referred to as Board, and the CITY COUNCIL of the CITY OF SANTA ANAs hereinafter re.

A. The follmwing subparagraphs shall be added to said 'Contracts
S (n) section 21251,75 of the Government Code (providing for increases in
allowances payable for time commencing on the ,first day of the calendar

B, Paragraphs 9 (a) and 9 (b) shall be stricken from said Contract and the follow.
ing paragraphs substituted therefors
7 (a) With respect to miscellaneous members, the public agency shall contribute
the following percentages of monthly salaries earned as miscellaneous
members of said System,
(1) 2.074 percent until June 30, 1977 on account of the liability for
prior service benefits.
(2) 6.690 percent on account of the liability for current service
benefits,
7 (b) ,With respect to local safety members, the public agency shall contribute
the following percentages of monthly salaries earned as local safety
members of said Systema

THE CONTRACT BETWEEN THE CITY OF SANTA ANA
AND THE BOARD OF ADMINISTRATION OF THE CALIFORNIA
PUBLIC EMPLOYEES' RETIREMENT SYSTEM
THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS
FOLLOWS:
SECTION 1: That an amendment to the Contract between the
€ City Council of the City of Santa Ana and the Board of Administra-
r tion, California Public Employees` Retirement System is hereby
authorized, a copy of said amendment being attached hereto,
marked "Exhibit A", and by such reference made a part hereof as
though herein set out in full.
SECTION 2: That the City Manager of the City of Santa '
Ana is hereby authorized, empowered, and directed to execute
said amendment for and on behalf of said Agency.
SECTION 3: That this Ordinance shall take effect thirty
days from and after the date of its adoption.
SECTION 4: That the Clerk of the Council shall certify
to the passage of this Ordinance and cause the same to be
published in some daily newspaper printed and published in the
City of Santa Ana.

A. The following subparagraphs shall be added to said Contract:

SUBJECT: COST OF LIVING AMENDMENT FOR RETIRED EMPLOYEES
Attached hereto for your consideration is a proposed resolution
No. 70-47 which would amend the existing retirement system contract
to provide a cost of living increase only for those City employees
who have been retired since prior to January 1, 1967. The State
Legislature has provided four types of cost of living benefits for
retired employees.
The most recent legislation affects all employees who retire after
December 31, 1966 and will enable them to receive automatically
after their fourth year of retirement without action by contracting
agencies, up to a 112/ per year increase if warranted by consumer
price index (C.P.I.) trends. The City will not be required to act
on such increases henceforth nor will they result in any additional
cost to the City. Of course, however, this rate of lz% is not
nearly equal to the actual C.P.I. rates of approximately 6% and 7%
annually in recent years.
Previous City Councils have already approved two of the three
remaining permissive types of cost of living amendments. The
attached resolution would provide for this sole remaining increase
available at the present time from State legislation adopted in
1968 for retired employees. It would benefit approximately 120
of our already retired employees who have been adversely affected
by an increase of 19.7% in the C.P.S. from January 1967 to April
1970. The amount of benefit will vary on a sliding scale ranging
from 2% for those whose retirement became effective during 1966
to a maximum of 12% for those who retired prior to 1962. In dollar
amounts, the average individual would receive an additional $18.61
per month and the maximum increase would be $58.48.

The maximum potential cost to the City for funding this amendment
could be $26,934 the first year. This cost was calculated by the
State actuary several months ago. Since then several of the
retired employees have died and been removed from the rolls. In
actual practice, when the State has conducted its mandatory audits
every four years it has been determined that the additional costs
caused by adoption of the first amendment have been almost completely
offset after the fourth year due primarily to increased earning
power of the investments made with these retirement funds, and also
due to cost reductions from removals from the rolls. However, if
Council approves this amendment, some adjustments will have to be
made in the 1970-71 budget and they could probably best be accom-
plished in the mid -year review.
Most of the other major cities in the State that are members of the
State retirement system have already adopted this proposed amendment,
including Anaheim, San Bernardino, Long Beach, Riverside, Glendale,
Torrance, Berkeley, etc. In addition, the recent salary agreement
approved by the Orange County Board of Supervisors provides that
cost of living adjustments for retired County employees will be
granted annually up to a maximum of 3% per year. It seems only
fair and equitable that retired City employees be helped with this
increase to partially offset the cost of living increase.
RECOMMENDATION: That Council adopt Resolution 70-47.

This will acknowledge receipt of your governing body's Resolution of Inten-
tion to amend your contract with this system to include Section 21257..75
of the Retirement Law. TATe are sending to you the following documents in
order to accomplish the proposed amendment:
1. Amendment to contract, in duplicate. Please sign and return two
copies to this system.
2. Ordinance, Form 126, in duplicate, approving amendment to contract.
This ordinance must be adopted by affirmative vote of two-thirds
of the members of the governing body no earlier than twenty days
after the adoption of the Resolution of Intention. The number
of days and publications are to be inserted in Section 3 of the
form to comply with local requirements. One copy is to be completed
and returned to this system.
3. Certification of Final Action by the Governing Body, Form 130.
One copy is to be completed and returned to this system.
Effective date of the amendment cannot be earlier than the first day of a
payroll period following the effectivity of final action of your governing
body.
Please be sure to notify your accounting division regarding the rate change
because of the amendment.
