DISCUSSION The City Council on October 7, 1991 adopted a resolution which amended the City's contract with the Public Employees Retirement System to provide the Two -Years Additional Service Credit Option, Section 20818 to local miscellaneous members. On February 16, 1993 an ordinance which would amend the PERS contract providing two - years additional service credit option to local safety members as well was placed on first reading. For the City to offer the benefit to those impacted by budget conditions or changes in operational focus, a resolution designating a window period for employees to utilize the service credit needs to be adopted. Adoption of the resolution would provide two -years additional service credit to local miscellaneous members retiring April 3, 1993 through July 1, 1993 and to local safety members retiring April 16 through July 14, 1993. FISCAL IMPACT Cost for providing the Two -Years Additional Service Credit Option is an average of $26,665 per eligible employee. However, a savings of approximately $1,372,000 will be realized by the City in salary and benefit costs. 9 Arl, it Fran iscutive D rector Personnel S rvices KF:LR:ck RETWIN.RES CONCUR: o Colo R 25; Executiv Director Finance and Management Services RESOLUTION NO.93-021 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA TO DESIGNATE WINDOW PERIODS TO GRANT TWO -YEARS ADDITIONAL SERVICE CREDIT FOR DESIGNATED CLASSES AND POSITIONS IN THE CITY COVERED BY THE PUBLIC EMPLOYEES' RETIREMENT SYSTEM WHEREAS, on October 7, 1991 the City Council amended the contract with the Public Employees' Retirement System (PERS) to provide the Two -Years Additional Service Credit Option, Section 20818 to local miscellaneous members; and WHEREAS, on March 15, 1993 the City Council is scheduled to amend the contract with the Public Employees' Retirement System (PERS) to provide the Two -Years Additional Service Credit Option, Section 20818 to local safety members; and WHEREAS, it is now desired to provide designated_ window periods for Two -Years Additional Service Credit (Section 20818) based on the contract amendments included in said contract which provides for Two -Years Additional Service Credit (Section 20818) for eligible members; and WHEREAS, it is also necessary to specify the eligible group of members eligible for the Two -Years Additional Service Credit under these designated window periods. NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA: 1. That the City Council of the City of Santa Ana does hereby give notice of intention to seek to add an additional designated window period for granting Two -Years Additional Service Credit; and 2. That the additional designated window period be granted from April 3, 1993 through July 1, 1993 for local miscellaneous members; and 3. Sections 21380.21387 (1959 Survivor Benefits) exc.iuding Section 21382.2 (Increased 1959 Survivor Benefits) and Section 21382.4 (Third Level of 1959 Survivor Benefits), b. Sections 21263, 21263.1 and 21263.3 (Yost -Retirement Survivor Allowance). Code Section 20740, ceased to be an "employer" for purposes of Section 20759 effective on December 16, 1976. Accumulated contributions of Public Agency shall be fixed and determined as provided in Government Code Section 20759, and accumuluted contributions thereafter shall he held by the Board as provided in Government Code Section 20759. 9. Public Agency shall contribute to said Retirement System the contributions determined by actuarial valuations of prior and future service liability with respect to local miscellaneous members and local safety members of said Retirement System. 10, Public Agency shall also contribute w said Retirement System as follows: a. A reasonable amount, as fixed by the Board, payable in one Installment withir 60 days of dale of contract to cover the costs of administering said System as ii affects the employees of Public Agency, not including the costs of speclal valuations or of the periodic investigation and valuations required by law. h. A reasonable. amount, as fixed by the Board, payable in one installment as the occasions arise, to cover the costs of special valuations on account of employees of Public Agency, and costs of the periodic investigation and valuations required by law, 11. Contributions required of Public Agency and its employees shall be subject to adjustment by Board on account of amendments to the Public Employees' Retirement Law, and on account of the experience under the Retirement System as determined by the periodic investigation and valuation required by said Retirement Lass. 12. Contributions required of Public Agency and its employees shall be paid by Public Agency to the Retirement System within fifteen days after the end of the period to which said contributions refer or as may bo prescribed by Board regulation. If more or less than the correct amount of contributions is paid for any period, proper adjustment shall be made in connection with subsequent remittances. Adjustments on account of errors in contributions required of any employee may be made by direct payments between the employee and the Board, B. Currently the City does not have a mechanism to assist local safety employees whose job classifications have been impacted as a result of budget conditions or changes in operational focus. Adoption of the recommended benefit would grant the City Council the option of providing two years of additional service credit to impacted employees. To be eligible for the benefit, impacted employees must be at least 50 years old and have a minimum of five years of service with PERS. Also, in accordance with provisions of the Memorandum of Understanding between the City of Santa Ana and the Fireman's Benevolent Association (FBA) executed on September 17, 1990, the City agreed to amend its contract with PERS to provide the Military Service Credit as a Public Service option. This amendment will standardize the benefits for all safety personnel and restore a benefit option Fire employees previously possessed. 07'7 Proposed PERS Amendment February 16, 1993 Page 2 The contract amendment process specified in the PERS law requires adoption of a Resolution of Intention to amend the contract and adoption of an ordinance authorizing the amendment to the contract. FISCAL IMPACT There is no immediate fiscal impact associated with the Military Service Credit provision with this action. However, the total cost of providing the benefit will be dependent on the number of employees exercising this option. Cost per employee for the two year additional service credit is from 56% to 62% of salary.
