CONDITIONAL USE PERMIT NO. 2012 -19
10:59 a.m.
Mr. Sergio Klotz, Zoning Administrator, called to order the public hearing in the City Hall
Ross Annex Conference Room 2001.
Also in attendance were: Bruce Marsh and Naseem Aflakian, Applicants; Phil Bacerra;
Darren Shippen, Morrison Neighborhood Resident; Yolanda Lawler, Downtown Inc.;
Justin Reuter, Proof; Hally Soboleske, Associate Planner; Eileen Greene and Mike
McCoy, Police Department; Ryan Hodge, City Attorney; and Jocelyn Magalona,
Recording Secretary.
There were no written communications.
Ms. Soboleske presented the staff report and recommendation for approval.
Mr. Bacerra, Mr. Shippen, Mr. Reuter and Ms. Lawler stated their support for the
project.
The Police Department requested the deletion of two conditions that are no longer
pertinent: Police Condition 2 which states alcohol service shall be by waiter /waitress
only; and Police Condition 3 which states alcohol sale shall only be made in conjunction
with the sale of food by the person ordering the beverage — these conditions were not
necessary due to the configuration of the operation or other conditions listed.
Police Condition 15 was modified to allow the sales, service and consumption of alcohol
until 2:00 a.m.
The Zoning Administrator inquired if the applicant understood and agreed to all of the
conditions. The applicant stated his agreement to all of the conditions.
The Zoning Administrator adopted a resolution approving Conditional Use Permit No.
2012 -19 with amended conditions.
The hearing adjourned at 11:12 a.m.
