All matters listed under the Consent Calendar are considered to be routine
by the Planning Commission and will be enacted by one motion without
discussion. Persons wishing to speak regarding a Consent Calendar
matter should file a “Request to Speak” form with the Commission

A. MINUTES
RECOMMENDATION:
Approve the minutes of the regular meeting of September 27 2004.
B. RECORDING SECRETARY REPORT
Pursuant to the Brown Act and the Maddy Act, the September 27, 2004
Agenda for the Regular Meeting was posted on the door of the City Hall
Council Chambers at 22 Civic Center Plaza on September 24 2004 at
8:11 a.m.
RECOMMENDATION:
Instruct the Commission Secretary to enter posting into the minutes.
C. CONDITIONAL USE PERMIT NO. 2004-22 (Ann Ni)
Filed by La Cascada Restaurant to allow a Type 41 Alcoholic Beverage
Control license in conjunction with an existing restaurant at 2629
Westminster Avenue.

RECOMMENDATION:
Receive and file the staff report approving Conditional Use Permit No.
2004-22 as conditioned.
D. MINOR EXCEPTION NO. 2004-07 (Ann Ni)
Filed by Ms. Ngoc-Anh Thi Huynh to allow a 42” height front yard fence,
with a 24” solid base at 5026 W. Fifth Street.
RECOMMENDATION:
Receive and file the staff report denying Minor Exception No. 2004-07.

E. COMMISSIONER COMMUNICATION DISCLOSURE (REGARDING
AGENDIZED PROJECTS)
F. VARIANCE NO. 2004-07 (Vince Fregoso)
Filed by Caribou Industries to obtain variances from various provisions on
the sign code for Original Mike’s Restaurant at 100 South Main Street
following referral of Sign No. 3 to Historic Resource Commission and
continuance of consideration of Sign No. 6(E).
RECOMMENDATION:
Adopt a final resolution on Variance No. 2004-07, including items
considered at meeting of September 27, 2004, and:
1. Approving Variance No. 2004-07 (B) to allow one changeable copy
sign as conditioned (Signs 2 and 3).
2. Approving Variance No. 2004-07 (E) for Sign No. 6.
G. VARIANCE NO. 2004-10 (Lucy Linnaus)
Filed by Caribou Industries to allow off-street parking and to provide
exceptions from various provisions of the sign code for the Orange County
Performing Arts Pavilion at 801 North Main Street.
