MINOR EXCEPTION NO. 2009 -05
10:39 a.m.
Mr. Sergio Klotz, Zoning Administrator, called to order the public hearing in the City Hall
Ross Annex Conference Room 2001.
Also in attendance were: Perry Burch, Applicant; Nancy Aceves and Lucila Iniguez,
Residents; Willie Huh, Business Owner; Vince Fregoso, Principal Planner; Martha
Ramirez, Commission Secretary; and Jocelyn Magalona, Recording Secretary.
There were no written communications.
Vince Fregoso presented the staff report and recommendation. Mr. Fregoso added a
condition requiring the recordation of a lot merger prior to issuance of the building
permit.
Martha Ramirez and Lucila Iniguez provided translation in Spanish for Ms. Aceves, a
resident at 1234 West Cubbon.
Ms. Iniguez stated her concern regarding the wall on the side of the residence, noise,
alcohol and hours of operation.
Discussion and clarification followed concerning the wall and the outdoor patio area.
Mr. Klotz stated the decision before him is the encroachment of the building into the
side yard setback. He explained the different process for the ABC license and hours of
operation.
Mr. Klotz added three more conditions requiring a temporary fence during construction,
restriction of audible music or noise beyond the patio area, and a fence around the patio
area.
The Zoning Administrator adopted a resolution approving Minor Exception No. 2009 -05
with the amended conditions.
The hearing adjourned at 10:13 a.m.
