PUBLIC HEARINGS
1. CONDITIONAL USE PERMIT NO. 2016-18
(Applicant: David Gregory, Certified Transportation - 628 East Washington Avenue)
Matter continued from the June 13, 2016 Planning Commission meeting at the
request of the applicant.
Legal notice published in the Orange County Reporter on June 3, 2016 and notices
mailed June 2. 2016.
Commissioner Alderete arrived at 5:41 p.m.
A project overview was provided by Candida Neal, Planning Manager. Noted
applicant met with Logan neighborhood representatives and agreed to a number
items in order to operate and be sensitive to neighboring residents on the Custer site
and summarized what was agreed upon. Chairman Gartner opened the public
hearing. Debbie McEwen expressed concern on the landscaping and bus
ingress/egress on Washington Avenue, Sam Romero noted he was pleased with
meeting with applicant and agreed to about 95% of issues, Pam Andrade expressed
concern on bus maintenance and the number of buses at the site, Cecelia
Rodriguez expressed concern of the project citing there should be no maintenance
on the site. Pamela Sapetto, representing applicant, thanked staff & Logan
neighborhood, discussed items that were agreed upon at their meeting, and
discussed proposed improvements. Commissioner Gartner closed the public
hearing. Discussion ensued on the hours of operation, the storage and maintenance
of buses and the proposals for the Washington Avenue and Custer Street sites and
the implementation of an Operations Plan. Ms. Neal noted applicant is willing to
discuss concerns with staff and requested the Commission take a recess on the
matter and continue with the agenda.
Chairman Gartner announced that the matter would be recessed so that the
applicant can meet with staff. Chairman Gartner proceeded with the remaining
public hearings.
2. CONDITIONAL USE PERMIT NO. 2016-19
(Applicant: Steven Hall, Brasa Rotisserie — 3940 South Bristol Street, Unit 111)

mailed June 29, 2016.
A project overview was provided by Jessica Aguilar, Planning Technician. Chairman
Gartner opened the public hearing. Linda Lou Kestin spoke in opposition to the sale
alcoholic beverages. Steven Hall, applicant, answered questions and spoke in
support of the project. There were no other speakers on the matter and the hearing
was closed.

A project overview was provided by Pamela Guerra, Planning Technician. Chairman
Gartner opened the public hearing. Linda Lou Kestin spoke in opposition to the sale
of alcoholic beverages. Paul Roberts, representing applicant, and Darryl Kwok,
applicant, answered questions and spoke in support of the project. There were no
other speakers and the hearing was closed.

Gartner opened the public hearing. There were no speakers and the hearing was
closed.

AGENDA ITEM CONSIDERED OUT OF ORDER
1. RECONVENED CONSIDERATION OF THE MATTER - CONDITIONAL USE
PERMIT NO. 2016-18
(Applicant: David Gregory, Certified Transportation - 628 East Washington Avenue)
Verny Carvajal, Principal Planner, noted staff was successful in speaking with
applicant and their representatives who agreed with a modified operational plan that
applies to the Custer Street site and presented added conditions of approval for the
Washington Street project.

Chairman Gartner reopened the Public Hearing. Cecelia Rodriguez expressed
concern on the light maintenance of buses and hours of operation on the Custer site,
Ana Andrade expressed concern on the amount of items on the light maintenance
list, and Joe Andrade expressed concern of noise. Chairman Gartner closed the
Public Hearing.
AMENDED MOTION:
1. Adopt a resolution approving Conditional Use Permit No. 2016-18 as
conditioned.
2. Prepare an Operational Plan for Certified Transportation properties at
Washington Street and Custer Street that will include the following: hours
of light maintenance shall be from 6:00 a.m. to 8:00 p.m., Monday through
Saturday. Light maintenance shall consist of bus servicing and minor
repair of buses, including replacement of belts, hoses, batteries, tires,
shock absorbers, oil and air filters, chassis lubrication, air conditioning
servicing, replacement of brake pads, seat repairs, wiper blade repairs,
window/glass repairs, electrical repairs and washing.
3. Per the M-1 Light Industrial Zoning District operational standards, in the
City of Santa Ana Municipal Code (SAMC), any activity permitted in this
district shall be conducted in such a manner as to not have a detrimental
effect on permitted adjacent uses by reason of refuse matter, noise, light,
vibration or lack of proper maintenance of grounds or buildings for both
properties.

5. ELECTION OF OFFICERS
Recommended Action:
1. Elect a Chairperson of the Planning Commission for the 2026/2017 term.
2. Elect a Vice Chairperson of the Planning Commission for the 2016/2017
term.
3. Elect a Representative from the Planning Commission to the Historic
Resources Commission for the 2016/2017 term.
Chairman Gartner called for nominations for Chairperson. Commissioner Bauer
nominated Commissioner Verino as Chairperson and the nomination was accepted.
Hearing no further nominations, the nominations were closed without objection.
MOTION: Elect Lynnette Verino as Chairperson for the Planning Commission
for the 2016/2017 term.

By a 5:0 vote (Verino absent), Commissioner Verino was elected Chairperson for
the 2016/ 2017 term.
Chairman Gartner called for nominations for Vice Chairperson. Chairman Gartner
nominated Commissioner Bauer as Vice Chairman and the nomination was
accepted. Hearing no further nominations, the nominations were closed without
objection.
MOTION: Elect Bruce Bauer as Vice Chairman for the Planning Commission
for the 2016/2017 term.

7. PLANNING MANAGER UPDATES
Candida Neal
• Announced the resignation of Sean Mill effective July 6 and suggested having
some sort of recognition at the next meeting.
8. PLANNING COMMISSION MEMBER COMMENTS
Commissioner Bacerra
• Thanked Commissioners on appointment as the representative to the Historic
Resources Commission.
• Noted he and Commissioner McLoughlin had a productive General Plan &
Zoning Subcommittee meeting and applauded staff noting appreciation for the
work and looks forward to when it comes to the full commission.
Chairman Gartner
• Noted he enjoyed serving as Chairman.
• Noted he will miss Commissioner Mill.
Commissioner Bauer
• Thanked Chairman Gartner for his service as Chairman.

scheduled for Monday, July 25, 2016 at 5:30 p.m. in the Council
