CODE OF ETHICS AND CONDUCT
The people of the City of Santa Ana, at an election held on February 5, 2008, approved an
amendment to the City Charter which established the Code of Ethics and Conduct for elected
officials and members of appointed boards, commissions, and committees to assure public
confidence. A copy of the City's Code can be found on the Clerk of the Council's webpage. The
following are the core values expressed:

PUBLIC COMMENTS
Pursuant to Government Code Sec. 54954.3, the public may address the Commission on any and
all matters under the Commission's jurisdiction. To speak, please register by submitting a
completed "Request to Speak" form to the Commission Secretary. Speaker forms are available on
the speaker's podium and Chamber Lobby.
• To speak on an item on the Agenda, enter the Agenda item number on your speaker form.
The Chairperson will call your name when that Agenda item is considered.
• To speak on an item not on the Agenda, check the Public Comments box on your speaker
form. The Chairman will call your name during the Public Comments portion of the
meeting.
Members of the public are allowed three (3) minutes to speak on each agenda item, but when any
group desires to address the committee, the committee may request that its members agree on a
spokesperson to make the presentation.
AGENDA INFORMATION
The agenda descriptions provide the public with a general summary of the items of business to be
considered by the Commission. The Commission is not limited in any way by the "Recommended
Action" and may take any action which the council deems to be appropriate on an agenda item.
Except as otherwise provided by law, no action shall be taken on any item not listed on the
agenda. All supporting documentation for this Agenda is available for public review in the
Planning Division during the business hours, 8:00 a.m. — 4:00 p.m., Monday through Friday. The
Planning Division is located in City Hall, Ross Annex, Second Floor, 20 Civic Center Plaza, Santa

Consent Calendar - All matters listed under the Consent Calendar are considered to be routine

Senate Bill 343 - As required by Senate Bill 343, any non - confidential writings or documents
provided to a majority of the Commission members regarding any item on this agenda will be

Commissioner Hitterdale:
• Inquired about vacancies on the Historic Resources Commission.
• Inquired about status of Historic Exterior Modification Application for 214 East
Santa Clara Avenue that was adjourned for lack of quorum at the July
meeting. Planning Manager Haluza stated applicant requested a continuance
to January 2011.
EXCUSE OF ABSENCES
Commissioner Plascencia made a motion to excuse the absence of
Commissioner O'Callaghan; the motion was seconded by Commissioner Rogers
and unanimously approved by the Commission with a vote of 5:0.

2009 -2010 CERTIFIED LOCAL GOVERNMENT ANNUAL REPORT
In 2002, the California State Office of Historic Preservation approved a resolution
establishing the City of Santa Ana as a Certified Local Government (CLG) for historic
preservation. One of the requirements of this program is the completion of an annual
report that documents the City's preservation activity for the previous fiscal year. A
copy of this report is attached for the Historic Resources Commission to review.

REGARDING THE TWIST BASLER HOUSE
Principal Planner Vince Fregoso discussed the Historic Commission's desire to
prepare a letter to the City Council outlining concerns with the Twist Basler
House rehabilitation. Associate Planner Soboleske provided an update of the
work done to the property.
Commission discussion ensued regarding exterior modifications to the Twist
Basler building. Commissioner Chinn recommended a sub - committee to evaluate
the completed work and also requested a copy of the resolution submitted to City
Council by the Historic Resources Commission regarding One Broadway Plaza
for review.
MOTION: Create Ad Hoc Committee to review the original resolution;
Commissioners Dickman, Chinn and O'Callaghan were elected as
committee members to work with staff ( Fregoso and Soboleske).
Principal Planner Fregoso will obtain copy of mitigation measures
and development agreement for Committee review. The Ad Hoc
Committee will be contacted by staff to coordinate a date /time for a
meeting.

Chair Schaefer commented on West Floral Park /Floral Park Neighborhoods, and
indicated should not be just Flower Street. Chair Schaefer referred to memo
regarding "Eligibility for Listing on the Santa Ana Register of Historical
Properties" and requested a complete list to be emailed to the Commission. By-
laws state Flower Street used as a dividing line, thus two districts exist.
Associate Planner Soboleske:
• Commented on West Floral Park's survey regarding nominations that
were not placed, indicated that only qualified properties were listed as
Key or Landmark. Chairman Schaefer requested a follow up report.
• Recommended Ad Hoc Committee to review nominations for 2009
Award Program for Outstanding Historic Preservation Projects.

Basic City Council Meeting
Information
Code of Ethics and Conduct - The people of the City of Santa Ana, at an election held on February
5, 2008, approved an amendment to the City Charter which established the Code of Ethics and
Conduct for elected officials and members of appointed boards, commissions, and committees to
assure public confidence. A copy of the City's Code can be found on the Clerk of the Council's
webpage. The following are the core values expressed: Integrity • Honesty • Responsibility
Fairness • Accountability • Respect • Efficiency
Agenda. Information - The agenda descriptions provide the public with a general summary of the
items of business to be considered by the Council. The Council is not limited in any way by the
"Recommended Action" and may take any action which the council deems to be appropriate on an
agenda item. Except as. otherwise provided by law, no action shall be taken on any item not listed
on the agenda.
Public Comments /Public Input - Pursuant to Government Code Sec. 54954.3, the public may
address the City Council, Community Redevelopment Agency, and /or Housing Authority on any
and all matters within the City of Santa Ana's jurisdiction.
At the discretion of the Chair, at the first Public Comment portion of the meeting, all comments
may be considered jointly. The public will be given the opportunity to speak on any and all
matters contained on any of the Consent Calendar and Business Calendar items and /or on issues
of public interest within the jurisdiction of the City. For public hearings, members of the public

Fund and appropriating funds to the Select Street Construction Fund.

RECOMMENDED ACTIONS:
1. Award a contract to J. Desigio Construction, Inc., the lowest
responsible bidder, in accordance with unit bid prices for the
base bid in the estimated amount of $1,598,092 for construction
of Riverview Neighborhood Water Main Improvements.
2. Approve a Funding Analysis with a total estimated construction
cost of $1,997,500.
23B CONTRACT AWARD FOR SR55 /MACARTHUR BOULEVARD RAMPS
WIDENING (PROJECT NO. 072503) - Public Works Agency
Continued from the August 2, 2010 City Council meeting by a vote of 7 -0.
RECOMMENDED ACTIONS:
1. Award a contract to Peterson -Chase General Engineering
Construction, Inc., the lowest responsible bidder, in accordance
with unit bid prices in the estimated amount of $1,126,850.64 for
construction of SR -55 /MacArthur Boulevard Ramps Widening.
2. Approve a Funding Analysis with a total estimated construction
cost of $1,577,000.
3. Direct the City Manager and Clerk of the Council to execute the
attached Construction Cooperative Agreement with Caltrans for
the State Route 55 /MacArthur Boulevard Ramps Widening project.

District annual report.

Inc., a non - profit corporation, in the amount of $1,294.37 to

Recommend that the City Council authorize the City Manager and Clerk of the Council to execute
the attached agreement with Thomas and Amy Tsotsis, property owners, for the structure located
at 2126 North Ross Street subject to non - substantive changes approved by the City Manager and
City Attorney.
Request of Applicant
The applicants, Thomas and Amy Tsotsis, request -the approval of Historic Property Preservation
Agreement No. 2010 -19 (Mills Act) between the property owner and the City of Santa Ana.
Property Location and Site Description
The subject property includes a Spanish Colonial Revival styled residence located at 2126 North
Ross Street, between Santa Clara Avenue and Nineteenth Street, and is within the Floral Park
neighborhood. Surrounding land uses are all residential (Exhibit 1). The lot is 9,250 square feet,
and is developed with a 1,381 square foot home and a detached garage.
Project Background
In March 1999, the City Council approved an ordinance authorizing Historic Property Preservation
Agreements (HPPA), commonly known as the Mills Act contracts, for eligible historic properties.
The agreement provides monetary incentive to the property owner in the form of a property tax
reduction in exchange for the owner's voluntary commitment to maintain the property in a good
state of repair and to rehabilitate the property as necessary to maintain its character and
appearance. Once recorded, the agreement triggers the use of a different valuation method in
determining the property's assessed value, thereby resulting in potentially significant property tax
savings for the owner.

One of the eligibility requirements for the Mills Act is that the property must be listed on the Santa
Ana Register of Historical Properties pursuant to Government Code Section 502380.1. The
subject property was placed on the local register as the MacKay House and categorized as
Contributive in 2007 by the Historic Resources Commission (Exhibit 2).
Analysis of the Issues
Upon consideration of the application, it is recommended that the City enter into a Historic Property
Preservation Agreement (Exhibit 3). The benefits of executing this agreement include, but are not
limited to, the following:
1. Reduced property tax to allow reinvestment for the long term preservation of the property.
2. Allows for a mechanism to provide for property rehabilitation.
3. Provides an additional incentive for potential buyers to purchase historic structures.
4. Discourages inappropriate alterations to the historic property.
5. Provides an opportunity for visual improvement to the physical environment of the
community.
6. Offers additional support and attention for historic districts and historic structures in the City.
Public Notification
This subject site is located within the Floral Park neighborhood. The president of this
Neighborhood Association was notified by mail prior to this meeting date although this is not a
public hearing item. No areas of concern were identified by the Neighborhood Association
president, nor was there a request that the applicant present the project to a meeting of their
members.
CEQA Compliance
In accordance with the California Environmental Quality Act, the recommended action is exempt
from further review under General Rule Section 15061(b)(3), and therefore, the recommended
action is exempt from further review.

Conclusion
Since the property meets all the requirements for eligibility for a Historic Property Preservation
Agreement, and there are no code violations noted at this site, a positive recommendation for a
Historic Property Preservation Agreement is given.

ARCHITECTURAL STYLE: Mission /Spanish Colonial Revival
The Mission/Spanish Colonial Revival style, as its name implies, encompasses two major subcategories. The Mission Revival
vocabulary, popular between 1894 and 1920, drew its inspiration from the missions of the Southwest. Identifying features include
curved parapets (or espadana); red tiled roofs and coping; low- pitched roofs, often with overhanging eaves; porch roofs supported by
large, square piers, arches; and wall surfaces commonly covered in smooth stucco. The Spanish Colonial Revival flourished between
1915 and 1940, reaching its apex during the 1920s and 1930s. The movement received widespread attention after the Panama -
California Exposition in San Diego in 1915, where lavish interpretations of Spanish and Mexican prototypes were showcased. Easily
recognizable hallmarks of the Spanish Colonial Revival are low- pitched roofs, usually with little or no overhangs and red tile roof
coverings, flat roofs surrounded by tiled parapets, and stuccoed walls. The Spanish vocabulary also includes arches, asymmetry,
balconies and patios, window grilles, and wood, wrought iron, tile, or stone decorative elements.
SUMMARY /CONCLUSION:
The MacKay House qualifies for listing in the Santa Ana Register of Historical Properties under Criterion 1 for its exemplification of
the distinguishing characteristics of the Spanish Colonial Revival style. Additionally, the house has been categorized as
"Contributive" because it "contributes to the overall character and history" of Santa Ana, and, as an example of the Spanish Colonial
Revival style in the Floral Park neighborhood "is a good example of period architecture" (Municipal Code, Section 30 -2.2).

This Spanish Colonial Revival residence was built as a one -story home but recently (2002) was expanded to two. The
original portion of the house comprises the front (east) end of building. Stucco -clad, the building features a complex roof
consisting of tiled front and side gables, a flat- section rimmed by a parapet, and hipped roof "towers." The roof configuration
of the upper story echoes that of the lower. The fagade is asymmetrical in composition, with a porte cochere spanning the
driveway on the north and merging into a covered entry porch crowned by the original of the two towers. Three arches,
varied in width and degree of curvature, pierce the porte cochere and porch. South of the porch, a front-gabled wing projects
forward and contains a large, multi ,caned window whose segmented head accommodates a lunette with radiating muntins.
The flat roofed wing that marks the southeast corner of the building is anchored by buttress and contains a triple window
shaded by a canvas awning. The addition, setback so as not to overwhelm the original building, echoes the vocabulary and
proportions of the lower story. It incorporates a characteristically Spanish Colonial Revival wood - railed balcony visible on the
north elevation and an attached, stucco- covered chimney on the south elevation. The properly is in good condition and also
includes a similarly designed garage visible through the porte cochere and a pool and pool house which are hidden from
view.

The MacKay House is architecturally significant as a representative example of the Spanish Colonial Revival style. The house
retains its Spanish character despite the sizeable addition made in 2002 because of the setback and design of the new second
floor, including its proportions, materials, massing, and detailing. City of Santa Ana records indicate that the house and garage,
valued at $5,000, were originally constructed in March 1930 by Roy Russell, one of the primary developers of the Floral Park
neighborhood. Curiously enough, a building permit for a swimming pool, valued at $350, was issued prior to that for the house, in
1929. When the address first appears in city directories in 1931, Kenneth MacKay, the district manager of the Union Central Life
Insurance Company, and his wife Clarice were the listed residents. From 1932 through 1935, Howard L. Stone, a foreman for the
Telephone Company, and his wife Marquita occupied the house. In subsequent years, ownership of the residence changed multiple
times.

Santa Ana was founded by William Spurgeon in 1869 as a speculative town site on part of the Spanish land grant known as
Rancho Santiago de Santa Ana. The civic and commercial core of the community was centered around the intersection of
Main and Fourth Streets. Stimulated by the arrival of the Santa Fe Railroad and incorporation as a city in 1886, and selection
as the seat of the newly created County of Orange in 1889, the city grew outwards, with residential neighborhoods
developing to the north, south, and east of the city center. Agricultural uses predominated in the outlying areas, with
cultivated fields and orchards dotted with widely scattered farmhouses.
The MacKay House is located in Floral Park, a neighborhood northwest of downtown Santa Ana bounded by East
Seventeenth Street, North Flower Street, Riverside Drive, and Broadway. Groves of oranges, avocados, and walnuts and
widely scattered ranch houses characterized this area before 1920. Developerand builder Allison Honer (1897- 1981),
credited as the subdivider and builder of a major portion of northwest Santa Ana, arrived in Santa Ana from Beaver Falls,
New York in 1922 (Talbert, pages 353 -356). "Before nightfall on the day of his arrival, Mr. Honer purchased a parcel of land.
And that month, he began building custom homes in Santa Ana" (Orange County Register, September 15, 1981). The parcel
chosen became the Floral Park subdivision between Seventeenth Street and Santiago Creek. "When built in the 1920s, the
Floral Park homes were the most lavish and expensive in the area. They sold for about $45,000 each" (Orange County
Register, September 15, 1981). Revival architecture in a wide variety of romantic styles was celebrated in the 1920s and
1930s and Floral Park showcased examples of the English Tudor, French Norman, Spanish Colonial, and Colonial Revival.
The Allison Honer Construction Company went on to complete such notable projects as the 1935 Art Deco styled Old Santa
Ana City Hall, the El Toro Marine Base during World War II, and the 1960 Honer Shopping Plaza. Honer lived in the
neighborhood he had helped to create, at 615 West Santa Clara Avenue.
In the late 1920s and 1930s, another builder, Roy Roscoe Russell (1881 - 1965), continued developing the groves of Floral
Park. An early Russell project was his 1928 subdivision of Victoria Drive between West Nineteenth Street and West Santa
Clara Avenue. The homes were quite grand and displayed various revival styles, including Russell's own large, Colonial
Revival mansion at 2009 Victoria Drive. In the early post World War II years, Floral Park continued its development as
numerous, smaller, single - family houses were built. Continuing in the Floral Park tradition, they were mostly revival in style.
In the 1950s, low, horizontal Ranch Style houses completed the growth of Floral Park. Today (2006) Floral Park maintains its
identity as the premier neighborhood of Santa Ana, historically home to many affluent and prominent citizens.
The MacKay House also qualities for listing in the Santa Ana Register of Historical Properties under Criterion 1 for its
exemplification of the distinguishing characteristics of the Spanish Colonial Revival style. Typical features of this style
illustrated by the house include its combination of stucco cladding with tiled roofs, the use of arched openings as a unifying
theme, and the incorporation of a romantic feature such as decorative tower into the design. Additionally, the house has
been categorized as "Contributive" because it "contributes to the overall character and history" of Santa Ana, and, as an
example of the Spanish Colonial Revival style is a good example of period architecture." Character -defining exterior
features of the MacKay House that should be preserved include, but may not be limited to, materials and finishes (stucco,
wood); original roof configuration and detailing; original windows and doors where extant; porch and porte cochere;
architectural details such as vents, buttress, and slightly raised molding at the roofline; and garage.

This agreement ( "Agreement ") is made and entered into this May 2, 2011 by and
between the City of Santa Ana, a charter city and municipal corporation duly organized and
existing under the Constitution and laws of the of the State of California (hereinafter referred to
as "City "), and Thomas and Ann Tsotsis, (hereinafter referred to as "Owners "), owner of real
property located at 2126 North Ross Street, Santa Ana, California, 92706 in the County of
Orange and listed on the Santa Ana Register of Historical Properties.
RECITALS
A. The City Council of the City of Santa Ana is authorized by California
Government Code Section 50280 et seq. (known as the "Mills Act ") to enter into
contracts with Owner of qualified historical properties to provide for appropriate
use, maintenance, rehabilitation and restoration such that these historic properties
retain their historic character and integrity.
B. The Owner possess fee title in and to that certain qualified real property together
with associated structures and improvements thereon, located at 2126 North Ross
Street, Santa Ana, CA, 92706 and more particularly described in Exhibit "A,"
attached hereto and incorporated herein by reference, and hereinafter referred to
as the "Historic Property ".
C. The Historic Property is officially designated on the Santa Ana Register of
Historical Properties pursuant to the requirements of Chapter 30 of the Santa Ana
Municipal Code.
D. The City and the property Owner, for their mutual benefit, now desire to enter
into this Agreement which defines and limits the use and alteration of this
Historic Property in order to enhance and maintain its value as a cultural and
historical resource for the Owner and for the community; to prevent inappropriate
alterations to the Historic Property and to ensure that repairs, additions, new
building, and other changes are appropriate; and to ensure that rehabilitation and
maintenance are carried out in an exemplary manner.

E. The Owner and the City intend to carry out the purposes of California
Government Code, Chapter 1, Part 5 of Division 1 of Title 5, Article 12, Section
50280 et seq., which will enable the Historic Property to qualify for an assessment
of valuation as a restricted historical property pursuant to Article 1.9, Sec. 439 et
seq., Chapter 3 Part 2 of Division 1 of the California Tax and Revenue Code.
NOW, THEREFORE, the City of Santa Ana and the Owners of the Historic Property
agree as follows:
1. Effective Date and Terms of Agreement.
This Agreement shall be effective and commence on May 2, 2011, and shall remain in
effect for a term of ten (10) years thereafter. Each year, upon the anniversary of the effective
date of this Agreement, such initial term will automatically be extended as provided in California
Government Code Sections 50280 through 50290 and in Section 2, below.
2. Renewal.
a. Each year on the anniversary of the effective date of this Agreement, a year shall
automatically be added to the initial ten (10) year term of this Agreement unless written notice of
nonrenewal is served as provided herein.
b. If the Owners or the City desire(s) in any year not to renew the Agreement, the
Owner or City shall serve written notice of nonrenewal of the Agreement on the other party.
Unless such notice is served by the Owners to the City at least ninety (90) days prior to the
annual renewal date, or served by the City to the Owners at least sixty (60) days prior to the
annual renewal date, one (1) year shall automatically be added to the term of the Agreement as
provided herein.
C. Within 30 days from receipt of City's notice of nonrenewal, the Owners may file
a written protest of City's decision of nonrenewal. The City may, at any time prior to the annual
renewal date of the Agreement, withdraw its notice to the Owners of nonrenewal.
d. If either the Owners or the City serves notice to the other of nonrenewal in any
year, the Agreement shall remain in effect for the balance of the term then remaining, either from
its original execution or from the last renewal of the Agreement, whichever may apply.
3. Standards and Conditions for Historic Property.
During the term of this Agreement, the Historic Property shall be subject to the following
conditions, requirements and restrictions:

a. Owners shall maintain the Historic Property in a good state of repair and shall
preserve, maintain, and, where necessary, restore or rehabilitate the property and its character -
defining features, notably the general architectural form, style, materials, design, scale,
proportions, organization of windows, doors, and other openings, textures, details, mass, roof
line, porch and other aspects of the appearance of the exterior to the satisfaction of the City.
b. All changes to the Historic Property shall comply with applicable City plans and
regulations, and conform to the rules and regulations of the Office of Historic Preservation of the
State of Department of Parks and Recreation, namely the U.S. Secretary of the Interior's
Standards and Guidelines for Historic Preservation Projects. These guidelines are attached
hereto, marked as Exhibit B, and incorporated herein by this reference. The condition of the
exterior of the property, as of the effective date of this Agreement, is documented in photographs
attached hereto as Exhibit B and incorporated herein by reference. Owner shall continually
maintain the Historic Property in the same or better condition as documented in Exhibit C.
C. A view corridor enabling the general public to see the Historic Property from the
public right -of -way shall be maintained, and Owners shall not be permitted to block the view
corridor to the property with any new structure, such as walls, fences or shrubbery, so as to
prevent the viewing of the historic landmark by the public.
d. The following are prohibited: Demolition of the Historic Property or destruction
of character - defining features of the building or site; removal of trees and other major vegetation
unless removal is approved by a rehabilitation plan approved by the Historic Resources
Commission, paving of yard surface; exterior alterations or additions unless approved by the
Historic Resources Commission and such alternations are in keeping with the Secretary of
Interior's Standards; deteriorating, dilapidated or unrepaired structures such as fences, roofs,
doors, walls, and windows; storage of junk, trash, debris, discarded or unused objects such as
cars, appliances, or furniture; and other unsightly by decoration, structure or vegetation which is
unsightly by reason of its height, condition, or inappropriate location.
e. Owners shall allow reasonable periodic examination, by prior appointment, of the
interior and exterior of the Historic Property by representatives of the County Assessor, the State
Department of Parks and Recreation, the State Board of Equalization, and the City of Santa Ana
as may be necessary to determine the Owner' compliance with the terms and provisions of this
Agreement.
4. Furnishing of Information.
The Owners hereby agree to furnish the City with any and all information requested
which may be necessary or advisable to determine compliance with the terms and provisions of
this Agreement.

5. Cancellation.
a. The City, following a duly noticed public hearing by the City Council as set forth
in Government Code Section 50280, et. seq., may cancel this Agreement if it determines that the
Owner have breached any of the conditions of this Agreement, or have allowed the property to
deteriorate to the point that it no longer meets the standards for a qualified Historic Property, or
if the City determines that the Owner have failed to restore or rehabilitate the property in the
manner specified in Section 3 of this Agreement. If a contract is cancelled for these reasons, the
Owner shall pay a cancellation fee to the County Auditor as set forth in Government Code
Section 50286. This cancellation fee shall be a percentage (currently set at twelve and one -half
(12 %) percent by Government Code Section 50286) of the current fair market value of the
property at the time of the cancellation, as determined by the county assessor, without regard to
any restriction imposed pursuant to this Agreement.
b. If the Historic Property is destroyed by earthquake, fire, flood or other natural
disaster such that in the opinion of the City Building Official more than sixty (60) percent of the
original fabric of the structure must be replaced, this Agreement shall be canceled because, in
effect, the historic value of the structure will have been destroyed. No fee shall be imposed in
the case of destruction by acts of God or natural disaster.
C. If the Historic Property is acquired by eminent domain and the City Council
determines that the acquisition frustrates the purpose of this Agreement, this Agreement shall be
cancelled and no fee imposed, as specified in Government Code Section 50288.
6. Enforcement of Agreement.
a. In lieu of and/or in addition to any provisions to cancel the Agreement as
referenced herein, the City may specifically enforce, or enjoin the breach of, the terms of the
Agreement. In the event of a default, under the provisions to cancel the Agreement by the
Owner, the City shall give written notice to the Owners by registered or certified mail, and if
such a violation is not corrected to the reasonable satisfaction of the Deputy City Manager for
Development Services or designee within thirty (30) days thereafter, or if not corrected within
such a reasonable time as may be required to cure the breach or default, or default cannot be
cured within thirty (30) days (provided that acts to cure the breach or default may be commenced
within thirty (30) days and shall thereafter be diligently pursued to completion by the Owners),
then the City may, without further notice, declare a default under the terms of this Agreement
and may bring any action necessary to specifically enforce the obligations of the Owner growing
out of the terms of this Agreement, apply to any court, state or federal, for injunctive relief
against any violation by the Owners or apply for such relief as may be appropriate.
b. The City does not waive any claim of default by the Owners if the City does not
enforce or cancel this Agreement. All other remedies at law or in equity which are not otherwise
provided for in this Agreement or in the City's regulations governing historic properties are
available to the City to pursue in the event that there is a breach of this Agreement. No waiver by

the City of any breach or default under this Agreement shall be deemed to be a waiver of any
other subsequent breach thereof or default hereunder.
7. Binding effect of Agreement.
a. The Owner hereby subject the Historic Property, located at 2126 North Ross
Street, Assessor Parcel Number, 002 - 112 -15, and more particularly described in Exhibit A, in
the City of Santa Ana, to the covenants reservations, and restrictions as set forth in this
Agreement.
b. The City and Owners hereby declare their specific intent that the covenants,
reservations and restrictions as set forth herein shall be deemed covenants running with the land
and shall pass to and be binding upon the Owner's successors and assigns in title or interest to
the Historic Property. Every contract, deed, or other instrument hereinafter executed, covering
or conveying the Historic Property or any portion thereof, shall conclusively be held to have
been executed, delivered, and accepted subject to the tenants, restrictions, and reservations
expressed in this Agreement regardless of whether such covenants, restrictions and reservations
are set forth in such contract, deed, or other instrument.
8. No Compensation.
Owners shall not receive any payment from the City in consideration of the obligation
imposed under this Agreement, it being recognized that the consideration for the execution of
this Agreement is the substantial public benefit to be derived therefrom and the advantage that
will accrue to the Owners as a result of the effect upon the assessed value of the property on the
account of the restrictions on the use and preservation of the property.
9. Notice.
Any notice required by the terms of this Agreement shall be sent to the address of the
respective parties as specified below or at other addresses that may be later specified by the
parties hereto.

10. General Provisions.
a. None of the terms, provisions, or conditions of this Agreement shall be deemed
to create a partnership between the parties hereto and any of their heirs, successors, or assigns,
nor shall such terms, provisions or conditions cause them to be considered joint ventures or
members of any joint enterprise.
b. The Owners agree to and shall indemnify and hold the City and its elected and
appointed officials, officers, agents, and employees harmless from liability for damage or claims
for damage for personal injuries, including death, and claims for property damage which may
arise from the direct or indirect use or operations of the Owners or those of his or her contractor,
subcontractor, agenda, employee, or other person acting on his or her behalf which relates to the
use, operation, and maintenance of the Historic Property. The Owners hereby agree to and shall
defend the City and its elected and appointed officials, officers, agents, and employees with
respect to any and all actions for damages caused by, or alleged to have been caused by, reason
of the Owner's activities in connection with the Historic Property.
C. This hold harmless provision applies to all damages and claims for damages
suffered, or alleged to have been suffered, and costs of defense incurred, by reason of the
operations referred to in this Agreement regardless of whether or not the City prepared, supplied,
or approved the plans, specifications or other documents for the Historic Property.
d. All of the Agreements, rights, covenants, reservations, and restrictions
contained in this Agreement shall be binding upon and shall inure to the benefit of the parties
herein, their heirs, successors, legal representatives, assigns, and all persons acquiring any part or
portion of the Historic Property, whether by operation of law on in any manner whatsoever.
e. In the event legal proceedings are brought by any party or parties to enforce or
restrain a violation of any of the covenants, reservations, or restrictions contained herein, or to
determine the rights and duties of any party hereunder, the prevailing party in such proceeding
may recover all reasonable attorney's fees to be fixed by the court, in addition to court costs and
other relief ordered by the court.
f. In the event that any of the provisions of this Agreement are held to be
unenforceable or invalid by any court of competent jurisdiction, or by subsequent preemptive
legislation, the validity and enforceability of the remaining provisions, or portions thereof, shall
not be effected thereby.
g. This Agreement shall be construed and governed in accordance with the laws of
the State of California.

11. Recordation.
No later than twenty (20) days after the parties execute and enter into this Agreement, the
City shall cause this Agreement to be recorded in the office of the County Recorder of the
County of Orange.
12. Notice of the Contract to Office of Historic Preservation.
No later than six (6) months of entering into the contract, the owner or agent of an owner
shall provide written notice of this Agreement to the Office of Historic Preservation.
13. Amendments.
This Agreement may be amended, in whole or in part, only by a written recorded
instrument executed by the parties hereto.
14. Effective Date
This Agreement shall be effective on the day and year first written above.

Exterior work shall be reviewed by the Historic Resources Commission and subject to the U.S.
Secretary of the Interior's Standards for Rehabilitation of Historic Buildings, as follows:
1. Every reasonable effort shall be made to provide a compatible use for a property
which requires minimal alteration of the building, structure, or site and its
environment, or to use a property for its originally intended purpose.
2. The distinguishing original qualities or character of a building, structure or site
and its environment shall not be destroyed. The removal or alteration of any
historic material or distinctive architectural features should be avoided when
possible.
3. All buildings, structures, and sites shall be recognized as products of their own
time. Alterations that have no historical basis and which seek to create an earlier
appearance shall be discouraged.
4. Changes which may have taken place in the course of time are evidence of the
history and development of a building, structure, or site and its environment.
These changes may have acquired significance in their own right, and this
significance shall be recognized and respected.
5. Distinctive stylistic features or examples of skilled craftsmanship which
characterize a building, structure, or site shall be treated with sensitivity.
6. Deteriorated architectural features shall be repaired rather than replaced,
whenever possible. In the event replacement is necessary, the new material
should match the material being replaced in composition, design, color, texture,
and other visual qualities. Repair or replacement of missing architectural features
should be based on accurate duplications of features, substantiated by historic,
physical, or pictorial evidence rather than on conjectural designs or the
availability of different architectural elements from the other buildings or
structures.
7. The surface cleaning of structures shall be undertaken with the gentlest means
possible. Sandblasting and other cleaning methods that will damage the historic
building materials shall not be undertaken.
8. Every reasonable effort shall be made to protect and reserve archaeological
resources affected by, or adjacent to any project.
9. Contemporary design for alternations and additions to existing properties shall not
be discouraged when such alterations and additions do not destroy significant
historical, architectural or cultural material, an such design is compatible with

size, scale, color, material and character of the property, neighborhood, or
environment.
10. Wherever possible, new additions or alterations to structures shall be done in such
a manner that if such additions or alterations need to be removed in the future, the

Recommend that the City Council authorize the City Manager and Clerk of the Council to execute
the attached agreement with John M. and Ana P. Coil, property owners, for the structure located at
2024 North Victoria Drive subject to non - substantive changes approved by the City Manager and
City Attorney.
Request of Applicant
The applicants, John M. and Ana P. Coil, request the approval of Historic Property Preservation
Agreement No. 2011 -01 (Mills Act) between the property owner and the City of Santa Ana.
Property Location and Site Description
The subject property includes a Tudor Revival styled residence located at 2024 North Victoria
Drive and is within the Floral Park neighborhood. Surrounding land uses are all residential
(Exhibit 1). The lot is 12,244 square feet, and is developed with a 3,185 square foot home and a
detached garage.
Project Background
In March 1999, the City Council approved an ordinance authorizing Historic Property Preservation
Agreements (HPPA), commonly known as the Mills Act contracts, for eligible historic properties.
The agreement provides monetary incentive to the property owner in the form of a property tax
reduction in exchange for the owner's voluntary commitment to maintain the property in a good
state of repair and to rehabilitate the property as necessary to maintain its character and
appearance. Once recorded, the agreement triggers the use of a different valuation method in
determining the property's assessed value, thereby resulting in potentially significant property tax
savings for the owner.

One of the eligibility requirements for the Mills Act is that the property must be listed on the Santa
Ana Register of Historical Properties pursuant to Government Code Section 502380.1. The
subject property was placed on the local register as the Hammond -Haan House and categorized
as Landmark in 2003 by the Historic Resources Commission (Exhibit 2).
Analysis of the Issues
Upon consideration of the application, it is recommended that the City enter into a Historic Property
Preservation Agreement (Exhibit 3). The benefits of executing this agreement include, but are not
limited to, the following:
1. Reduced property tax to allow reinvestment for the long term preservation of the property.
2. Allows for a mechanism to provide for property rehabilitation.
3. Provides an additional incentive for potential buyers to purchase historic structures.
4. Discourages inappropriate alterations to the historic property.
5. Provides an opportunity for visual improvement to the physical environment of the
community.
6. Offers additional support and attention for historic districts and historic structures in the City.
Public Notification
This subject site is located within the Floral Park neighborhood. The president of this
Neighborhood Association was notified by mail prior to this meeting date although this is not a
public hearing item. No areas of concern were identified by the Neighborhood Association
president, nor was there a request that the applicant present the project to a meeting of their
members.
CEQA Compliance
In accordance with the California Environmental Quality Act, the recommended action is exempt
from further review under General Rule Section 15061(b)(3), and therefore, the recommended
action is exempt from further review.

ARCHITECTURAL STYLE: Tudor Revival
The Tudor Revival looked to medieval England for its inspiration. Signature features of the style include steeply pitched gables;
decorative half - timbering; arched openings, often Tudor or Gothic in form; asymmetrical arrangements of building features; tall brick
chimneys; and picturesque windows of leaded glass or diamond patterned lights. The more ambitious examples of the Tudor Revival
were executed in brick or even stone; however, stucco over wood frame is quite common in the forgiving climate of southern
California. The Tudor Revival was favored primarily for residential buildings, although small scale commercial buildings in the style
also occur. Born in the late nineteenth century, the Tudor Revival was associated with some Craftsman era construction but was most
popular during the 1920s and 1930s.
SUMMARY/CONCLUSION:
The Hammond -Haan House appears eligible for listing in the National Register of Historic Places and the California Register of
Historical Resources. It also qualifies for listing in the Santa Ana Register of Historical Properties under Criterion 1, for its
exemplification of the Tudor Revival style, and under Criterion 4b, for its association with prominent Santa Ana citizens Dana K.
Hammond and Otto R. Haan. The house also contributes to the historic character of the Floral Park neighborhood through its age,
style, scale, and historic associations. In addition, the Hammond -Haan House has been categorized as "Landmark" because the
building "appears to be eligible" to be placed on the National Register and the California Register and "has a unique architectural
significance" as an intact and representative example of the Tudor Revival style that contributes to the historic streetscape of North
Victoria Drive (Municipal Code, Section 30 -2.2).

Set back from the street beyond a deep front lawn and a screen of trees, this two -story residence exhibits the Tudor Revival
style. A complex hipped roof, covered in wood shingles and accented by a series of front gables, covers the building. Rafter
tails are visible in the eaves. The stuccoed exterior walls are enlivened with decorative half - timbering. In the center of the
principal portion of the fapade, the entry bay is executed in red and black bricks, laid vertically and horizontally in blocks of
three. Flanked by two smaif, rectangular, diamond paned windows, the slightly recessed entry contains a decoratively
paneled door that incorporates an arched peephole. Banks of multi -light windows to the left and right of the entry bay feature
leaded glass set within heavy wooden surrounds. The second story is cantilevered over the first, with a series of heavy
beams marking the overhang. Paired, leaded, diamond -paned casement windows occupy each of the three principal bays
beneath wall gables outlined by extended bargeboards. An interior chimney, located in the south half of the house, is
stuccoed and accented with randomly placed clinker bricks. Appearing unaltered from the street, the house was expanded
by one room in 1951 and partially remodeled in 1996. Landscaped with neatly clipped shrubs and lawns, the property also
contains a garage, which is not visible from the street due to the vegetation and the curved driveway on the north side of the
house.

The Hammond -Haan House is architecturally distinguished as a remarkably intact and characteristic example of the Tudor
Revival style of the early 1930s. Its period revival design, substantial scale, and generous setback contribute to the elegant
and distinctive streetscape on North Victoria Drive. It was built in 1934 for Harriet Hoxie at a cost of $12,500. The 1935
Orange County Directory indicates that Dana K. and Helen Hammond were the first owner residents of the house. Dana King
Hammond, characterized as `one of the leading educators of Orange County" by Mrs. Pleasants in her 1931 History of
Orange County (page 352), held a dual appointment as the principal of Santa Ana Polytechnic High School and dean of the

'1310. Significance (continued):
Santa Ana Junior College. Born in Maine in 1884 and educated at Dartmouth, Hammond came to Santa Ana as a teacher of
French and Spanish in 1912 and was responsible for the establishment of the junior college in 1915. In 1917, he both
married Helen Hoxie and assumed the leadership position at the two schools. Respected citizens of Santa Ana, the
Hammonds lived in the Victoria Drive house until 1941, when engineer Donald W. Darnell and his wife Dorothy moved in. By
1945, auto dealer Otto R. Haan, his wife Dora Mae, and their family had purchased the house. Haan, born in Michigan in
1879, spent his early career as a newsagent with various railroads, rising to a position of responsibility with the Fred Harvey
Company. He came to Santa Ana in 1916 or 1917 and purchased a Cadillac dealership. Over the years, he sold numerous
kinds of automobiles, expanding his business to include an auto showroom on South Main Street, a used car lot, and a paint
and body shop. A circa 1952 newspaper article chronicled his career, noted that he had operated the Chrysler and Plymouth
dealership since 1933 and that his operation at the time employed 34 with an annual payroll of $160,000. Prominent in the
civic and social affairs of Santa Ana, Haan also served on the Santa Ana City Council.
The Hammond -Haan House is located in Floral Park, a neighborhood northwest of downtown Santa Ana bounded by West
Seventeenth Street, North Flower Street, Riverside Drive, and Broadway. Groves of oranges, avocados, and walnuts and
widely scattered ranch houses characterized this area before 1920. Developer and builder Allison Honer (1897- 1981),
credited as the subdivider and builder of a major portion of northwest Santa Ana, arrived in Santa Ana from Beaver Falls,
New York in 1922 (Talbert, pages 353 -356). `Before nightfall on the day of his arrival, Mr. Honer purchased a parcel of land.
And that month, he began building custom homes in Santa Ana" (Orange County Register, September 15, 1981). The
parcel chosen became the Floral Park subdivision between Seventeenth Street and Santiago Creek. "When built in the
1920s, the Floral Park homes were the most lavish and expensive in the area. They sold for about $45,000 each" (Orange
County Register. September 15, 1981). Revival architecture in a wide variety of romantic styles was celebrated in the 1920s
and 1930s and Floral Park showcased examples of the English Tudor, French Norman, Spanish Colonial, and Colonial
Revival. The Allison Honer Construction Company went on to complete such notable projects as the 1935 Art Deco styled
Old Santa Ana City Hall, the El Toro Marine Base during World War II, and the 1960 Honer Shopping Plaza. Honer lived in
the neighborhood he had helped to create, at 615 West Santa Clara Avenue.
In the late 1920s and 1930s, another builder, Roy Roscoe Russell (1881- 1965), continued developing the groves of Floral
Park. An early Russell project was his 1928 subdivision of Victoria Drive between West Nineteenth Street and West Santa
Clara Avenue. The homes were quite grand and displayed various revival styles, including Russell's own large, Colonial
Revival mansion at 2009 Victoria Drive. In the early post World War 11 years, Floral Park continued its development as
numerous, smaller, single- family houses were built. Continuing in the Floral Park tradition, they were mostly revival in style.
In the 1950s, low, horizontal Ranch Style houses completed the growth of Floral Park. Today (2003) Floral Park maintains
its identity as the premier neighborhood of Santa Ana, historically home to many affluent and prominent citizens.
The Hammond -Haan House appears eligible for listing in the National Register of Historic Places and the California Register
of Historical Resources. It qualifies for listing in the Santa Ana Register of Historical Properties under Criterion 1 for its
exemplification of the Tudor Revival style. The use of decorative half - timbering, the combination of materials such as
stucco, brick and wood, the second story overhangs, and the incorporation of varied and picturesque window types are
notable in this regard. It also qualifies for the Santa Ana Register under Criterion 4b for its association with two prominent
families in the community. The house also contributes to the historic character of the Floral Park neighborhood through its
age, style, scale, and historic association with a prominent Orange County family. Additionally, the house has been
categorized as "Landmark" for its unique architectural significance as an example of the Tudor Revival style that contributes
to the historic streetscape of North Victoria Drive. All original exterior features of the Hammond -Haan House are considered
character defining and should be preserved. These features include, but may not be limited to: materials and finishes
(stucco, brick, wood); roof configuration and treatment, massing and composition; entry, doors and windows, architectural
detailing (exposed beam -ends, decorative half - timbering); and stucco and brick chimney.

HISTORIC PROPERTY PRESERVATION AGREEMENT
This agreement ( "Agreement ") is made and entered into this May 2, 2011 by and
between the City of Santa Ana, a charter city and municipal corporation duly organized and
existing under the Constitution and laws of the of the State of California (hereinafter referred to
as "City"), and John M. and Ann P. Coil, (hereinafter referred to as "Owners "), owner of real
property located at 2024 North Victoria Drive, Santa Ana, California, 92706 in the County of
Orange and listed on the Santa Ana Register of Historical Properties.
RECITALS
A. The City Council of the City of Santa Ana is authorized by California
Government Code Section 50280 et seq. (known as the "Mills Act") to enter into
contracts with Owner of qualified historical properties to provide for appropriate
use, maintenance, rehabilitation and restoration such that these historic properties
retain their historic character and integrity.
B. The Owner possess fee title in and to that certain qualified real property together
with associated structures and improvements thereon, located at 2024 North
Victoria Drive, Santa Ana, CA, 92706 and more particularly described in Exhibit
"A," attached hereto and incorporated herein by reference, and hereinafter
referred to as the "Historic Property".
C. The Historic Property is officially designated on the Santa Ana Register of
Historical Properties pursuant to the requirements of Chapter 30 of the Santa Ana
Municipal Code.
D. The City and the property Owner, for their mutual benefit, now desire to enter
into this Agreement which defines and limits the use and alteration of this
Historic Property in order to enhance and maintain its value as a cultural and
historical resource for the Owner and for the community; to prevent inappropriate
alterations to the Historic Property and to ensure that repairs, additions, new
building, and other changes are appropriate; and to ensure that rehabilitation and
maintenance are carried out in an exemplary manner.

E. The Owner and the City intend to carry out the purposes of California
Government Code, Chapter 1, Part 5 of Division 1 of Title 5, Article 12, Section
50280 et seq., which will enable the Historic Property to qualify for an assessment
of valuation as a restricted historical property pursuant to Article 1.9, Sec. 439 et
seq., Chapter 3 Part 2 of Division 1 of the California Tax and Revenue Code.
NOW, THEREFORE, the City of Santa Ana and the Owners of the Historic Property
agree as follows:
1. Effective Date and Terms of Agreement.
This Agreement shall be effective and commence on May 2, 2011, and shall remain in
effect for a term of ten (10) years thereafter. Each year, upon the anniversary of the effective
date of this Agreement, such initial term will automatically be extended as provided in California
Government Code Sections 50280 through 50290 and in Section 2, below.
2. Renewal.
a. Each year on the anniversary of the effective date of this Agreement, a year shall
automatically be added to the initial ten (10) year term of this Agreement unless written notice of
nonrenewal is served as provided herein.
b. If the Owners or the City desire(s) in any year not to renew the Agreement, the
Owner or City shall serve written notice of nonrenewal of the Agreement on the other party.
Unless such notice is served by the Owners to the City at least ninety (90) days prior to the
annual renewal date, or served by the City to the Owners at least sixty (60) days prior to the
annual renewal date, one (1) year shall automatically be added to the term of the Agreement as
provided herein.
C. Within 30 days from receipt of City's notice of nonrenewal, the Owners may file
a written protest of City's decision of nonrenewal. The City may, at any time prior to the annual
renewal date of the Agreement, withdraw its notice to the Owners of nonrenewal.
d. If either the Owners or the City serves notice to the other of nonrenewal in any
year, the Agreement shall remain in effect for the balance of the term then remaining, either from
its original execution or from the last renewal of the Agreement, whichever may apply.
3. Standards and Conditions for Historic Property.
During the term of this Agreement, the Historic Property shall be subject to the following
conditions, requirements and restrictions:

a. Owners shall maintain the Historic Property in a good state of repair and shall
preserve, maintain, and, where necessary, restore or rehabilitate the property and its character -
defining features, notably the general architectural form, style, materials, design, scale,
proportions, organization of windows, doors, and other openings, textures, details, mass, roof
line, porch and other aspects of the appearance of the exterior to the satisfaction of the City.
b. All changes to the Historic Property shall comply with applicable City plans and
regulations, and conform to the rules and regulations of the Office of Historic Preservation of the
State of Department of Parks and Recreation, namely the U.S. Secretary of the Interior's
Standards and Guidelines for Historic Preservation Projects. These guidelines are attached
hereto, marked as Exhibit B, and incorporated herein by this reference. The condition of the
exterior of the property, as of the effective date of this Agreement, is documented in photographs
attached hereto as Exhibit B and incorporated herein by reference. Owner shall continually
maintain the Historic Property in the same or better condition as documented in Exhibit C.
C. A view corridor enabling the general public to see the Historic Property from the
public right -of -way shall be maintained, and Owners shall not be permitted to block the view
corridor to the property with any new structure, such as walls, fences or shrubbery, so as to
prevent the viewing of the historic landmark by the public.
d. The following are prohibited: Demolition of the Historic Property or destruction
of character - defining features of the building or site; removal of trees and other major vegetation
unless removal is approved by a rehabilitation plan approved by the Historic Resources
Commission, paving of yard surface; exterior alterations or additions unless approved by the
Historic Resources Commission and such alternations are in keeping with the Secretary of
Interior's Standards; deteriorating, dilapidated or unrepaired structures such as fences, roofs,
doors, walls, and windows; storage of junk, trash, debris, discarded or unused objects such as
cars, appliances, or furniture; and other unsightly by decoration, structure or vegetation which is
unsightly by reason of its height, condition, or inappropriate location.
e. Owners shall allow reasonable periodic examination, by prior appointment, of the
interior and exterior of the Historic Property by representatives of the County Assessor, the State
Department of Parks and Recreation, the State Board of Equalization, and the City of Santa Ana
as may be necessary to determine the Owner' compliance with the terms and provisions of this
Agreement.
4. Furnishing of Information.
The Owners hereby agree to furnish the City with any and all information requested
which may be necessary or advisable to determine compliance with the terms and provisions of
this Agreement.

5. Cancellation.
a. The City, following a duly noticed public hearing by the City Council as set forth
in Government Code Section 50280, et. seq., may cancel this Agreement if it determines that the
Owner have breached any of the conditions of this Agreement, or have allowed the property to
deteriorate to the point that it no longer meets the standards for a qualified Historic Property, or
if the City determines that the Owner have failed to restore or rehabilitate the property in the
manner specified in Section 3 of this Agreement. If a contract is cancelled for these reasons, the
Owner shall pay a cancellation fee to the County Auditor as set forth in Government Code
Section 50286. This cancellation fee shall be a percentage (currently set at twelve and one -half
(12 %2) percent by Government Code Section 50286) of the current fair market value of the
property at the time of the cancellation, as determined by the county assessor, without regard to
any restriction imposed pursuant to this Agreement.
b. If the Historic Property is destroyed by earthquake, fire, flood or other natural
disaster such that in the opinion of the City Building Official more than sixty (60) percent of the
original fabric of the structure must be replaced, this Agreement shall be canceled because, in
effect, the historic value of the structure will have been destroyed. No fee shall be imposed in
the case of destruction by acts of God or natural disaster.
C. If the Historic Property is acquired by eminent domain and the City Council
determines that the acquisition frustrates the purpose of this Agreement, this Agreement shall be
cancelled and no fee imposed, as specified in Government Code Section 50288.
6. Enforcement of Agreement.
a. In lieu of and/or in addition to any provisions to cancel the Agreement as
referenced herein, the City may specifically enforce, or enjoin the breach of, the terms of the
Agreement. In the event of a default, under the provisions to cancel the Agreement by the
Owner, the City shall give written notice to the Owners by registered or certified mail, and if
such a violation is not corrected to the reasonable satisfaction of the Deputy City Manager for
Development Services or designee within thirty (30) days thereafter, or if not corrected within
such a reasonable time as may be required to cure the breach or default, or default cannot be
cured within thirty (30) days (provided that acts to cure the breach or default may be commenced
within thirty (30) days and shall thereafter be diligently pursued to completion by the Owners),
then the City may, without further notice, declare a default under the terms of this Agreement
and may bring any,action necessary to specifically enforce the obligations of the Owner growing
out of the terms of this Agreement, apply to any court, state or federal, for injunctive relief
against any violation by the Owners or apply for such relief as may be appropriate.
b. The City does not waive any claim of default by the Owners if the City does not
enforce or cancel this Agreement. All other remedies at law or in equity which are not otherwise
provided for in this Agreement or in the City's regulations governing historic properties are
available to the City to pursue in the event that there is a breach of this Agreement. No waiver by

the City of any breach or default under this Agreement shall be deemed to be a waiver of any
other subsequent breach thereof or default hereunder.
7. Binding effect of Agreement.
a. The Owner hereby subject the Historic Property, located at 2024 North Victoria
Drive, Assessor Parcel Number, 002- 101 -01, and more particularly described in Exhibit A, in
the City of Santa Ana, to the covenants reservations, and restrictions as set forth in this
Agreement.
b. The City and Owners hereby declare their specific intent that the covenants,
reservations and restrictions as set forth herein shall be deemed covenants running with the land
and shall pass to and be binding upon the Owner's successors and assigns in title or interest to
the Historic Property. Every contract, deed, or other instrument hereinafter executed, covering
or conveying the Historic Property or any portion thereof, shall conclusively be held to have
been executed, delivered, and accepted subject to the tenants, restrictions, and reservations
expressed in this Agreement regardless of whether such covenants, restrictions and reservations
are set forth in such contract, deed, or other instrument.
8. No Compensation.
Owners shall not receive any payment from the City in consideration of the obligation
imposed under this Agreement, it being recognized that the consideration for the execution of
this Agreement is the substantial public benefit to be derived therefrom and the advantage that
will accrue to the Owners as a result of the effect upon the assessed value of the property on the
account of the restrictions on the use and preservation of the property.
9. Notice.
Any notice required by the terms of this Agreement shall be sent to the address of the
respective parties as specified below or at other addresses that may be later specified by the
parties hereto.

10. General Provisions.
a. None of the terms, provisions, or conditions of this Agreement shall be deemed
to create a partnership between the parties hereto and any of their heirs, successors, or assigns,
nor shall such terms, provisions or conditions cause them to be considered joint ventures or
members of any joint enterprise.
b. The Owners agree to and shall indemnify and hold the City and its elected and
appointed officials, officers, agents, and employees harmless from liability for damage or claims
for damage for personal injuries, including death, and claims for property damage which may
arise from the direct or indirect use or operations of the Owners or those of his or her contractor,
subcontractor, agenda, employee, or other person acting on his or her behalf which relates to the
use, operation, and maintenance of the Historic Property. The Owners hereby agree to and shall
defend the City and its elected and appointed officials, officers, agents, and employees with
respect to any and all actions for damages caused by, or alleged to have been caused by, reason
of the Owner's activities in connection with the Historic Property.
C. This hold harmless provision applies to all damages and claims for damages
suffered, or alleged to have been suffered, and costs of defense incurred, by reason of the
operations referred to in this Agreement regardless of whether or not the City prepared, supplied,
or approved the plans, specifications or other documents for the Historic Property.
d. All of the Agreements, rights, covenants, reservations, and restrictions
contained in this Agreement shall be binding upon and shall inure to the benefit of the parties
herein, their heirs, successors, legal representatives, assigns, and all persons acquiring any part or
portion of the Historic Property, whether by operation of law on in any manner whatsoever.
e. In the event legal proceedings are brought by any party or parties to enforce or
restrain a violation of any of the covenants, reservations, or restrictions contained herein, or to
determine the rights and duties of any party hereunder, the prevailing party in such proceeding
may recover all reasonable attorney's fees to be fixed by the court, in addition to court costs and
other relief ordered by the court.
f. In the event that any of the provisions of this Agreement are held to be
unenforceable or invalid by any court of competent jurisdiction, or by subsequent preemptive
legislation, the validity and enforceability of the remaining provisions, or portions thereof, shall
not be effected thereby.
g. This Agreement shall be construed and governed in accordance with the laws of
the State of California.

11. Recordation.
No later than twenty (20) days after the parties execute and enter into this Agreement, the
City shall cause this Agreement to be recorded in the office of the County Recorder of the
County of Orange.
12. Notice of the Contract to Office of Historic Preservation.
No later than six (6) months of entering into the contract, the owner or agent of an owner
shall provide written notice of this Agreement to the Office of Historic Preservation.
13. Amendments.
This Agreement may be amended, in whole or in part, only by a written recorded
instrument executed by the parties hereto.
14. Effective Date
This Agreement shall be effective on the day and year first written above.

Exterior work shall be reviewed by the Historic Resources Commission and subject to the U.S.
Secretary of the Interior's Standards for Rehabilitation of Historic Buildings, as follows:
1. Every reasonable effort shall be made to provide a compatible use for a property
which requires minimal alteration of the building, structure, or site and its
environment, or to use a property for its originally intended purpose.
2. The distinguishing original qualities or character of a building, structure or site
and its environment shall not be destroyed. The removal or alteration of any
historic material or distinctive architectural features should be avoided when
possible.
3. All buildings, structures, and sites shall be recognized as products of their own
time. Alterations that have no historical basis and which seek to create an earlier
appearance shall be discouraged.
4. Changes which may have taken place in the course of time are evidence of the
history and development of a building, structure, or site and its environment.
These changes may have acquired significance in their own right, and this
significance shall be recognized and respected.
5. Distinctive stylistic features or examples of skilled craftsmanship which
characterize a building, structure, or site shall be treated with sensitivity.
6. Deteriorated architectural features shall be repaired rather than replaced,
whenever possible. In the event replacement is necessary, the new material
should match the material being replaced in composition, design, color, texture,
and other visual qualities. Repair or replacement of missing architectural features
should be based on accurate duplications of features, substantiated by historic,
physical, or pictorial evidence rather than on conjectural designs or the
availability of different architectural elements from the other buildings or
structures.
7. The surface cleaning of structures shall be undertaken with the gentlest means
possible. Sandblasting and other cleaning methods that will damage the historic
building materials shall not be undertaken.
8. Every reasonable effort shall be made to protect and reserve archaeological
resources affected by, or adjacent to any project.
9. Contemporary design for alternations and additions to existing properties shall not
be discouraged when such alterations and additions do not destroy significant
historical, architectural or cultural material, an such design is compatible with

size, scale, color, material and character of the property, neighborhood, or

the attached agreement with John L. Novak and Michelle D. Light, property owners, for the
structure located at 321 East Eighth Street subject to non - substantive changes approved by the
City Manager and City Attorney.
Request of Applicant
The applicants, John L. Novak and Michelle D. Light, request the approval of Historic Property
Preservation Agreement No. 2011 -03 (Mills Act) between the property owner and the City of Santa
Ana.
Property Location and Site Description
The subject property includes an Italianate styled residence located at 321 East Eighth Street and
is within the French Park National Register Historic District. Surrounding land uses are all
residential (Exhibit 1). The lot is 4,504 square feet, and is developed with a 1,032 square foot
home and a single car detached garage.
Project Background
In March 1999, the City Council approved an ordinance authorizing Historic Property Preservation
Agreements (HPPA), commonly known as the Mills Act contracts, for eligible historic properties.
The agreement provides monetary incentive to the property owner in the form of a property tax
reduction in exchange for the owner's voluntary commitment to maintain the property in a good
state of repair and to rehabilitate the property as necessary to maintain its character and
appearance. Once recorded, the agreement triggers the use of a different valuation method in
determining the property's assessed value, thereby resulting in potentially significant property tax
savings for the owner.

One of the eligibility requirements for the Mills Act is that the property must be listed on the Santa
Ana Register of Historical Properties pursuant to Government Code Section 502380.1. The
subject property was placed on the local register as the Chilton House and categorized as
Landmark in 2001 by the Historic Resources Commission (Exhibit 2).
Analysis of the Issues
Upon consideration of the application, it is recommended that the City enter into a Historic Property
Preservation Agreement (Exhibit 3). The benefits of executing this agreement include, but are not
limited to, the following:
1. Reduced property tax to allow reinvestment for the long term preservation of the property.
2. Allows for a mechanism to provide for property rehabilitation.
3. Provides an additional incentive for potential buyers to purchase historic structures.
4. Discourages inappropriate alterations to the historic property.
5. Provides an opportunity for visual improvement to the physical environment of the
community.
6. Offers additional support and attention for historic districts and historic structures in the City.
Public Notification
This subject site is located within the French Park neighborhood. The president of this
Neighborhood Association was notified by mail prior to this meeting date although this is not a
public hearing item. No areas of concern were identified by the Neighborhood Association
president, nor was there a request that the applicant present the project to a meeting of their
members.
CEQA Compliance
In accordance with the California Environmental Quality Act, the recommended action is exempt
from further review under General Rule Section 15061(b)(3), and therefore, the recommended
action is exempt from further review.

DESCRIPTIONIBACKGROUND RELATED TO PERIOD ARCHITECTURE:
The Italianate (Late Victorian) style is chiefly identified by its window treatment: tall, relatively narrow, double -hung sash, with flat,
arched, or flattened arch heads often emphasized by hood moldings. Other typical features include low hipped or flat roofs, bracketed
cornices, and, particularly in residential examples, a square tower or cupola. In commercial usage, a raised pediment bearing the
name or date of the building is not uncommon. A variety of siding materials are used, usually with stringeourses between stories, and
sometimes with wall planes framed by quoins, Used for both residential and commercial buildings from the mid nineteenth century
through the 1890s, the Italianate style was adapted to "Main Street" commercial buildings and simplified, becoming the "commercial
vernacular" of the era (Whiffen, 99).

A fine example of Victorian era design, this is a two -story residence in the Italianate style. A truncated hip roof crowns the building,
accented by a projecting front gable on the east end of the facade (south elevation). Curved brackets, placed at either side of the
second story windows, punctuate the enclosed soffits. A decorative bargeboard ornaments the gable end. Beneath the soffit
overhang, a vertically detailed frieze circles the building. Wide shiplap siding, trimmed with endboards, sheathes the house.
Spanning the first floor facade, a pent hipped roof tops a three -bay, attached, front porch. Turned columns whose carved brackets
form an arched porch frieze support the porch roof. The porch railing features carved balusters alternating with blocks pierced by
circular cutouts. Located in the central bay, the entry contains a paneled door topped by a transom and approached by six stairs. Orbs
surmount the newel posts of the stairway. Below the front gable, the east bay of the house consists of a two -story squared bay.
Patterned shingles accent the upper story of the bay. Windows are one - over -one double -hung sash, arranged singly or in pairs, and
simply framed. Moved to this location in 1986, the house is substantially unaltered. Contemporary additions to the property include
an iron fence at the front and a two -story, wood -frame garage building in the rear, both of which are compatible in style and materials
with the historic character of the house.
HISTORIC HIGHLIGHTS:
Robert Francis Chilton, who arrived in Santa Ana in 1876, was in the banking business in the City for more than twenty-five years.
The head cashier of the Orange County Trust and Savings Bank, Chilton served as City Treasurer and was appointed postmaster in
1885. His other activities included development of property in northwest Santa Ana and service as the secretary of the Masons
(excerpted from Marsh, 1998).
Threatened with demolition at its original location on Sixth Street, the house was moved to this location and restored by Robert and
Diann Marsh, prominent local historians, in 1986.

STATEMENT OF SIGNIFICANCE: (Discuss importance in terms of historical or architectural context as defined by theme,

Santa Ana was founded by William Spurgeon in 1869 as a speculative townsite on part of the Spanish land grant known as Rancho
Santiago de Santa Ana. In 1877, Spurgeon, along with James McFadden and James Fruit, formed the Western Development
Company with the intention of bringing the Southern Pacific Railroad from its then terminus in Anaheim into Santa Ana. Thinking to
capitalize on commercial growth around the railroad, the partners purchased 160 acres adjacent to the eastern city boundary at French
Street. Although they were successful in luring the Southern Pacific to a new depot on Fruit Street in Santa Ana in 1878, the expected
commercial development of "Santa Ana East" never materialized. Early growth and development of the town continued to be
centered further west around Fourth and Main Streets, with the result that the legacy of Santa Ana East is an angled street plan whose
intersection with the original city is marked by a small, triangular parcel, developed in the 1890s as a small park, now known as
French Park. Santa Ana continued to grow, stimulated by the arrival of the Santa Fe Railroad in 1886. Following its incorporation as
a city in 1886, Santa Ana was recognized as one of the leading communities in the area in 1889 when it became the seat of the newly
created county of Orange.
Beginning in the 1880s and continuing well into the twentieth century, the area around the park began to be developed with many of
the finest homes in Santa Ana. Examples of Victorian era, turn of the century, and Craftsman homes were built along the tree -lined
streets. By the 1920s, most streets in the neighborhood were fully developed, although a few revival styled single - family homes and
duplexes were built during the 1920s, and a handful of apartments constructed in the 1930s. From the nineteenth century onwards,
residents were a "Who's Who" of early Santa Ana and included bankers, attorneys, doctors, businessmen, ranchers, teachers and
others active in the civic and social life of the city.
Once known as the "Nob Hill" of Santa Ana, French Park declined in the 1940s and 1950s as some homes were converted into
rooming houses and others were allowed to deteriorate. In the 1960s and 1970s some houses were demolished and the properties
redeveloped with multi - family housing. However, a grass roots preservation effort begun in the late 1970s led to the establishment of
a local historic district in 1984 and the listing of the neighborhood in the National Register of Historic Places in 1999.
One of the activities undertaken in support of the historic district has been the relocation of several historic homes slated for
demolition into French Park. The Chilton House is a case in point, moved from Sixth Street to Eighth Street in 1986. The property is
architecturally significant as a remarkably intact and highly characteristic example of the Italianate style dating to the mid 1880s
"boom" period. It is also noteworthy for its association with a prominent early resident, Robert Chilton, and for its contribution to the
historic character of the French Park district. All original and restored exterior features of the Chilton House are considered to be
character defining and should be preserved. These features include, but may not be limited to: materials and finishes (shiplap siding,
shingling); roof configuration and detailing; porch configuration and treatment; bays; windows and doors; and architectural detailing
such as brackets, bargeboards, frieze, columns, etc.
SUMMARY /CONCLUSION:
The Chilton House was listed in the National Register of Historic Places in 1999 as a contributor to the French Park Historic District.
Under the regulations implementing the California Register of Historical Resources, the building is also listed in the California
Register. Included in the Santa Ana Register of Historical Property, the Chilton House has been categorized as "Landmark" because
it "is on the national register," "is on the state register," "has historical/cultural significance to the City of Santa Ana," for its
association with prominent early resident Robert Chilton, and it "has a unique architectural significance" as an intact example of
Italianate residential design (Municipal Code, Section 30 -2.2).

RECITALS

retain their historic character and integrity.
B. The Owner possess fee title in and to that certain qualified real property together
with associated structures and improvements thereon, located at 321 East Eighth
Street, Santa Ana, CA, 92701 and more particularly described in Exhibit "A,"
attached hereto and incorporated herein by reference, and hereinafter referred to
as the "Historic Property ".
C. The Historic Property is officially designated on the Santa Ana Register of
Historical Properties pursuant to the requirements of Chapter 30 of the Santa Ana
Municipal Code.
D. The City and the property Owner, for their mutual benefit, now desire to enter
into this Agreement which defines and limits the use and alteration of this
Historic Property in order to enhance and maintain its value as a cultural and
historical resource for the Owner and for the community; to prevent inappropriate
alterations to the Historic Property and to ensure that repairs, additions, new
building, and other changes are appropriate; and to ensure that rehabilitation and
maintenance are carried out in an exemplary manner.

of valuation as a restricted historical property pursuant to Article 1.9, Sec. 439 et
seq., Chapter 3 Part 2 of Division 1 of the California Tax and Revenue Code.
NOW, THEREFORE, the City of Santa Ana and the Owners of the Historic Property
agree as follows:
1. Effective Date and Terms of Agreement.
This Agreement shall be effective and commence on May 2, 2011, and shall remain in
effect for a term of ten (10) years thereafter. Each year, upon the anniversary of the effective
date of this Agreement, such initial term will automatically be extended as provided in California
Government Code Sections 50280 through 50290 and in Section 2, below.
2. Renewal.
a. Each year on the anniversary of the effective date of this Agreement, a year shall
automatically be added to the initial ten (10) year term of this Agreement unless written notice of
nonrenewal is served as provided herein.
b. If the Owners or the City desire(s) in any year not to renew the Agreement, the
Owner or City shall serve written notice of nonrenewal of the Agreement on the other party.
Unless such notice is served by the Owners to the City at least ninety (90) days prior to the
annual renewal date, or served by the City to the Owners at least sixty (60) days prior to the
annual renewal date, one (1) year shall automatically be added to the term of the Agreement as
provided herein.
C. Within 30 days from receipt of City's notice of nonrenewal, the Owners may file
a written protest of City's decision of nonrenewal. The City may, at any time prior to the annual
renewal date of the Agreement, withdraw its notice to the Owners of nonrenewal.
d. If either the Owners or the City serves notice to the other of nonrenewal in any
year, the Agreement shall remain in effect for the balance of the term then remaining, either from
its original execution or from the last renewal of the Agreement, whichever may apply.
3. Standards and Conditions for Historic Property.
During the term of this Agreement, the Historic Property shall be subject to the following
conditions, requirements and restrictions:

a. Owners shall maintain the Historic Property in a good state of repair and shall
preserve, maintain, and, where necessary, restore or rehabilitate the property and its character -
defining features, notably the general architectural form, style, materials, design, scale,
proportions, organization of windows, doors, and other openings, textures, details, mass, roof
line, porch and other aspects of the appearance of the exterior to the satisfaction of the City.
b. All changes to the Historic Property shall comply with applicable City plans and
regulations, and conform to the rules and regulations of the Office of Historic Preservation of the
State of Department of Parks and Recreation, namely the U.S. Secretary of the Interior's
Standards and Guidelines for Historic Preservation Projects. These guidelines are attached
hereto, marked as Exhibit B, and incorporated herein by this reference. The condition of the
exterior of the property, as of the effective date of this Agreement, is documented in photographs
attached hereto as Exhibit B and incorporated herein by reference. Owner shall continually
maintain the Historic Property in the same or better condition as documented in Exhibit C.
C. A view corridor enabling the general public to see the Historic Property from the
public right -of -way shall be maintained, and Owners shall not be permitted to block the view
corridor to the property with any new structure, such as walls, fences or shrubbery, so as to
prevent the viewing of the historic landmark by the public.
d. The following are prohibited: Demolition of the Historic Property or destruction
of character - defining features of the building or site; removal of trees and other major vegetation
unless removal is approved by a rehabilitation plan approved by the Historic Resources
Commission, paving of yard surface; exterior alterations or additions unless approved by the
Historic Resources Commission and such alternations are in keeping with the Secretary of
Interior's Standards; deteriorating, dilapidated or unrepaired structures such as fences, roofs,
doors, walls, and windows; storage of junk, trash, debris, discarded or unused objects such as
cars, appliances, or furniture; and other unsightly by decoration, structure or vegetation which is
unsightly by reason of its height, condition, or inappropriate location.
e. Owners shall allow reasonable periodic examination, by prior appointment, of the
interior and exterior of the Historic Property by representatives of the County Assessor, the State
Department of Parks and Recreation, the State Board of Equalization, and the City of Santa Ana
as may be necessary to determine the Owner' compliance with the terms and provisions of this
Agreement.
4. Furnishing of Information.
The Owners hereby agree to furnish the City with any and all information requested
which may be necessary or advisable to determine compliance with the terms and provisions of
this Agreement.

5. Cancellation.
a. The City, following a duly noticed public hearing by the City Council as set forth
in Government Code Section 50280, et. seq., may cancel this Agreement if it determines that the
Owner have breached any'of the conditions of this Agreement, or have allowed the property to
deteriorate to the point that it no longer meets the standards for a qualified Historic Property, or
if the City determines that the Owner have failed to restore or rehabilitate the property in the
manner specified in Section 3 of this Agreement. If a contract is cancelled for these reasons, the
Owner shall pay a cancellation fee to the County Auditor as set forth in Government Code
Section 50286. This cancellation fee shall be a percentage (currently set at twelve and one -half
(12 %2) percent by Government Code Section 50286) of the current fair market value of the
property at the time of the cancellation, as determined by the county assessor, without regard to
any restriction imposed pursuant to this Agreement.
b. If the Historic Property is destroyed by earthquake, fire, flood or other natural
disaster such that in the opinion of the City Building Official more than sixty (60) percent of the
original fabric of the structure must be replaced, this Agreement shall be canceled because, in
effect, the historic value of the structure will have been destroyed. No fee shall be imposed in
the case of destruction by acts of God or natural disaster.
C. If the Historic Property is acquired by eminent domain and the City Council
determines that the acquisition frustrates the purpose of this Agreement, this Agreement shall be
cancelled and no fee imposed, as specified in Government Code Section 50288.
6. Enforcement of Agreement.
a. In lieu of and/or in addition to any provisions to cancel the Agreement as
referenced herein, the City may specifically enforce, or enjoin the breach of, the terms of the
Agreement. In the event of a default, under the provisions to cancel the Agreement by the
Owner, the City shall give written notice to the Owners by registered or certified mail, and if
such a violation is not corrected to the reasonable satisfaction of the Deputy City Manager for
Development Services or designee within thirty (30) days thereafter, or if not corrected within
such a reasonable time as may be required to cure the breach or default, or default cannot be
cured within thirty (30) days (provided that acts to cure the breach or default may be commenced
within thirty (30) days and shall thereafter be diligently pursued to completion by the Owners),
then the City may, without further notice, declare a default under the terms of this Agreement
and may bring any action necessary to specifically enforce the obligations of the Owner growing
out of the terms of this Agreement, apply to any court, state or federal, for injunctive relief
against any violation by the Owners or apply for such relief as may be appropriate.
b. The City does not waive any claim of default by the Owners if the City does not
enforce or cancel this Agreement. All other remedies at law or in equity which are not otherwise
provided for in this Agreement or in the City's regulations governing historic properties are
available to the City to pursue in the event that there is a breach of this Agreement. No waiver by

the City of any breach or default under this Agreement shall be deemed to be a waiver of any
other subsequent breach thereof or default hereunder.
7. Binding effect of Agreement.
a. The Owner hereby subject the Historic Property, located at 321 East Eighth
Street, Assessor Parcel Number, 398 - 017 -12, and more particularly described in Exhibit A, in
the City of Santa Ana, to the covenants reservations, and restrictions as set forth in this
Agreement.
b. The City and Owners hereby declare their specific intent that the covenants,
reservations and restrictions as set forth herein shall be deemed covenants running with the land
and shall pass to and be binding upon the Owner's successors and assigns in title or interest to
the Historic Property. Every contract, deed, or other instrument hereinafter executed, covering
or conveying the Historic Property or any portion thereof, shall conclusively be held to have
been executed, delivered, and accepted subject to the tenants, restrictions, and reservations
expressed in this Agreement regardless of whether such covenants, restrictions and reservations
are set forth in such contract, deed, or other instrument.
8. No Compensation.
Owners shall not receive any payment from the City in consideration of the obligation
imposed under this Agreement, it being recognized that the consideration for the execution of
this Agreement is the substantial public benefit to be derived therefrom and the advantage that
will accrue to the Owners as a result of the effect upon the assessed value of the property on the
account of the restrictions on the use and preservation of the property.
9. Notice.
Any notice required by the terms of this Agreement shall be sent to the address of the
respective parties as specified below or at other addresses that may be later specified by the
parties hereto.

10. General Provisions.
a. None of the terms, provisions, or conditions of this Agreement shall be deemed
to create a partnership between the parties hereto and any of their heirs, successors, or assigns,
nor shall such terms, provisions or conditions cause them to be considered joint ventures or
members of any joint enterprise.
b. The Owners agree to and shall indemnify and hold the City and its elected and
appointed officials, officers, agents, and employees harmless from liability for damage or claims
for damage for personal injuries, including death, and claims for property damage which may
arise from the direct or indirect use or operations of the Owners or those of his or her contractor,
subcontractor, agenda, employee, or other person acting on his or her behalf which relates to the
use, operation, and maintenance of the Historic Property. The Owners hereby agree to and shall
defend the City and its elected and appointed officials, officers, agents, and employees with
respect to any and all actions for damages caused by, or alleged to have been caused by, reason
of the Owner's activities in connection with the Historic Property.
C. This hold harmless provision applies to all damages and claims for damages
suffered, or alleged to have been suffered, and costs of defense incurred, by reason of the
operations referred to in this Agreement regardless of whether or not the City prepared, supplied,
or approved the plans, specifications or other documents for the Historic Property.
d. All of the Agreements, rights, covenants, reservations, and restrictions
contained in this Agreement shall be binding upon and shall inure to the benefit of the parties
herein, their heirs, successors, legal representatives, assigns, and all persons acquiring any part or
portion of the Historic Property, whether by operation of law on in any manner whatsoever.
e. In the event legal proceedings are brought by any party or parties to enforce or
restrain a violation of any of the covenants, reservations, or restrictions contained herein, or to
determine the rights and duties of any party hereunder, the prevailing party in such proceeding
may recover all reasonable attorney's fees to be fixed by the court, in addition to court costs and
other relief ordered by the court.
E In the event that any of the provisions of this Agreement are held to be
unenforceable or invalid by any court of competent jurisdiction, or by subsequent preemptive
legislation, the validity and enforceability of the remaining provisions, or portions thereof, shall
not be effected thereby.
g. This Agreement shall be construed and governed in accordance with the laws of
the State of California.

11. Recordation.
No later than twenty (20) days after the parties execute and enter into this Agreement, the
City shall cause this Agreement to be recorded in the office of the County Recorder of the
County of Orange.
12. Notice of the Contract to Office of Historic Preservation.
No later than six (6) months of entering into the contract, the owner or agent of an owner
shall provide written notice of this Agreement to the Office of Historic Preservation.
13. Amendments.
This Agreement may be amended, in whole or in part, only by a written recorded
instrument executed by the parties hereto.
14. Effective Date
This Agreement shall be effective on the day and year first written above.

Exterior work shall be reviewed by the Historic Resources Commission and subject to the U.S.
Secretary of the Interior's Standards for Rehabilitation of Historic Buildings, as follows:
1. Every reasonable effort shall be made to provide a compatible use for a property
which requires minimal alteration of the building, structure, or site and its
environment, or to use a property for its originally intended purpose.
2. The distinguishing original qualities or character of a building, structure or site
and its environment shall not be destroyed. The removal or alteration of any
historic material or distinctive architectural features should be avoided when
possible.
3. All buildings, structures, and sites shall be recognized as products of their own
time. Alterations that have no historical basis and which seek to create an earlier
appearance shall be discouraged.
4. Changes which may have taken place in the course of time are evidence of the
history and development of a building, structure, or site and its environment.
These changes may have acquired significance in their own right, and this
significance shall be recognized and respected.
5. Distinctive stylistic features or examples of skilled craftsmanship which
characterize a building, structure, or site shall be treated with sensitivity.
6. Deteriorated architectural features shall be repaired rather than replaced,
whenever possible. In the event replacement is necessary, the new material
should match the material being replaced in composition, design, color, texture,
and other visual qualities. Repair or replacement of missing architectural features
should be based on accurate duplications of features, substantiated by historic,
physical, or pictorial evidence rather than on conjectural designs or the
availability of different architectural elements from the other buildings or
structures.
7. The surface cleaning of structures shall be undertaken with the gentlest means
possible. Sandblasting and other cleaning methods that will damage the historic
building materials shall not be undertaken.
8. Every reasonable effort shall be made to protect and reserve archaeological
resources affected by, or adjacent to any project.
9. Contemporary design for alternations and additions to existing properties shall not
be discouraged when such alterations and additions do not destroy significant
historical, architectural or cultural material, an such design is compatible with

size, scale, color, material and character of the property, neighborhood, or
environment.
10. Wherever possible, new additions or alterations to structures shall be done in such

Request of Applicant
This request is for two structures to be designated to the Santa Ana Register of Historical
Properties (Exhibit 1). The applicants are the homeowners: Tam Tran at 2346 N. North Park
Boulevard; and Nicola Fleming at 2109 North Heliotrope Drive.
Proiect Location and Site Description
Tam Tran's property at 2346 N. North Park Boulevard is located on the south side of the street,
between Benton Way and Santa Clara Avenue, and is a 9,100 square foot residential lot. It is
developed with a 2,460 square foot home and a detached two car garage. Nicola Fleming's property
is located on the east side of Heliotrope Drive and is an 11,700 square foot residential lot. It is
developed with a 2,953 square foot residence and has a detached two car garage with a permitted
studio. There is also a pool on the lot.
Proiect Background
This project entails applying the selection criteria established in Chapter 30 of the Santa Ana
Municipal Code, Places of Historical and Architectural Significance to determine if these two
structures are eligible for historic designation to the Santa Ana Register of Historical Properties.

In March 1999, the City Council approved an ordinance establishing the Historic Resources
Commission and the Santa Ana Register of Historical Properties. The Historic Resources
Commission may, by resolution and at a noticed public hearing, designate as historical property
any building or part thereof, object, structure, or site having importance to the history or
architecture of the city in accordance with the criteria set forth in section 30 -2.
Analvsis of the Issues
The structures identified meet the minimum selection criteria for inclusion on the Santa Ana
Register of Historical Properties pursuant to criteria contained in Section 30 -2 of the Santa Ana
Municipal Code. The first criterion for selection requires that structures be 50 or more years old.
As detailed in the following property descriptions, the structures proposed for placement on the
Register meet the minimum age criterion. The analysis further indicates the criteria each property
meets for consideration of historic designation. No known code violations exist at either of these
properties.
2346 N. North Park Boulevard — C. Swanner House (HRCA/HRC No. 2011 -01). The
C. Swanner House has distinctive architectural features of the Colonial Revival style, and was built
in 1937 by prolific builder, Roy Russell. The first owner was Mr. and Mrs. Loyal King who was part
owner of the Santa Ana Register, a precursor to the Orange County Register. The subsequent
owners were Mr. and Mrs. Charles Swanner. Mr. Swanner was a noted attorney, historian, and
author. Character defining features include exterior wood siding material, fenestration patterns,
wood shutters, and broken pediment detail on -the front entry and side gables. It is recommended
to be categorized as Key because it has "distinctive architectural style and quality" and is
associated with persons significant to the city and region (Exhibit 2).
2109 North Heliotrope Drive — Stauffer House (HRCA/HRC No. 2011 -02). The Stauffer House
is an architecturally significant building built in 1940 in the Colonial Revival style. Mr. William
Stauffer was a regionally significant person for having established the first financial investment
company in Santa Ana and Orange County. Character defining features of the Stauffer House
include massing, fenestration patterns and original wood windows, front porch area, and wood
shutters. It is recommended to be categorized as Key because it possesses "distinctive
architectural style and quality" and is associated with Mr. William Stauffer (Exhibit 3).
Public Notification
Both subject properties are located within the Floral Park neighborhood. The president of this
Neighborhood Association was notified by mail 10 days prior to this public hearing. In addition,
Floral Park Neighborhood president was contacted by telephone to ensure that they were notified
of the project and to see if there were any areas of concern. No areas of concern were identified
by the Neighborhood Association president, nor was there a request that the applicant present the
project to a meeting of their members.

The project sites were posted with a notice advertising this public hearing, a notice was published
in the Orange County Reporter and mailed notices were sent to all property owners within 500 feet
of the project sites. At the time of this printing, no correspondence, either written or electronic, had
been received from any members of the public.
CEQA Compliance
In accordance with the California Environmental Quality Act, the recommended actions are exempt
from further review under Section 15331, Class 31, as these actions are designed to preserve
historic resources. Categorical Exemption will be filed for this project.
Conclusion
Based on the analysis provided within this report, staff recommends that the Historic Resources
Commission adopt a resolution approving Historic Resources Commission Application No. 2011 -01
and Historic Register Categorization No. 2011 -01; and adopt a resolution approving Historic
Resources Commission Application No. 2011 -02 and Historic Register Categorization No. 2011-
02.

ARCHITECTURAL STYLE: Colonial Revival
The most universal of all American domestic building styles, the Colonial Revival has been popular since the 1876
Centennial celebration in Philadelphia stimulated a patriotic interest in the American architectural past. Whether drawing
upon Georgian, Federal, or Dutch Colonial prototypes, Colonial Revival buildings feature rectangular building plans and
designs which are usually symmetrical, or at least highly regular and balanced, in composition. Roofs are commonly
side- gabled, hipped, or gambreled, sometimes accented with dormers. Porches, one or two stories in height, are often
included, mostly as central focal points, and frequently incorporate classical elements such as columns, pilasters, and
entablatures. Doorways are adorned with classical surrounds and pediments; sidelights, transoms, and fanlights are not
uncommon. Windows are typically double -hung sash, with multiple lights in the upper sash. French doors and Palladian
windows are also utilized. Depending on location, Colonial Revival buildings have wood, brick, or stucco exteriors
(McAlester, 320 -326).
SUMMARY/ CONCLUSION:
The C, Swanner House qualifies for listing in the Santa Ana Register of Historical Properties under Criterion 1 for its
exemplification of the distinguishing characteristics of the Colonial Revival style. Additionally, the house has been
categorized as "Key" because of its "distinctive architectural style and quality" and, as an intact example of the
combination of the Colonial Revival style in the Floral Park neighborhood, its association with Charles D. Swanner,
attorney, author, and local historian. (Municipal Code, Section 30 -2.2).

This Colonial Revival styled residence is rectangular in plan, as a side gable, and is two storied. The structure is clad in
horizontal wood siding, and is topped by asphalt shingles. A red brick chimney sits atop the roof. The roof has very shallow
eaves and the side gables have broken pediments. Fenestration patterns are very symmetrical. The first floor front facade
has two bow windows on either side of the front entry. Each bow window has five 10 -light segments composed of wood and
a copper roof. Shutters adorn each side of the windows. Windows on the upper floor span the second floor elevation in its
entirety and include five single hung wood windows, aft with wood shutters straddling each window. The central front entry
includes a wood door with a narrow porch and landing protruding into the front yard. The porch is supported by half Doric
wood porch supports and includes a front facing gable with broken pediment. The landscape on the property is lush and
mature. A small detached garage sits to the rear of the property.

The C. Swanner House is architecturally significant as a Colonial Revival style of architecture in the Floral Park neighborhood.
It was constructed in 1937 by Roy Russell as a speculative venture. The first occupants and owners were Loyal and Mary
King, who were ranchers in the area. Loyal King eventually gave up ranching and became part owner of the Santa Ana
Register with J. Frank Burke, a precursor to the Orange County Register. The publication began in 9905 as a way to offer
local news to Santa Ana residents and those nearby. The publication was sold to R. C. Holies in 9935 at a time when the
newspaper was being sold at 3 cents a copy. After Mr. King sold the newspaper, he became part owner in Pacific Coast
Broadcasting which operated out of Pasadena, and he and his wife moved out of the home to be closer to his employment.
The house was then sold to Charles Douglas Swanner and his wife Helen. Charles Swanner was a local who attended Santa
Ana High School, and went on to become a well -known attorney and President of the Orange County Bar Association. His
offices were located in the National Bank Building on the southwest corner of Fourth and Main Street. Mr. Swanner was a
lieutenant in Company "L" in Santa Ana in 1916. Mr. Swanner was also the owner of a 30 acre ranch in the San Juan
Capistrano area that was sold to the City in 1990 for $6.9 million. He was also an amateur historian and authored several
books regarding life in Santa Ana, and the history of Orange County.

Santa Ana was founded by William Spurgeon in 1869 as a speculative town site on part of the Spanish land grant known as
Rancho Santiago de Santa Ana. The civic and commercial core of the community was centered around the intersection of
Main and Fourth Streets. Stimulated by the arrival of the Santa Fe Railroad and incorporation as a city in 1886, and selection
as the seat of the newly created County of Orange in 1889, the city grew outwards, with residential neighborhoods
developing to the north, south, and east of the city center. Agricultural uses predominated in the outlying areas, with
cultivated fields and orchards dotted with widely scattered farmhouses.
The C. Swanner House is located in Floral Park, a neighborhood northwest of downtown Santa Ana bounded by West
Seventeenth Street, North Flower Street, Riverside Drive, and Broadway. Groves of oranges, avocados and walnuts, and
widely scattered ranch houses characterized this area before 1920. Developer and builderAlfison Honer (1897 - 1989),
credited as the subdivider and builder of a major portion of northwest Santa Ana, arrived in Santa Ana from Beaver Falls,
New York in 1922 (Talbert, pages 353 -356). Before nightfall on the day of his arrival, Mr. Honer purchased a parcel of land.
And that month, he began building custom homes in Santa Ana" (Orange Count Rg ister September 15, 1981). The parcel
chosen became the Floral Park subdivision between Seventeenth Street and Santiago Creek. "When built in the 1920s, the
Floral Park homes were the most lavish and expensive in the area. They sold for about $45,000 each" (Orange County
Register, September 15, 1981). Revival architecture in a wide variety of romantic styles was celebrated in the 1920s and
1930s; Floral Park showcased examples of the English Tudor, French Norman, Spanish Colonial, and Colonial Revival
styles. The Allison Honer Construction Company went on to complete such notable projects as the 1935 Art Deco - styled Old
Santa Ana City Hall, the El Toro Marine Base during World War it, and the 1960 Honer Shopping Plaza. Honer lived in the
neighborhood he had helped create, at 615 West Santa Clara Avenue.
In the late 1920s and 1930s, another builder, Roy Roscoe Russell (1881- 1965), continued developing the groves of Floral
Park. An early Russell project was his 1926 subdivision of Victoria Drive between West Nineteenth Street and West Santa
Clara Avenue. The homes were quite grand and displayed various revival styles, including Russell's own large, Colonial
Revival mansion at 2009 Victoria Drive. In the early post -World War lI years, Floral Park continued its development as
numerous smaller, single- family houses were built. Continuing in the Floral Park tradition, they were mostly revival in style.
In the 1950s, low, horizontal Ranch Style houses completed the growth of Floral Park. Today (2007), Floral Park maintains
its identity as the premier neighborhood of Santa Ana, historically home to many affluent and prominent citizens.
The C. Swanner House qualifies for listing in the Santa Ana Register of Historical Properties under Criterion 1 for its
exemplification of the distinguishing characteristics of the Colonial Revival style. Additionally, the house has been
categorized as "Key" because it of its distinctive architectural style and quality of architecture, as well as its association with
both Loyal King, former co -owner of the Santa Ana Register, and with Chades D. Swanner, notable attorney and historian.
Character - defining exterior features of the C. Swanner House that should be preserved include, but may not be limited to,
exterior materials, massing, original windows where extant, and front porch configuration.

ARCHITECTURAL STYLE: Colonial Revival
The most universal of all American domestic building styles, the Colonial Revival has been popular since the 1876
Centennial celebration in Philadelphia stimulated a patriotic interest in the American architectural past. Whether drawing
upon Georgian, Federal, or Dutch Colonial prototypes, Colonial Revival buildings feature rectangular building plans and
designs which are usually symmetrical, or at least highly regular and balanced, in composition. Roofs are commonly
side - gabled, hipped, or gambreled, sometimes accented with dormers. Porches, one or two stories in height, are often
included, mostly as central focal points, and frequently incorporate classical elements such as columns, pilasters, and
entablatures. Doorways are adorned with classical surrounds and pediments; sidelights, transoms, and fanlights are not
uncommon. Windows are typically double -hung sash, with multiple lights in the upper sash. French doors and Palladian
windows are also utilized. Depending on location, Colonial Revival buildings have wood, brick, or stucco exteriors
(McAlester, 320 -326).
SUMMARY/ CONCLUSION:
The Stauffer House qualifies for listing in the Santa Ana Register of Historical Properties under Criterion I for its
exemplification of the distinguishing characteristics of the Colonial Revival style. Additionally, the house has been
categorized as "Key" because of its "distinctive architectural style and quality" and, as an intact example of the
combination of the Colonial Revival style in the Floral Park neighborhood, its association with William J. Stauffer.

Rectangular in plan, this side gabled two -story Colonial Revival styled residence is clad in smooth stucco finish on the first
floor, sides and back of the structure, and the upper front elevation is clad with 8" horizontal tongue and groove wood siding.
The roof is capped with asphalt shingles, and the eaves are very shallow and rafters are covered by a wood fascia board.
Fenestration patterns are very symmetrical as is typical of the Colonial Revival style. The first floor windows include two
large wooden bow windows on either side of the central front entry topped with a copper shed roof. Although the center
window of each bow is fixed, the side windows of each bow window are shingle hung with lamb's tongue features. The
windows on the front fa Cade of the second floor are all composed of wood, and are single hung. The windows on the
outermost portion of the facade are six-over-six, lamb's tongue decoration, and wood shutters. Just above the front entry,
and central to the fagade, are two smaller single hung wood windows installed side by side. Each of these windows is six -
over -six with a prominent wood sill, and wood shutters surrounding the pair. The central front entry is flush with the fagade,
with a narrow porch and landing protruding into the front yard. This porch is supported by simple wood porch supports and
includes a front facing gable with broken pediment. A slender, carved wood finial rests inside the pediment. There was a
small den addition to the rear of the house which is not visible from the right -of -way. The landscape on the property is lush
and mature. A small detached garage sits to fhe rear of the property.

The Stauffer House is architecturally significant as a Colonial Revival style of architecture in the Floral Park neighborhood. It
was constructed in 1940 by Allison Honer as a speculative venture, and the first occupant was William J. Stauffer and his wife
Violet. Mr. and Mrs. Stauffer were married September 25, 1925, and were lifelong Orange County residents. He opened the
first Orange County investment house in 1924 in Santa Ana where he worked as a finance manager for Dean Witter and
Company. This helped to establish Santa Ana as a hub for finance and business at the time. His son Bob joined the Dean
Witter office (now Morgan Stanley) in 1955 and worked in Santa Ana for 33 years. Bob's nephew, David, is still there,
representing the third generation of Stauffers to work in the firm.

Colonial Revival style, and was built in 1937 by prolific builder, Roy
Russell. The first owner was Mr. and Mrs. Loyal King who was part owner

The subsequent owners were Mr. and Mrs. Charles Swanner. Mr.
Swanner was a noted attorney, historian, and author.
C. This home qualifies for listing on the Santa Ana Register of Historical
Properties and is eligible for categorization as Key because it has

significant to the city and region.

Section 2: In accordance with the California Environmental Quality Act, the
recommended action is exempt from further review under Section 15331, Class 31, as
this action is designed to preserve historic resources. Categorical Exemption will be
filed for this project.
Section 3: The Historic Resources Commission of the City of Santa Ana after
conducting the public hearing hereby approves:
A. Historic Resources Commission Application No. 2011 -01 to place the C.
Swanner House, located at 2346 North North Park Boulevard, Santa Ana,
on the historical register, and
B. Historic Register Categorization No. 2011 -01 placing the C. Swanner
House, located at 2346 North North Park Boulevard, Santa Ana, within the
Key category.
These decisions are based upon the evidence submitted at the above said
hearing, which includes, but is not limited to: the Staff report and exhibits attached
thereto; the report entitled "Historical Property Description;" and the public testimony, all
of which are incorporated herein by this reference.
Section 4: For the subject property, a report entitled "Historical Property
Description," is on file in the Planning and Building Department, and is hereby approved
and adopted, and together with the staff report and this resolution, justify the findings for
placement on the City of Santa Ana Register of Historical Properties into a category. The
Historic Resources Commission Secretary is authorized and directed to include this
resolution in the City of Santa Ana Register of Historical Properties.
Section 5. The Historic Resources Commission Secretary is hereby directed to
file a certified copy of this Resolution with the County Recorder's Office after the adoption
of this Resolution pursuant to Public Resources Code Section 5029.

William Stauffer.
D. Character defining features of the Stauffer House include massing,
fenestration patterns and original wood windows, front porch area, and
wood shutters.
E. The legal owner of the subject property is Nicola Jane Fleming.
F. The legal description for the subject property is attached hereto as Exhibit
A and incorporated by this reference as though fully set forth herein.
