The 95 bed Santa Ana Detention Facility has been in operation since December of 1993. The average weekday population of the facility is 65 detainees. This agreement would allow the Detention Facility to provide up to ten bed spaces per day to the United States Immigration Services. These spaces would be provided on an availability basis and at a per diem rate of $80.00. This agreement would continue to operate, and will be significantly expanded, at the new Detention Facility, with a rate adjustment based on actual operating cost for that facility. FISCAL IMPACT Funds generated by the space 1996/1997 budget in the Police 11 -01- 5830), and no additional Paul M. Purpose: The purpose of this Intergovernmental Service Agreement is to establish a formal binding relationship between the U.S. Department of Justice, Immigration & Naturalization Service (INS) and the Santa Ana City Jail for the detention of persons found to be in violation of the Immigration & Nationality Act and related criminal statutes. The City shall retain the option to accept USINS detainees on a space available basis. II. The covered services: Include the housing, safekeeping, and subsistence of USINS detainees in accordance with the contents of this agreement. The unit of service will be the Detained Day, and the cost per unit is established by the City at $80.00 per Detained Day. III. Support, and Medical Services: The Contractor agrees to accept and provide for the security, custody, care, and safekeeping of INS detainees in accordance with. state and local laws, standards, policies, procedures and court orders applicable to the operation of a detention facility. The Contractor agrees to provide INS detainees with the same level of services and medical care provided local inmates. The Contractor will provide all necessary security and transportation services when directed by the INS to move detainees to medical or other facilities. The Contractor further agrees to notify the INS as soon as possible of emergency medical cases requiring removal of a detainee from the facility. Prior authorization shall be obtained from the authorization officers, as listed in Section VII, or from the undersigned Contracting Officer when removal is required for any medical services. All costs associated with hospital or health care services provided outside the Contractor's facility shall be invoiced separately, according to the provisions listed under Section VII. IV. Receiving and Discharging Detainees: In receiving or discharging USINS detainees from the facility, the Contractor agrees to receive and discharge such detainees only to and from persons presenting proper USINS credentials, except for medical or emergency situations. USINS detainees sought for state or local court proceedings may be made available only with the concurrence of USINS, which shall not be unreasonably withheld. Juveniles may be placed in Foster Care, consistent with the normal placement procedures and rate of the Department of Probation, with the written permission of the USINS. Juveniles may also be released to family members, relatives and responsible adult authorities with the written consent of the USINS. Written consent shall only be authorized by individuals listed in section VII and may not include an increase in cost per Detained Day. V. Period of Performance: This Agreement shall remain in effect indefinitely until terminated by either party upon 60 days written notice. Should conditions of an unusual nature occur making it impractical or undesirable to continue to house detainees, the Contractor may suspend or restrict the use of the facility upon 60 days written notice to the INS. VI. Economic Price Adjustment: Rates shall be established on the basis of actual costs associated with the operation of the facility during a recent annual accounting period or upon an approved annual operating budget. The rate may be renegotiated not more than once a year, after the Agreement has been in effect for twelve months. The Contractor may initiate a request for a rate increase or decrease by notifying the INS Contracting Officer in writing at least 60 days prior to the desired effective date of the adjustment. The Contractor agrees to provide additional cost documentation for the proposed rate increase. 4. Criteria used to evaluate the increase or decrease in the per capita rate shall be those specified in the Federal cost standards for contracts and grants with State and local Governments issued by the Office of Management and Budget. The effective date of the rate modification will be negotiated and specified on the modification form approved and signed by the Contracting Officer. The effective date will be established on the first day of the month for accounting purposes. Payments at the modified rate will be paid upon the return of the signed modification by the authorized local official to the INS. 6. Unless other justifiable reasons can be documented by the Contractor, per diem increases shall not exceed the National Inflation rate for the preceding year as established by the U.S. Department of Commerce. VII. Financial Provisions: The following individuals are authorized to place orders for the detention services under the terms of this IGSA. Name and Title Phone or such persons the Contracting Officer may indicate in writing to the Contractor as authorized to place orders for detention services. The individual placing the order for services shall obtain a funding document (G -514) prior to placing any calls and shall maintain a log and such documents with the file containing this IGSA. Los Angeles Street, Room 7631A Los Angeles, CA 90012 The INS shall reimburse the Contractor at the fixed rate identified on Page 1 of this Agreement. The Contractor may bill for the day of arrival but not for the day of departure. The Prompt Payment Act, Public Law 97 -177 (96 Stat. 85, 31 USC 1801) is applicable to payments under this Agreement and requires the payment to the Contractor of interest on overdue payments. Determinations of interest due will be made in accordance with the provisions of the Prompt Payment Act and the Office of Management and Budget Circular A -125. 4. Payment under this Agreement will be due on the thirtieth (30) calendar day after receipt of a proper invoice, in the office designated to receive the invoice (see Paragraph 1). The date of the check issued in payment shall be considered to be the date payment is made. The original invoice shall be submitted monthly in arrears to the INS office that has been designated to receive invoices as stated in Paragraph 1. To constitute a proper invoice the invoice must include the name, address, and phone number of the official designated payment office. In addition, it shall list each detainee, the specific dates of confinement for each, the total days to be reimbursed, the agreed upon rate per day, and the total amount billed (total days multiplied by the rate per day). VIII. Modifications and Disputes: Either party may initiate a request for modification to the Agreement in writing. All modifications will be written, approved by the Contracting Officer and submitted to the Contractor for approval. 2. Disputes, questions, or concerns pertaining to this Agreement will be resolved between the rNS and the appropriate Contractor official. Unresolved issues, or issues causing change to the price, shall be directed to the Contracting Officer at the Issuing Address, as listed on page one (1) of this IGSA. The Contracts Dispute Act of 1978 (41 U.S.C. 601 -613) (the Act), as amended by the Administration Dispute Resolution Act (Pub. L. 101 -552) shall be in effect for the duration of this IGSA. IX. Inspection and Technical Assistance: The Contractor agrees to allow periodic inspections of the facility by INS. Immigration & Customs Enforcement / Enforcement & Removal Operations (ICE/ERO) will develop 8 hours specialized training for the SACJ facility staff to cover the following training topics (the topics listed below are not exhaustive): • Familiarization of LGBT persons (gender identity, difference from the physical sex in which the person was born, etc,); • Interpersonal relations and communications skills for use with this vulnerable population (e.g, tone of voice, use of gender specific words, homophobic and derogatory comments); • Sexual abuse /assault vulnerability and intervention; and • Sensitivity in search methods; and • Use of LOST Detainee's Preferred Pronouns: SACJ facility staff assigned to supervise LGBT detainees will refer to detainees using the detainee's preferred gender pronouns (i.e. Ms. /Miss/Ma'am) or they may be referred to by their last name as stated in the Santa Aria Jail Policy. This training may pull from existing trainings already developed for this specific population and may include the "use of PowerPoint slides and /or video(s). It will be easy to understand and designed to allow the SACJ facility to easily implement. Initially, -training should be provided to SACJ staff that interact with the LGBT detainee population and should be conducted annually thereafter. Timeline: A preliminary completion date for the training will be 30 days from receipt of the "Syllabus from ICE. 3. General Training Requirement: • Training developed by ICE/ER0 will be reviewed by Santa Ana Jail Administration to ensure content is not contrary to current Jail Policy or applicable laws or statutes. • The 8 hours specialized training is required for the first year, The Service Provider shall review annually and provide the required refresher topics and coordinate with Contracting Officer Representative (COR). • ICE, /ERO will provide the training syllabus. The Service Provider shall complete the training within 30 days once provided the training syllabus. • The training site shall be. provided by the Service Provider at no cost to the Government. 4.
