Box 1988 Santa Ana, California 92702 Attn: Housing Programs Manager SPACE ABOVE THIS LINE FOR RECORD[NG USE FREE RECORDING REQUESTED [Government Code Section 6[03] AMENDMENT TO NEIGHBORHOOD STABILIZATION PROGRAM LOAN DOCUMENTS (605 -611 East Washington, Santa Ana, CA) This AMENDMENT TO NEIGHBORHOOD STABILIZATION PROGRAM LOAN DOCUMENTS is entered into as of July 31, 2013, by and between SANTA. ANA WBBB, LP, a California limited partnership ( "Developer "), and the CITY OF SANTA ANA, a California municipal corporation and charter city ( "City"), collectively "the Parties ". RECITALS: A. The City and Developer entered into that certain Neighborhood Stabilization Program Rental Housing Development Loan Agreement, dated as of June 1, 2010 ( "NSP Loan Agreement "), regarding a loan of $655,000 from the City to the Developer, recorded against the real property described in the attached Exhibit A (the "Property ") in the official records of Orange County, California, on June 2, 2010 as Instrument No. 2010000258489 (the "NSP Loan "). The NSP Loan is evidenced by that certain City Promissory Note Secured by Subordinated Deed of Trust to the City of Santa Ana, California (605 -611 E. Washington Street), dated as of June 1, 2010 ( "NSP Promissory Note "), in the original principal amount of $655,000, and is secured by that certain City Deed of Trust and Assignment of Rents in favor of the City, recorded against the Property in the official records of Orange County, California, on June 2, 2010 as Instrument No. 2010000258491 ( "NSP Deed of Trust "). In connection with the NSP Loan, the City and the Developer entered into Affordability Covenants and Restrictions, recorded against the Property in the official records of Orange County, California, on June 2, 2010 as Instrument No. 2010000258490 (the "NSP Covenants "). Collectively, the NSP Loan Agreement, the NSP Promissory Note, the NSP Deed of Trust and the NSP Covenants are referred to as the "NSP Loan. Documents ". B. The name of the Developer has changed since the date the NSP Loan Documents were entered into as set forth in the Amendment to Certificate of Limited Partnership (LP -2) 2 filed with the California Secretary of State's office on August 12, 2010 with regard to LP File No 201012400017. C. The parties hereto desire to amend the NSP Loan Documents to reflect the Developer's name change. NOW, THEREFORE, DEVELOPER AND CITY COVENANT AND AGREE AS FOLLOWS: 1. The NSP Loan Documents are hereby amended to replace the words "Santa Ana BBBW, LP" wherever they appear in the Loan Documents with the words "Santa Ana WBBB, LP." 2. Except as amended herein, the NSP Loan Documents shall remain in full force and effect.
