GARTNER, Chairman STAFF Present: HASSAN HAGHANI, Executive Director VINCE FREGOSO, Acting Planning Manager RYAN HODGE, Assistant City Attorney KAREN GERARDO, Commission Secretary PLEDGE OF ALLEGIANCE Chairman Gartner PUBLIC COMMENTS (No public comments received) COMMISSIONER COMMUNICATION DISCLOSURE (REGARDING AGENDIZED PROJECTS): • Vice - Chairman Mill disclosure that he spoke with John Palacios regarding item no. 1 and its potential impact on local schools. *Commissioner Alderete was proposed to join the meeting via teleconference as referenced on the agenda, but was unable to participate. PUBLIC HEARING 1. ZONING ORDINANCE AMENDMENT NO. 2015 -03 TO UPDATE THE HOUSING OPPORTUNITY ORDINANCE AND ADAPTIVE REUSE ORDINANCE Legal notice published in the Orange County Register and Orange County Reporter on July 7, 2015. A project overview was provided by Hassan Haghani, Executive Director of Planning and Building Agency, which included project background, the intent to simplify the fee calculation, project exemptions, and other changes to the existing ordinance. Mr. Haghani fielded questions from the Commission related to target areas, the PLANNING COMMISSION MINUTES 1 JULY 20, 2015 difference between on -site and off -site units, and provided further clarification on the calculation of in -lieu fees. Chairman Gartner opened the public hearing. • Steven LaMotte spoke in support of the amendment and thanked staff for recommending these changes. • Blake Hopkins spoke in support of the amendment. • Cesar Covarrubias expressed concerns that the amendment will benefit developers more than the city's low /very low- income residents. Commissioner Nalle motioned to recommend that the City Council adopt an ordinance approving Zoning Ordinance Amendment No. 2015 -03 and was seconded by Commissioner Bacerra. Further discussion ensued regarding rehabilitation /relocation costs, comparison with other cities' ordinances, concerns with exemption of adaptive reuse provisions. A substitute motion was presented by Commissioner Verino to continue the item to allow more time to analyze the amendment and to allow the absent commissioners to be present. SUBSTITUTE MOTION: Continue the item to the subsequent meeting. MOTION: Verino VOTE: AYES: SECOND: Mill Mill, Verino (2) NOES: Bacerra, Bauer, Nalle (3) ABSTAIN: None (0) ABSENT: Alderete, Gartner (2) Motion failed. Commissioners Bauer and Bacerra expressed they did not believe there was a need to continue the item. Commissioner Mill discussed the possibility of taking the original motion, but to separate the adaptive reuse clause from Section III into a secondary vote. Commissioner Nalle restated his original motion with the exception of recommending Section III. Commissioner Mill seconded that motion. Further discussion ensued and Commissioner Nalle withdrew his motion. The motion was settled on approving as presented. MOTION: Recommend that City Council adopt an ordinance approving Zoning Ordinance Amendment No. 2015 -03.
