SETTLEMENT AGREEMENT
G AND MUTUAL RELEASE OF CLAIMS
This Settlement Agreement and Mutual Release of Claims (hereinafter referred to as the
1- "AGREEMENT ") is entered into by and between ARNIE PIKE (hereinafter referred to as
"PIKE "), and the CITY OF SANTA ANA (hereinafter referred to as "CITY "). PIKE and the
k�, CITY may individually be referred to as a PARTY or collectively as the "PARTIES ".
This AGREEMENT acts exclusively to settle PIKE'S claims for removal of the
architectural barriers to disabled access he alleges exist at the Bowers Museum, located at 2002
N. Main Street, Santa Ana, California 92706 (the "PREMISES "). The PARTIES agree that the
terms of this AGREEMENT will satisfy all of PME'S claims regarding the removal of the
architectural barriers to disabled access at the PREMISES, In order to avoid the costs, expense,
and uncertainty of protracted litigation, the PARTIES hereby enter into this Agreement as set
forth below.
RECITALS
This AGREEMENT is based on the following facts:
A. On or around March 4, 2013, PIKE addressed a letter to the CHARLES W.
BOWERS MUSEUM CORPORATION (hereinafter referred to as "BOWERS ") and the CITY
in which he notified BOWERS and the CITY of certain alleged barriers to disabled access at the
PREMISES, including, but not limited to, inaccessible parking for persons with disabilities and
inaccessible paths of travel to and throughout the PREMISES.
B. Without any admission of liability or any admission that the PREMISES do not
meet accessibility standards and codes, the CITY has agreed to undertake remedial work at the
PREMISES to improve and ensure accessibility for persons with mobility disabilities.

C. In order to avoid the cost, expense, and uncertainty of litigation, the PARTIES
have reached an agreement on PIKE'S claims regarding the removal of alleged access barriers at
the PREMISES. Attachment "A" identifies the work to be performed by the CITY as agreed to
between the PARTIES. Said Attachment is hereby incorporated by reference as if fully set forth
herein as the full and complete agreement between the PARTIES for settlement of all of PIKE'S
claims regarding the removal of accessibility barriers at the PREMISES. The PARTIES
acknowledge that there may be a deviation as it pertains to the path of travel from the South
Parking lot towards the Museum inasmuch as the Bowers Museum is listed in the Santa Ana
Register of Historical Property and is categorized as a "Landrnark." However, any change in
such path of travel must be certified and supported in any updated CASp report commissioned
by the City.
D. The PARTIES agree that the work as outlined in Attachment "A" will be
completed no later than December 31, 2015.
E. The CITY will be responsible for the path of travel over the public right of way;
BOWERS to oversee path of travel on museum grounds leading to doors.
F. Within thirty (30) days of cornpleting all items and conditions described in
Attachments A the CITY shall advise counsel for PIKE. in writing that all items have been
completed. PIKE shall then have the right to complete an inspection of the subject property by
PIKE'S representative within forty -five (45) days of being provided the Notice of Completion.
In the event that PIKE believes that the CITY has not complied with the terms of this
AGREEMENT, Counsel for PIKE will inform Counsel for the CITY of the alleged breach and
allow for thirty (30) days for a good faith negotiation of a resolution. PIKE may immediately
file a lawsuit to compel enforcement in the event that the PARTIES are unable to resolve their

dispute within thirty (30) days of notice. In any action to enforce the terms of this
AGREEMENT, or for breach or for declaratory relief or appropriate legal or equitable relief, the
prevailing party shall be entitled to his or its reasonable attorneys' fees and costs.
G. The PARTIES acknowledge and agree that the terms of this AGREEMENT are
fair, reasonable, adequate, in their mutual best interest, and the product of joint negotiation
through counsel.
H. The PARTIES agree that this AGREEMENT satisfies all of PIKE'S claims
regarding the removal of architectural barriers at the PREMISES. The PARTIES acknowledge
that they are waiving significant legal rights and /or claims by entering into this AGREEMENT.
Each PARTY has consulted with legal counsel, has a full and complete understanding of the
terms and legal effect of the AGREEMENT, and intends to be bound thereby.
TERMS OF AGREEMENT
1. Payment: The Parties agree to settle this matter for the sum of $48,000.00. This
Settlement amount constitutes the total settlement to resolve all claims for removal of the
architectural barriers to disabled access alleged to exist at the Bowers Museum, and includes
claims for attorneys' fees and costs. The CITY as soon as practical after fill execution of this
Agreement, but in no event later than twenty (20) days thereafter, shall pay $48,000.00 via wire
transfer or check to the Metz & Harrison client trust account.
2. Releases: Except for the obligations expressly set forth in this AGREEMENT, the
CITY agrees to release and forever discharge PIKE and PIKE agrees to release and forever
discharge the CITY and their parent companies, officers, directors, shareholders, partners,

members, agents, insurers, employees, attorneys, successors and assigns, parents, affiliates,
subsidiaries, related entities and all of their officers, directors, shareholders, partners, members,
agents, insurers, employees, attorneys, successors and assigns and each of them, from any and all
claims, demands, grievances, liabilities, debts, accounts, obligations, costs, expenses, liens,
actions or causes of action, of every kind and nature whatsoever, existing as of the date of this
AGREEMENT, whether known or unknown, anticipated or not, suspected or not, arising directly
and /or indirectly from or directly and /or indirectly connected to the AGREEMENT.
Notwithstanding the foregoing, PIKE does not hereby waive any claims for damages, attorneys'
fees, litigation expenses and costs, which have not been resolved by way of this AGREEMENT.
5. Waiver of Civil Code section 1542: The PARTIES acknowledges that he, she or it,
as applicable, is familiar with and has been advised by his, her or its, as applicable, attorney with
respect to the provisions of California Civil Code Section 1542, which provides:
A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS
WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT
TO EXIST IN HIS OR HER FAVOR AT THE TIME OF
EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM
OR IIER MUST HAVE MATERIALLY AFFECTED HIS OR
HER SETTLEMENT WITH THE DEBTOR.
The PARTIES acknowledge that he, she or it, as applicable, may have sustained damages,
losses, fees, costs or expenses that are presently unknown and unsuspected, and that such damages,
losses, fees, costs or expenses might give rise to claims in the firture. Nevertheless, the PARTIES
acknowledge that this AGREEMENT has been negotiated and agreed upon in light of such possible
damages, losses, fees, costs or expenses and acknowledges and waives such claims. .
6. Release Effective Upon Subsequent Discovery of Existing Facts: PIKE
acknowledges and agrees that even if he later discovers facts in addition to, or different from,

those which either he now knows or believes to be true with respect to the subject matter of this
AGREEMENT, that it is his intention to fully settle and release and forever discharge all of the
claims that are released and discharged by this AGREEMENT. The releases herein shall be, and
shall remain in effect, as full and completed releases, notwithstanding the discovery or existence
of additional or different facts. PIKE accepts and assumes the risk that such facts may be in
addition to or different from the facts now known or believed to be true and agrees that the
releases herein shall remain in all respects effective and shall not be subject to termination or
rescission by reason of any such additional or difference in fact.
7. Severability: If any term of this AGREEMENT is determined by any court to be
unenforceable, the other terms of this AGREEMENT shall nonetheless remain in full force and
effect.
8. Non - Assignment: Each PARTY hereby represents and warrants that they or it, as
applicable, has not heretofore assigned or transferred, or purported to assign or transfer, to any
person or entity any of the claims, demands, grievances, liabilities, debts, accounts, obligations,
costs, expenses, liens, actions or causes of action released by this AGREEMENT.
9. Authoritv: Each PARTY hereby represents and warrants that the party executing
this AGREEMENT is a duly authorized signatory.
10. Independent Advice: Each PARTY acknowledges and agrees that he, she or it, as
applicable, has been represented throughout the negotiation and docrunentation of this
AGREEMENT by counsel of the PARTY'S choice and has been advised by such counsel with
respect to this AGREEMENT and the effect of the releases given in this AGREEMENT. Each
PARTY further acknowledges and agrees that he, she or it, as applicable, has read this
AGREEMENT, knows its contents and effect and, in executing this AGREEMENT, has relied

solely on their or its, as applicable, own judgment, belief and knowledge and the advice and
recommendations of such PARTY'S counsel. Neither PARTY has been induced to enter into
this AGREEMENT by any representation or statement of any other party not expressly contained
in this AGREEMENT.
11. Successors and Assigns: This AGREEMENT shall be binding upon the
successors and assigns of the PARTIES to this AGREEMENT.
12. Integration: Conditions Precedent: This AGREEMENT shall be of no force or
effect, and will be neither binding nor enforceable, unless and until the AGREEMENT has been
fully executed by the PARTIES. No other agreements, covenants, representations or warranties,
express or implied, oral or written, have been made by any PARTY to any other PARTY with
respect to the subject matter of this AGREEMENT. All prior and contemporaneous
conversations, negotiations, possible and alleged agreements, representations, covenants and
warranties with respect to the subject matter hereof are of no force or effect.
13. No Admission of Liability: Each PARTY acknowledges and agrees that this
AGREEMENT accomplishes the compromise of disputed claims and is not intended to
constitute an admission of liability, wrongdoing or error on the part of PARTY. Any liability,
wrongdoing or error is expressly denied by each PARTY to this AGREEMENT.
14. Additional Documents: In addition to the documents as provided for in this
AGREEMENT, each of the PARTIES agrees to promptly execute and deliver such additional
documents and take such other action as may be reasonably required to carry out the terms of
this AGREEMENT.
15. Titles and Captions: Titles and captions contained in this AGREEMENT are
inserted as a matter of convenience and for reference, and are not intended and shall not be

construed to define, limit, extend or otherwise describe the scope of this AGREEMENT or any
provision of this AGREEMENT.
16. Modification and Amendment: No modification or amendment of any of the
terns or provisions of this AGREEMENT shall be binding upon any PARTY unless made in
writing and signed by such PARTY or by a duly authorized representative or agent of such

17. Governing Law: This AGREEMENT shall be governed by and construed in
accordance with the laws of the State of California applicable to contracts entered into and
wholly performed within said state.
18. No Construction: No PARTY or PARTY'S counsel shall be deemed to be the
drafter of this AGREEMENT for purposes of interpreting or construing any of the provisions of
this AGREEMENT. This AGREEMENT shall be interpreted in accordance with the fair
meaning of its language and not strictly for or against any of the PARTIES to this
AGREEMENT.
19. Execution in Counterparts: This AGREEMENT may be executed on separate
counterparts and will become effective upon signature by all PARTIES upon one or more of
such counterparts.

Please find included herewith, the Limited Access Compliance Survey Report for the above referenced
property. This report addresses the findings of a facility review that was conducted on July 29, 2014,
of the Bowers Museum and site. The review was based on the 2010 ADA Standards for Accessible
Design and the 2013 California Building Standards Code and conducted in accordance with the
disabled access review provisions of the State of California Senate Bill 1608. This review was prepared
in a response to a request disabled access received by the Consultant from the City of Santa Ana.

A review of the site and public access interior areas of the building was performed on July 29, 2014.
The review has been prepared as a request received by the Consultant from the City of Santa Ana for
the property commonly known as:
BOWERS MUSEUM
2002 N. Main Street
Santa Ana, California
At the time of the review, the property was found to generally be in generally good compliance
standing summarily however, those elements reviewed and found to be in non - compliant condition
concerned the areas of improvement as follows:

➢ Accessible Routes of Travel
➢ General Site Elements
➢ Plumbing Elements and Facilities
➢ Communication Elements
➢ Special Rooms, Spaces, and Elements
➢ Built -In Elements
A copy of the mandated CASp Notification has been provided and is attached to this report as an
exhibit. Since non - compliant conditions were identified during the review, the site and improvements
cannot be designated as "CASp Inspected." Until any and all discovered non - compliant conditions
are corrected, determinations are provided by the appropriate Authority Having Jurisdiction (AHJ - i.e.
the Department of Justice, Building Official, or other) regarding any equivalent facilitation, hardship or
similar, and a CASp re- inspection is performed to verify completion and compliance of said
corrections, the project status is established and will remain as "CASp Determination Pending."

A field evaluation was conducted on July 29, 2014 of the site conditions and the public areas of the
building. Weather conditions were sunny and the temperature at the time of the start of the inspection
was approximately 720 degrees Fahrenheit.
Physical measurements were taken at selected and strategic locations to observe compliance
conditions. Continuous measurements of all possible variances in all actual field conditions were not
performed and thus, it is possible that variances in the irregularity of a surface or material could occur
and reflect a non - compliant condition where an otherwise compliant condition was noted. An
example of such condition might include the width of a walkway or change in the slope of a floor
surface that might result in slight a convex (hump) or concave (bird -bath) condition where
measurements taken in all directions, locations and in a continuous manner could reflect that
dimensional requirements were non - compliant.
In addition to the above, although professional care was taken with obtaining all measurements, it is
noted that no inordinate measures were utilized to verify true line, distance, bearing, level or plumb
conditions. Measurements that are not stated in the codes as between a "minimum" and "maximum"
or that are within a specified range of dimensions are considered absolute. Such absolute dimensions
are subject to conventional industry tolerances as allowed by both the ADAAG and Title 24
requirements but do not fall under the purview of this CASp review for determination. Rather, such
determinations for acceptable tolerances are to be made by the Building Official, the Division of the
State Architect, the Department of Justice or other Authority Having Jurisdiction. An example of such
might include the issue that there is no change in level permitted within a required clear or
maneuvering space. Strict adherence could never be achieved since there are changes in level
between any materials or within a single material whether a tape measure or high -power microscope
is used.
Professional -grade equipment and instruments were used to obtain reasonably accurate field
measurements. Use of digital levels, calipers, shape- measuring gages, stop - watches, door - pressure
gages, templates and other instruments necessary to the measurement of a specific item were used
where appropriate. It is noted that no readings of sound, lighting, or color shade, contrast or index
levels were taken as part of this evaluation. Such readings require the service of an appropriately
licensed engineer or contractor to assist with such determinations where required. Examples of such
include measurements for alarm systems, elevators, lighting levels for egress systems, contrast between
surface colors, and etcetera. Metal -blade measuring tapes and digital levels were used to record the
dimensions. Since the dimensions reviewed were not of significant length and the ambient
temperature was not of significance range, no adjustments to any dimensions were made for any
expansion or calibration of any measuring device(s) at the time of the inspection. Digital equipment
was calibrated in accordance with manufacturer recommended procedures at the time of the
inspection.

It is noted that as part of this compliance- review that certain items regulated under the codes may or
may not have been constructed, installed, or otherwise provided at the site or the facility. Although
regulations govern the accessibility of a project by the disabled, the lack of provision of a specific code
regulated item should not necessarily cause the reader to arrive at the conclusion that the project is
not in compliance. The lack of provision may only mean that the specific regulations do not apply in
this instance or, that the AHJ may have made a determination that the specific item is not required at
this time or, that a determination of equivalent facilitation may have been previously made by the
AHJ.
This report does not attempt to identify all provisions of Federal or State codes, regulations,
determinations or policies related to a development project. Rather, the purpose of this report is to
only identify if physical barriers to access have been removed or that the required items are in
compliance with current Federal and /or State disabled access requirements. This report further does
not intend to provide any interpretations, establish policy or make any determinations. If any such
interpretation, policy or determination is found to be expressed or implied, such interpretation, policy
or determination is not valid and must not be relied upon as "fact" as it must be first confirmed by the
responsible AHJ or the DOJ prior thereto.
"The responsibility for demonstrating equivalent facilitation in the event of a challenge rests with the
covered entity. With the exception of transit facilities, which are covered by regulations issued by the
Department of Transportation, there is no process for certifying that an alternative design provides
equivalentfacilitation. "
Therefore, when an apparent item involving equivalent facilitation is found under this review, that item
will be strictly excluded from any implicit or explicit CASp certification.
When dimensions are specified by either the Federal or State regulations, they are often stated as a
"minimum" or "maximum" or they must fall within a "range" of acceptable dimensions. When no such
qualifier is given, the dimensions are to be considered as "absolute." During this review, no attempt
has been made to define if the dimension for a particular item falls within any industry- standard or
other construction tolerance limit and no such predetermined specific limits are prescribed by law. It
is the opinion of this consultant that absolute dimensions will always require some limit of tolerance
whether they are measured in fractions of an inch, a micron, or of an atom as there is never a perfectly
even surface. Acceptance of a construction tolerance is a function strictly reserved by law for the
interpretation by the Building Official, the Division of the State Architect, the Department of Justice or
other Authority Having Jurisdiction and is not a determination that a CASp is entitled to render. For that
reason, any items specified with an absolute dimension by any applicable code and /or regulation will
be considered in this review as "non- compliant" and no certification of compliancy of said work will
be able to be rendered by this reviewer. For guidance purposes however, in a September 30, 2004,
letter from the DOJ to the State of California that included a side -by -side comparison of the two codes,
the definition used by the State was considered compatible with the ADA Title III requirements and are
provided as follows:

104.2 Dimensions. Dimensions that are not stated as "maximum" or "minimum" are absolute. All
dimensions are subject to conventional industry tolerances.
CCR, TITLE 24, PART 2:
11 B- 104.1.1 Construction and Manufacturing Tolerances. All dimensions are subject to conventional
building industry tolerances except where the requirement is stated as a range with specific minimum
and maximum end points.
In light of the immediately above definition provided in the California Building Code (CCR, Title 24, Part
2), the Division of the State Architect has issued an Interpretation of Regulations Document (DSA /AC)
IR 1 1 B -8 "Use of Predetermined Construction Tolerance Guidelines for Accessibility" (revised 1/1 /2011),
where a strong caveat is presented against use of pre- determined construction tolerances. In the IR,
the State Attorney General has stated:
"We are concerned that the local building offeials and the members of the general public, when they consult
Construction Tolerance Guidelines,...may assume that they have been adopted by a state agency and therefore,
have the force ofstate law, which they do not. Such reliance, in our view, may result in violations of the California
Building Code and, possibly, litigation against the local building officials and /or property owners. "
Added to IR 1 1 B -8 is the following quotation from a United States District Court:
""at is an acceptable `dimensional tolerance' will vary, depending in part to the purpose for the standard and
the technological capacity to closely adhere to the target dimensions."
Similar to dimensioning, the Building Official, the Division of the State Architect, the Department of
Justice (DO-1), or other Authority Having Jurisdiction are charged with the respective issues such as;
considerations and determinations relating to equivalent facilitation, readily achievable,
disproportionate cost, unreasonable hardship, structural impracticability, technically infeasible, and
the like.
The observations and findings contained herein are limited in scope. Approvals, permits, and
inspections may likely be required by the Authority Having Jurisdiction (AHJ) for any correction required
to achieve compliance. This report does not intend to address the code compliant status of non -
accessibility items either implicitly or explicitly. Always check with the AHJ for local codes and
regulations that also may apply. Appropriate legal counsel should be retained concerning any
responsibilities, exposure to liability or other risks that the property owner could encounter.

SCOPING
PROJECT SCOPE
This limited investigational review is prepared under the guideline provisions for disabled access
compliance as identified by the State of California Senate Bill 1608 for the project as follows:
BOWERS MUSEUM
2002 North Main Street Santa Ana, California
The report has been prepared for the stated City Attorney's Office of the City of Santa Ana.
This report is intended to be investigational and informational in nature and concerns access by the
disabled community to an existing public museum. The scope of the project has been limited, to
address the exterior and interior (public spaces only) state and federal disabled access requirements.
The property is located within the incorporated boundaries of the Santa Ana, California. The overall
site comprises several land parcels that are improved with buildings, surface -level paved parking
spaces, walkways, landscaping and other appurtenant improvements. A "remote" parking lot
(located across and to the south side of 20th Street) that is used by patrons of the facility was also
reviewed.
The site is large and relatively rectangular in shape. The museum itself, is bounded on the east by Main
Street, on the south by 20th Street, along the west with a mix of residential and commercial properties,
and to the north with commercial properties. Main Street is a 4 -lane arterial street that is provided with
full public improvements (i.e. curb, gutter and sidewalk). A site view is provided below:

The site slopes very gently and at an angle of approximately less than five (5 %) percent overall. It is
developed with multiple buildings that are interconnected and used as part of the museum. The site
also is improved with surface -level parking area located to the north of the facility and with a detached
surface -level parking area located to the south of 201h Street.

Access to the site is provided for pedestrians, passenger vehicles and both small van and delivery -type
vehicles. Pedestrian access is provided along the Main Street and 20th Street frontages and from the
on -site parking area.
A regionally- connecting public transit system (bus stop) is located on Main Street and is immediately
adjacent to the remote surface -level parking area south of 20th Street.

The site is used as a public museum facility where the general public is commonly invited. Areas under
this review (the exterior site and interior public areas) are considered to be places of public
accommodation.

The property is under public ownership and the facility is considered a place of public
accommodation. Public funds have been used for the physical development or operational programs
of this facility. Therefore, the project qualifies for review under the Title II and Title III of the Federal ADA
requirements and under Title 24 of the California Building Standards Codes with respect to requirements
for access by the disabled and for associated barrier removal.

All newly constructed places of public accommodation and commercial facilities must be accessible
to individuals with disabilities to the extent that it is not structurally impracticable. For additions and
alterations, the new construction requirements apply to any facility occupied after January 26, 1993,
for which the last application for a building permit or permit extension is certified as complete after
January 26, 1992. According to the DOJ, full compliance will be considered "structurally impracticable"
only in those rare circumstances when the unique characteristics of terrain prevent the incorporation
of accessibility features (e.g., marshland that requires construction on stilts).
If an entity constructs or alters the required elements of the path of travel in accordance with the 1991
ADA Standards or the UFAS before March 15, 2012, then the entity is not required to retrofit any such
elements included in the 2010 ADA Standards solely because of an alteration to a primary function
area served by a path of travel. In accordance with the California Building Standards Code
requirements, a project must comply with the code underwhich that portion of the work was permitted
and inspected and of which also received a final certificate of occupancy or other approval. Certain
'grandfather' considerations are already being addressed with regards to compliance with the 2010
CBC, the emergency adoptions by the CBSC in August 2013, and the issuance of the new 2013 CBC
requirements (effective January 1, 2014).

Given the above facility characteristics, and in accordance with the 1991 and the 2010 ADA
Standards, readily achievable barriers limiting or preventing use by the disabled are required to be
removed to the maximum extent possible that they are readily achievable and not structurally
impracticable or technically infeasible. It is noted that although the existing property conditions and /or
proposed improvements may be accepted by a local Authority Having Jurisdiction, any determination
of 'structurally impracticable,' 'technically infeasible,' 'equivalent facilitation,' 'unreasonable
hardship' relating to disproportionate cost, or similar that is present or proposed may not provide the
level of protection as full compliance with ADA Standards and CBC. The Building Official for the AHJ
has authority for making certain determinations as they relate to the California Building Standards
Code while the DOJ, or other AHJ, may have the authority for making determinations and decisions as
they relate to the ADA Standards. That said, an advisory has been published by the DOJ in the 2010
ADA Standards for Accessible Design regarding equivalent facilitation indicating that:
"The responsibility for demonstrating equivalent facilitation in the event of a challenge rests with the
covered entity. With the exception of transit facilities, which are covered by regulations issued by the
Department of Transportation, there is no Process for certifying that an alternative design provides
equivalent facilitation. "
Therefore, when an apparent item involving equivalent facilitation is found under this review, that item
is strictly excluded from any implicit or explicit CASp certification.

Surfaces along a ROT that are required to be accessible must be firm, stable and slip- resistant.
Requirements apply to materials used for flooring, walks, curb ramps, pedestrian crossings, ramps, stairs,
and similar surfaces. Special provisions concerning cushions, pads, backing, pile -type, installation
methods and trims also apply when carpets or carpet tiles are used. Openings along the ROT may
also create hazard in the surface and often apply within exterior conditions where site drainage is also
a factor.
Factors to consider for compliance with surface conditions include the items as follows:

when beveled at a 1:2 slope (with up to 1/4" in vertical change allowable). Vertical changes greater
than 1/2" must comply with ramp feature requirements. Certain hazards may also be present due to
changes in surface levels (i.e. drop -offs) where adjacent to the ROT.

TURNING SPACE
An accessible ROT is required to maintain specific clear and level spaces used for turning and
maneuvering. The space required is commonly considered as a circular space that is 60" in diameter
or a T- shaped space that fits within a 60" square. The leg and top of the T -shape are each 36" wide
(see figure below).
Turning spaces are allowed to overlap required knee and toe spaces and, with limitations, doors are
allowed to encroach into the required area. Turning and maneuvering spaces are subject to surface
condition requirements and they must be level (1:48 or 1:50 maximum slope in any direction and
depending upon the date of applicable regulation). The surface may not contain any abrupt changes
in level, have items projecting into the space (again with limitations) or have unmitigated hazards
present.
Requirements for turning and maneuvering spaces generally include, but are not limited to, the
following conditions and /or locations:
• Doorways
• Landings
• ROT with passing space
• ROT with door encroachment
• Constricted ROT
• Projections in ROT

Similar to turning and maneuvering spaces is the concept of clear space. Clear space is a floor area
that is 30" x 48" or, under given conditions is 36" x 48" or 30" x 60 ", in size. It is the space that allows
forward or parallel ( "side ") approach to a given accessible element of the facility (e.g. a lavatory or
water closet, drinking fountain, TTY telephone, sales counter, interpretive display or the like). Additional
clear space requirements apply at each side of the door (i.e. the "pull" or "push" sides). They must be
connected to an accessible ROT and they often allow encroachment under counters, sinks or other
spaces for knee and toe space. Clear spaces are, again, subject to surface condition requirements
and they must be level (1:48 maximum slope in any direction. They may not contain any abrupt
changes in level, have items projecting into the space (again with limitations) or have unmitigated
hazards present.

of the report (e.g. under doorway or sanitation requirements) however, generally applicable figures
are as shown on the page that follows:

Knee and toe space applies generally to forward approach conditions and is to be provided when a
turning or maneuvering space or a clear floor space passes under an accessible facility element.
Examples of such spaces include the area under a work or sales counter, under a lavatory or drinking
fountain, under an interpretive table display or similar type conditions.
Knee space is required to be 30" wide minimum and is defined as the area between 9" and 27" above
the finish floor (AFF). It is permitted to extend to a maximum of 25" in depth under an element. That is
not to say that an element cannot have greater than 25" in clear depth but rather, to say that only 25"
D maximum is allowed for the "required" portion thereof. Where the knee space is an extension of the
required clear space the dimensions reduce. In these conditions, the depth is limited to an 11"
projection at 9" AFF and 8" at a point 27" AFF. Between 9" and 27" AFF, the knee space clearance
reduces on a straight -line ratio of 1 "D:6 "H (see the graphic below). As noted above, open spaces
provided beyond the required spaces are not permitted to be included within the clear or knee space
allowances.
Toe space is defined as the area from 0" to 9" AFF. Similar to knee space, the toe space may extend
to a maximum of 25" in depth under an element. Where part of the required clear floor space, the
depth of the toe space is limited to a 6" projection beyond the required and available knee space.
Therefore, if conditions permit, the toe space is limited to 11" (for the knee space) plus an additional
6" for the toe space or, 17" maximum total.
Section 4.2.3 of the 1991 Standards and Section 304.3 of the 2010 Standards allow turning space to be
either a circular space or a T- shaped space. Section 304.3 permits turning space to include knee and
toe clearance complying with section 306. Section 4.2.3 of the 1991 Standards did not specifically
permit turning space to include knee and toe clearance.
The Department of Justice recognizes that the technical specifications for T- shaped and circular
turning spaces in the 1991 and 2010 Standards, which are based on manual wheelchair dimensions,
may not adequately meet the needs of individuals using larger electric scooters. However, there is no
consensus about the appropriate dimension on which to base revised requirements. The Access Board
continues to conduct research to study this issue in order to determine if new requirements are
warranted.
The Department plans to wait for the results of this study and action by the Access Board before
considering any changes to the Department's rules. The Department has issued a statement indicating
that covered entities may wish to consider providing more than the minimum amount of turning space
in confined spaces where a turn will be required. Appendix section A4.2.3 and Fig. A2 of the 1991
Standards provide guidance on additional space for making a smooth turn without bumping into
surrounding objects.

Objects that protrude into the accessible ROT must be in some manner protected from causing injury
to individuals moving along the path. Protrusions are not permitted beyond a projection that is greater
than 4" as measured at a height of between 27" and 80" (84" for residential occupancies) AFF. Two
exceptions do apply that include the projection of handrails of up to 41/2" for handrails and door closers
and door stops shall be 78" minimum AFF. The required clear width of a ROT shall not be reduced by
any protruding objects.
When objects are mounted on a post, the maximum permitted overhand is again 4" unless there is a
physical barrier provided that reduces the clear height of the bottom of the object to less than 27" or
above 80" AFF. Where objects, such as an 'open" underside of a stair or other object allows an
individual to enter an area where the overhead projection is less than 80" or greater than 27" AFF it is
required to be protected with a physical barrier such as a guardrail or other acceptable barrier.
