[Americans with Disabilities Act, Title II, 28 CFR 35.102] Basic Housing Authority Meeting Information Code of Ethics and Conduct - The people of the City of Santa Ana, at an election held on February 5, 2008, approved an amendment to the City Charter which established the Code of Ethics and Conduct for elected officials and members of appointed boards, commissions, and committees to assure public confidence. A copy of the City's Code can be found on the Clerk of the Council's webpage. The following are the core values expressed: Integrity • Honesty • Responsibility Fairness • Accountability • Respect • Efficiency Agenda Information - The agenda descriptions provide the public with a general summary of the items of business to be considered by the Authority. The Authority is not limited in any way by the "Recommended Action" and may take any action which the Authority members deem to be appropriate on an agenda item. Except as otherwise provided by law, no action shall be taken on any item not listed on the agenda. Public Comments /Public Input - Pursuant to Government Code Sec. 54954.3, the Public may address the Housing Authority on any and all matters within the Authority's jurisdiction. At the discretion of the Chair, at the first Public Comment portion of the meeting, all comments may be considered jointly. The public will be given the opportunity to speak three (3) minutes on any and all matters contained on any of the Consent Calendar and Business Calendar items and/ or on issues of public interest within the jurisdiction of the City. For public hearings, members of the public shall be given three (3) minutes for each duly noticed hearing (unless the matter is continued prior to taking public testimony). All requests to speak shall be submitted in writing to the Clerk of the Council at the beginning of the meeting and before Public Comments begin. Speaker forms will be available at the meeting. REQUESTS TO SPEAK SHALL BE ACCEPTED AFTER THE PUBLIC COMMENT SESSION BEGINS WITHOUT PERMISSION OF THE CHAIR. When speaking, all persons addressing the Legislative Body shall follow the rules of decorum as detailed on the back of the speaker form. The presiding officer shall have the power and responsibility to enforce decorum and order of the meeting as set forth in Section 2- 104(c) of the Santa Ana Municipal Code. Consent Calendar - All matters listed under the Consent Calendar are considered to be routine by the Authority will be enacted by one motion without discussion unless a member of the Authority "pulls" an item(s) for a separate vote. Senate Bill 343 - As required by Senate Bill 343, any non - confidential writings or documents provided to a majority of the members regarding any item on this agenda will be made available for public inspection in the Clerk of the Council Office during normal business hours. Agreements valued at greater than $25,000 require approval by the Board of Directors. This is the same authority granted to the City Manager by the voters through a Charter Amendment in November 2006. The authority granted to the Executive Director required the submission of a quarterly report to the Housing Authority at a public meeting on all such agreements. The report is required to include the names of contractors and the amounts of each contract. There are no agreements to report for the period of January 1, 2014 through March 31, 2014. Adopt a resolution to approve and authorize submission of the Annual Plan to the United States Department of Housing and Urban Development. 2. Approve the revisions to the Administrative Plan and authorize submission to the Department of Housing and Urban Development. COMMUNITY REDEVELOPMENT AND HOUSING COMMISSION RECOMMENDATION At its Regular Meeting of March 17, 2014, by a vote of 5:0, the Community Redevelopment and Housing Commission recommended that the Housing Authority adopt a resolution to approve and submit the Annual Plan to the United States Department of Housing and Urban Development and approve the revision of the Administrative Plan and the submission to the Department of Housing and Urban Development. DISCUSSION The U. S. Department of Housing and Urban Development (HUD) requires housing authorities that administer a Housing Choice Voucher (HCV) Rental Assistance program to have an Annual Plan and Administrative Plan. The purpose of the Santa Ana Housing Authority's Annual Plan is to advise HUD, program participants and members of the public of its policies and procedures to serve the needs of very low- income families. The purpose of the Administrative Plan is to describe the Authority's policies and procedures to implement the HCV program in Santa Ana. The Annual Plan (Exhibit 1) provides detailed information about the current operations of the Housing Authority, including programs, participants, services for the upcoming year, and any operational or tenant concerns. The Housing Authority held a Tenant Advisory meeting on 4 -1 Submission - Annual & Administrative Plan April 1, 2014 Page 2 January 23, 2014 to solicit and inform participants of changes to the program that may impact them. In addition, suggestions for improvements to the program were solicited (Exhibit 2). Notices were sent to 1,562 participants of the HCV program living in Santa Ana, of which 59 attended the tenant advisory meeting. Breakout sessions were held in English, Spanish and Vietnamese. The Administrative Plan serves as supporting documentation for the Annual Plan. It informs the public and staff about HCV regulations and explains how Santa Ana Housing Authority will implement those regulations. The Administrative Plan (Exhibit 3) was last adopted in April 2012. The Administrative Plan must be revised to ensure compliance with regulatory changes made by HUD, and policy and procedure changes proposed by the Housing Authority. The following sections were updated: • Regulatory changes to portability procedures • Clarification of Violence Against Women Act (VAWA) • Process to open the wait list HUD regulations require a 45 -day comment period. On January 27, 2014, notification was published that the draft plans were available for review. The public comment period ended March 12, 2014. All comments received will be included in the final documents submitted to HUD. Information regarding SAHA's efforts for victims of domestic violence to obtain and maintain housing, and prevent domestic violence in assisted families, in accordance with the Violence Against Women Act (VAWA) of 2005: • SAHA Coordinates closely with the County of Orange's Domestic Violence Office for referrals and to ensure applicants and participants are made knowledgeable of all available services • Information on details of VAWA as pertaining to owner /tenant relations and evictions is given to all applicants and program participants and mailed to all participating owners • SAEA's Administrative Plan details restrictions on terminating assistance for victims of domestic violence, as well as guidelines on terminating assistance for perpetrators of domestic violence • SAHA discusses VAWA regulations with staff at least annually. Hope VI, Mixed Finance Modernization or Development, Demolition and/or Disposition, Conversion of Public Housing, Homeownership Programs, and Project -based Vouchers. Include statements related to these programs as applicable. 7.0 Housing Choice Voucher (HCV) homeownership is possible and participants are encouraged to have as a goal, however, a large funding gap exists between available resources and the local for -sale market. FSS participants are still required to take homeownership classes. The Housing Authority of the City of Santa Ana evaluates annually the number of HCVs that can be made available for project -based assistance within it's jurisdiction of the City of Santa Ana. This will assist thejutisdiction's affordable housing needs supported by the Authority's Administrative Plan and Consolidated Plan for the City of Santa Ana. During the fiscal year the Authority provided eight project -based vouchers in a project for developmentally disabled individuals. Capital Improvements. Based on information provided by the applicable Consolidated Plan, information provided by HUD, and other generally available data, make a reasonable effort to identify the housing needs of the low- income, very low - income, and extremely low- income families who reside in theimisdiction served by the PHA, including elderly families, families with disabilities, and households of various races and ethnic groups, and 9.0 other families who are on the public housing and Section 8 tenant -based assistance waiting lists. The identification of housing needs must address issues of affordability, supply, quality, accessibility, size of units, and location. The recently completed Housing Element of the City of Santa Ana's General Plan has identified as a goal 156 units of housing affordable to very low income households and 122 units of housing affordable for low income households. Whereas the majority of the participants (60 %) and applicants (47 %) only require 1- bedroom units. Of the overall renting population in Santa Ana, 45% have household of 5 or more persons. The most recent data regarding severe housing burden for renters by income level is 12% for very low, 60% for extremely low. Moderate housing burden by income level is 61 % very low and 82% extremely low. 50% of elderly renters are estimated to overpay for housing. Of the 1808 families on the wait list 11 % are disabled. 22% are elderly. SAHA is providing 8 project based vouchers in a new construction project specifically for the developmentally disabled population. Instructions form EXHIBIT 2 Tenant Advisory Meeting January 23, 2014 The Housing Authority of the City of Santa Ana sent notice invitations to all participants in the HCV program who live in Santa Ana for the a Tenant Advisory Meeting held on January 23, 2014. Notices were sent in English, Spanish and Vietnamese. Since space was limited, reservations were accepted on a first come, first served basis hoping to have approximately 20 attendees in each language. Attendance groups included: • English 10 • Vietnamese 26 • Spanish 23 Areas of Discussions: Sequestration: • Program participants can no longer port-out to higher payment standard areas. • Current port-out participants must return to SAHA when moving. Reduction in SAHA's payment standards as follows: • Applied the new payment standards effective 6/1/13 for any moves. • Apply the new payment standards at the annual re -exam effective 6/1/14, thereafter, for participants not moving. Return to using the flat rate utility allowance for all mobile home owners /renters. Applying the utility allowance using the actual voucher size or the unit size, whichever is less. It's been 1 %2 years since SAHA has issued any vouchers to applicants from the wait list. Based on funding and average HAP, we do not receive enough funds to support SAHA's allocated vouchers (2699). What is it that SAHA can do to improve the program? • Families are thankful for all assistance they now receive. • SAHA should serve the elderly /disabled population first (pull off the wait list) • SAHA needs to hire Vietnamese housing workers to better communicate with program participants • Property managers need to have better communication with resident issues. • Allow housing tenants to pay more than 30% of their income towards rent. The Housing Authority of the City of Santa Ana conclusively finds, determines and declares as follows: A. The Housing Authority of the City of Santa Ana (the "Authority') is required by the U.S. Department of Housing and Urban Development ( "HUD ") to have an Annual Plan due to the fact that the Authority administers a Housing Choice Voucher ( "HCV ") Rental Assistance Program. B. The purpose of the Authority's Annual Plan is to advise HUD, program participants and members of the public of its policies and procedures to serve the needs of very low- income families. C. The purpose of the Authority's Administrative Plan is to describe the Authority's policies and procedures to implement the HCV program in Santa Ana. D. The Annual Plan provides information about the current operations of the Authority including programs, participants, services for the upcoming year, and any operational or tenant concerns. The Authority scheduled a Tenant Advisory meeting on January 23, 2014. Notices of the meeting were sent to 1,562 participants in the HCV program in English, Spanish and Vietnamese. E. The Administrative Plan serves as supporting documentation for the Annual Plan. The Authority's Administrative Plan was last adopted in April 2012. The Administrative Plan must be revised to ensure compliance with regulatory changes made by HUD and policy and procedure changes proposed by the Authority. The changes that will be implemented include a clarification of the Violence Against Women Act and regulatory changes to portability procedures. F. HUD regulations require a forty -five (45) day comment period. On January 27, 2014, notification was published in the Orange County Register that the draft plans were available for public review. The public comment period ended on March 12, 2014. Further, a public hearing was held by the Community Redevelopment and Housing 4 -12 Commission on March 17, 2014, and all comments received at the hearing are included in the final documents to be submitted to HUD. Section 2. The fiscal year 2014 -2015 Annual Plan of the Housing Authority of the City of Santa Ana is hereby approved and adopted. Said Annual Plan shall be submitted by the Authority to HUD. Section 3. The revision of the Administrative Plan of the Housing Authority of the City of Santa Ana is hereby approved and adopted. Said Administrative Plan shall be submitted by the Authority to HUD. Section 4.
