Legal notice published in the Orange County Reporter on September 29, 2015 and
notices mailed September 30, 2015.
A project overview was provided by Ricardo Soto, Assistant Planner I. Chairman
Gartner opened the public hearing. There were no speakers and the hearing was
closed.
MOTION: Adopt a resolution approving Variance No. 2015 -07 as conditioned.

2. FINAL ENVIRONMENTAL IMPACT REPORT NO. 2015 -01. AMENDMENT
APPLICATION NO. 2014 -4, DEVELOPMENT AGREEMENT NO. 2015 -3,
GENERAL PLAN AMENDMENT NO. 2015 -3, AND VESTING TENTATIVE TRACT
MAP NO. 2015 -3 FOR THE HERITAGE MIXED -USE DEVELOPMENT PROJECT
(Applicant: Dyer 18 LLC)
Legal notice published in the Orange County Reporter on September 29, 2015 and
notices mailed September 30, 2015.
A project overview was provided by Vince Fregoso,
Acting Planning Manager. Mr. Fregoso answered questions from the commission
related to zone re- designation from industrial to mixed use, traffic studies, in -lieu
fees, and the development agreement. Chairman Gartner opened the public
hearing. Bob Bisno and Scott Reekstin both spoke in opposition of the project. A
letter of opposition was received from Kari Rigoni from John Wayne Airport. The
applicant answered questions and spoke in support of the project. There were no
other speakers and the hearing was closed.
RECOMMENDED ACTION: Planning Commission direction. As proposed, the
project would alter the existing General Plan and zoning policies for the site.
While this change in direction is quite substantial, it may be consistent with

the new direction the Planning Division is taking during the upcoming General
Plan and Zoning Code amendments.
MOTION: Recommend that City Council approve and certify Final
Environmental Impact Report No. 2015 -01, Amendment Application No. 2014 -4,
Development Agreement No. 2015 -3, with a recommendation that housing in-
lieu fees be directed towards AMCAL's housing project on First Street and
incorporating Exhibit A, General Plan Amendment No. 2015 -3, and Vesting
Tentative Tract Map No. 2015 -3 as conditioned.

Hassan Haghani
• Mentioned that commissioner training will be held at the following meeting of
October 26.
• Informed that the staff reports will be changing in writing style to reduce
redundancies.
• Thanked Vince Fregoso for his term as interim executive director and acting
planning manager and informed that he has proven to be of valuable service to
him.
