CONDITIONAL USE PERMIT NO. 2013 -05
11:03 a.m.
Mr. Sergio Klotz, Zoning Administrator, called to order the public hearing in the City Hall Ross
Annex Conference Room 2001.
Also in attendance were: Ralph Deppisch and Jason Novotny, Applicant; Melanie McCann,
Associate Planner; Mike McCoy, Police Department; Ryan Hodge, City Attorney; and Jocelyn
Magalona, Recording Secretary.
There were no written communications.
Ms. McCann presented the staff report and recommendation for approval.
The Police Department retracted Condition Nos. 12 and 28 regarding the security guard and
closed circuit television system and replaced it with a new condition that a written security
policy and procedures manual approved by the Police Department be maintained.
The Police Department noted Condition No. 20 that the lighting and parking standards be up to
code prior to the issuance of a letter of approval to the Alcoholic Beverage Control Board. A
sentence was added to state that corrections be made prior to the letter issuance.
Mr. Deppisch underscored 7- Eleven's training program, the small percentage of alcohol sales
to its overall business along with its expansion of providing fresh /healthy foods /lifestyle, and
requested that Condition No. 19 be modified to allow the sale of alcohol from 7:00 a.m. to
11:00 p.m. to 7:00 a.m. to 12:00 midnight. The Police Department had no objection with the
request.
Discussion was held regarding the site improvement, signage clean -up and landscaping. The
Zoning Administrator noted missing shrubs and requested it be added with the landscape
improvement. A condition was added that additional landscaping improvements be provided
prior to the issuance of a certificate of occupancy.
The Zoning Administrator noted there are no sensitive land uses in proximity to the project and
adopted a resolution approving Conditional Use Permit No. 2013 -05 with amended conditions.
The hearing adjourned at 11:29 a.m
