HomeMy WebLinkAbout2013-11-20 CODE OF CONDUCT & ETHICSMINUTES OF THE REGULAR MEETING OF THE CODE OF CONDUCT AND ETHICS COUNCIL COMMITTEE NOVEMBER 20, 2013 Meeting Convened at City Hall, 2nd Floor, 20 Civic Center Plaza Santa Ana, CA at 6:16 p.m. In attendance were Committee Members Sal Tinajero and Angelica Amezcua, Chair and Staff members Sonia Carvalho, City Attorney and Maria D. Huizar, Clerk of the Council. PUBLIC COMMENTS — None AGENDA ITEMS 1. SELECTION OF CHAIR Motion by Tinajero, seconded by Amezcua to elect Amezcua as Chair. Motion carried. 2. APPROVE MINUTES OF THE MARCH 21, 2012 AND JUNE 7, 2012 MEETINGS Motion by Tinajero, seconded by Amezcua to approve Minutes. Motion carried. 3-. DISCUSS COMMITTEE BY -LAWS City Attorney Carvalho provided background on rules and procedures. Chair Amezcua motion, seconded by Committee Member Tinajero to hold two meetings a year in May and November and call Special meetings, as needed. Motion carried. 4. ANNUAL REVIEW OF CODE OF CONDUCT Deferred discussion to future meeting. 5. DISCUSS CITY COUNCIL POLICY AS IT RELATES TO BROWN ACT VIOLATIONS AND SANCTIONS City Attorney Carvalho indicated that cities with Code of Conduct and Ethics have various methods of handling sanctions, such as consideration of resolution, policy referring to enforcement agency, policy can allow for discretion and report to council committee not to create adversarial situation. Will prepare sample policies for review and consideration; consider discretionary funds to protect municipal corporation and not official. Noted that actions would have to be considered by the full City Council. Committee member Tinajero Minutes of the Code of Conduct and Ethics Committee Page 1 November 20, 2013 indicated that Brown Act violations had been captured on video — protect against conflicts of interest. City Attorney Carvalho said that it is important to lay out process, but would have to be approved by the entire City Council — investigate situation and not just allegation of wrong doing, consider consistency with Charter and Municipal Code. Chair Amezcua asked that sample policies be considered. 6. COMMITTEE MEMBER COMMENTS Committee Member Tinajero, glad Committee held meeting; need direction and present policy recommendation to full City Council.
