HomeMy WebLinkAbout04/17/2013ZONING ADMINISTRATOR HEARING MINUTES APRIL 17, 2013 CONDITIONAL USE PERMIT NO. 2012 -28 10:45 a.m. Mr. Sergio Klotz, Zoning Administrator, called to order the public hearing in the City Hall Ross Annex Conference Room 2001. Also in attendance were: Maher Hawara, Edward A. Barhi, Zaher Hawara and Rick A. Blake, La Plaza Market; David Lopez and Maria Sandoval, Neighborhood Residents; Vince Fregoso, Principal Planner; Mike McCoy, Police Department; Ryan Hodge, City Attorney; and Jocelyn Magalona, Recording Secretary. There were no written communications. Mr. Fregoso provided an update and confirmed the existence of a church within 1,000 feet of the market which creates an overconcentration issue near a sensitive land use and therefore recommended denial. Mr. Fregoso also mentioned the location of a Community Center nearby. Mr. Lopez provided pictures of the church and the project site. Ms. Sandoval stated the Community Center also holds church services and is supportive of the denial. Mr. Blake stated the church building is not in operation and noted it held one night of bible study. The Zoning Administrator referred to a picture of the church sign showing a schedule of services it offers and noted that regardless of how the church operates the land use exists. The Zoning Administrator reiterated the standards for overconcentration and adopted a resolution denying Conditional Use Permit No. 2012 -28. The Zoning Administrator provided information on the appeal process.
