MEMORANDUM OF AGREEMENT
This Memorandum of Agreement ("MOA") sets forth the understanding and
agreement between the Cumberland County Prosecutor's Office ("CCPO"), Bridgeton,
New Jersey, and the Santa Ana Police Department ("SAPD"), Santa Ana, California,
regarding the provision of expert services by the SAPD on the Raymond Allen Homicide
Investigation ("Allen Homicide Investigation") (CCPO MCU -2011 -1172 -CI). The CCPD
and the SAPD agree as follows:
1. The CCPO has provided to the SAPD a written synopsis of the captioned
homicide.
2. The CCPD shall transmit, at its expense, if any, to Forensic Firearms
Examiner Rocky Edwards ("Examiner Edwards") of the SAPD fires and
barrel castings, along with 3-D images, from the revolver believed to
have been utilized in the captioned homicide and the projectile
obtained from the deceased victim. Examiner Edwards shall perform
comparison testing analysis on the items submitted.
3. If Examiner Edwards determines that it is necessary for him to inspect
the firearm and projectile then same shall be transmitted by the CCPO
to the SAPD at the expense of the CCPO.
4. Examiner Edwards shall perform his independent analysis regarding the
Allen Homicide Investigation outside his normal work schedule at the
SAPD's overtime rate of $67.99, the cost of which shall be paid by the
CCPD.
5. It is anticipated that the review by Examiner Edwards shall take
between six and nine months. The SAPD shall keep and provide to the
CCPD a detailed log of the amount of hours performed by Examiner
Edwards, along with his analysis. The CCPO and the SAPD agree that the
SAPD shall advise when Examiner Edwards has first consumed ten hours
of time. During such time period Examiner Edwards shalt provide a
preliminary opinion as to whether he believes a positive comparison
testing analysis can be accomplished. If applicable, when Examiner
Edwards has consumed a total of twenty hours of analysis the SAPD shall
so advise the CCPD. In no event shall Examiner Edwards and the SAPD
perform more than thirty hours of analysis at Examiner Edwards'
overtime rate without the specific written approval of the CCPO.
6. The designated persons of contact for this MOA shall be Sgt. Michael
Donato for the CCPD and Heather Heider, Forensic Services Supervisor,
for the SAPD.
7. In the event that it is necessary for Examiner Edwards to provide Court
testimony, same shalt be invoiced separately, subject to a Supplemental
MOA to be executed by the CCPO and the SAPD.
8. Invoices for Examiner Edwards' services on the Allen Homicide
Investigation at the overtime rate of $67.99 shalt be provided by the

SAPD to the CCPO. The CCPD shall provide payment according to its
normal and regular payment procedures.
By the signatures set forth below, the Cumberland County Prosecutor's Office
and the Santa Ana Police Department agree to be bound by the terms of this
Memorandum of Agreement.
