PUBLIC HEARINGS
1. CONDITIONAL USE PERMIT NO. 2015 -21
(Applicant: Dollar General)
Legal notice published in the Orange County Reporter on October 27, 2015 and
notices mailed October 28, 2015.
A project overview was provided by Verny Carvajal,
Principal Planner. Mr. Carvajal answered questions from the commission related to
the possibility of a secured storage cabinet, other liquor licenses in the vicinity, and
operating store hours. Chairman Gartner opened the public hearing. Written
communication was received from Tim Rush stating support for the project. There
were no speakers and the hearing was closed.
MOTION: Adopt a resolution approving Conditional Use Permit No. 2015 -21 as
conditioned and direct Planning staff to prepare a letter of Public Convenience
or Necessity.

A project overview was provided by Verny Carvajal,
Principal Planner. Mr. Carvajal answered questions from the commission related to
curb cuts, ingress /egress, and adding green screens to available walls. Chairman
Gartner opened the public hearing. Desi Reyes spoke in support of the project. The
applicant stated they support the addition of the green screens to the available walls.
There were no other speakers and the hearing was closed.
MOTION: Adopt a resolution approving Conditional Use Permit No. 2015 -18
and Variance No. 2015 -09, with the added condition of adding preen screens to
walls that would accommodate such addition.

WORK STUDY SESSION
CLIMATE ACTION PLAN AND ENVIRONMENTAL IMPACT REPORT UPDATE
Christy Kindig, Public Works Agency Project Manager, provided a PowerPoint
presentation explaining the reasons and steps needed to implement a Climate
Action Plan as required by Executive Order B- 30 -15, a statewide order to reduce
emissions by 15 percent below 2008 emissions by the year 2020 and by 30 percent
below 2008 emissions by the year 2035.

Candida Neal
• Stated that future agenda items have been placed on the agenda as requested.
• Mentioned the success of the first General Plan Community meeting held on
November 3, which is the first of many comprehensive meetings with various
stakeholders.

Commissioner Bacerra
• Attended the General Plan Community meeting and thought the meeting went
well.
• Voiced concern over the response received from Lyon Communities regarding
The Nineteen 01 project and their intentions to proceed with the proposed public
art [previously denied by the Planning Commission] and found the tone of the
letter improper.
Commissioner Alderete
• Echoed Commissioner Bacerra's concerns over Lyon Communities' decision to
proceed with the artwork presented in their public art plan.
• Attended Noche de Altares in the Downtown and found the popular event well
organized and programmed creatively.
Commissioner Bauer
• Stated he also took objection to the letter from Lyon Communities.
• Attended Noche de Altares and SOMOS events, which he found amazing.
Vice Chair Mill
• Echoed a similar sentiment regarding Lyon Communities' decision to proceed
with the artwork presented in their public art plan.
Commissioner Nalle
• Disagreed with commissioner comments related to Lyon Communities' letter and
opined that the developer has the right to choose what artwork he will pay to
display.
• Mentioned he did not attend Noche de Altares event, but finds it to be well
organized.

6:32 P.M. - The next meeting of the Planning Commission is scheduled
for Monday, November 23, 2015 at 5:30 p.m. in the Council Chamber,
22 Civic Center Plaza, Santa Ana, California.
