, which includes but is not limited to: the Request for Zoning Administrator Action dated July 22, 2009 and exhibits attached thereto; and the public testimony, all of which are incorporated herein by this reference. The applicant must comply in full with each and every condition listed below rip Or t0 exercising the rights conferred by this minor exception. The applicant must remain in compliance with all conditions listed below throughout the life of the minor exception. Failure to comply with each and every condition may result in the revocation of the minor exception. A. Planning Division 1. The project shall remain in compliance with Preferred Option 1 of Site Plan Review DP No. 09-20. 2. The maximum parking reduction permitted on the property is sixteen percent (16%). ., .. 3. The maximum enrollment for each childcare session shall be 64 students and the maximum number of teachers/supervisor for the childcare center shall be six. 4. There shall be no overlap in the schedule of childcare sessions. 5. The use of the vanpool service for drop-off and pick-up shall be maintained. B. Police Department 1. The existing suites and parking lot must conform to the provisions of the Building Security Ordinance. All project lighting, door/window locking devices and addressing shall be upgraded to current code standards.
