CONDITIONAL USE PERMIT NO. 2009 -14
10:59 a.m.
Mr. Sergio Klotz, Zoning Administrator, called to order the public hearing in the City Hall
Ross Annex Conference Room 2001.
Also in attendance were: Joe Takeda and Mira Pak, Applicants; Anna Lauri, Red
Mountain; Matt Foulkes, Assistant Planner I; Mike McCoy, Yolanda Pena and Monica
Hernandez, Police Department; and Jocelyn Magalona, Recording Secretary.
Matt Foulkes presented the staff report and recommendation.
There were no written communications.
Ms. Pena noted that the Alcoholic Beverage Control (ABC) analysis on Exhibit 5 of the
staff report did not come from the Police Department. Mr. Foulkes stated it was
obtained from the ABC website.
Mr. McCoy stated the Police Department's reluctance to approve an additional
discretionary action at the site due to a lack of compliance with existing conditions. The
two conditions involved are the requirement of a security guard in the rear parking lot as
well as bringing the lighting standards up to code.
Discussion and clarification ensued regarding the security guard and lighting standards.
Ms. Hernandez stated she will be sending a letter to Chipotle and a copy to Red
Mountain in reference to the non - compliance.
Mr. Foulkes also indicated that a signage placard to be placed in the rear parking lot as
part of Chipotle's condition of approval is not in place.
Ms. Lauri stated the property management will ensure the issues raised will be complied
with.
Mr. McCoy stated the Police Department needs to see the applicant's contract for the
guard company being used and the hours the guard will be on duty. He also indicated
that the lighting standards must be up to code prior to the issuance of a Letter of
Approval to the ABC Board. Mr. McCoy noted that the conditions of approval are the
applicant's responsibility.

Mr. Klotz inquired if the applicant read and agreed to the conditions. Ms. Pak stated her
agreement to all the conditions.
Mr. Klotz stated the two previous ABC licenses approved at the site was a great
concern with the neighbors and a way to address their concern was through the
conditions of approval. He stated his reluctance to make a decision today, even though
Shabu Shabu is an innocent outcome of this, when there are outstanding items that
need to be resolved by the other tenant at the site as well as the property owner.
The Zoning Administrator continued Conditional Use Permit No. 2009 -14 as conditioned
to July 1, 2009 to allow time to resolve the non - compliance of existing conditions on
site.
The hearing adjourned at 11:23 a.m.
