MINUTES MOTION: Approve the minutes of the regular meeting of July 25, 2016. * * * END OF CONSENT CALENDAR * * * BUSINESS CALENDAR COMMISSIONER COMMUNICATION DISCLOSURE (REGARDING AGENDIZED PROJECTS): - None PLANNING COMMISSION MINUTES 1 SEPTEMBER 12, 2016 PUBLIC HEARINGS 1. CONDITIONAL USE PERMIT NO. 2016-29, CONDITIONAL USE PERMIT NO. 2016-30 AND CONDITIONAL USE PERMIT NO. 2016-33 (Applicant. Andy Quach, The Majesty Restaurant - 5015 W. Edinger Ave., Unit V) Legal notice published in the Orange County Register on September 2, 2016 and notices mailed September 1, 2016. A project overview was provided by Vince Fregoso, Principal Planner, for Conditional Use Permit No. 2016-29 to allow the on -premise sale of alcoholic beverages, Conditional Use Permit 2016-30 for allow the restaurant to operate until 2:00 a.m.; and Conditional Use Permit No. 2016-33 to allow an ancillary banquet use. Chairperson Verino opened the public hearing. Written communication received in opposition of the project from Dick Blumer, Lorraine Roy, Thu Vu, and a petition signed by 20 residents. Phone call from Julie Melcher in opposition. Tung Le spoke in opposition of the project citing current illegal concerns, noise, difficulty parking, current problem would be worse with after-hours, concern that restaurant will become a nightclub, and presented a petition and copies of flyers of concerts held at the site. Tracy Thuy Trang spoke in opposition of after-hours operation noting they are currently operating those hours with alcohol served. Andy Quach, applicant, spoke in support of the project, provided background information and improvements made on the site adding they would like to come in compliance. There were no additional speakers and the hearing was closed. Commission discussion on police callouts, events at the location, previous conditional use permit, entertainment permits, alcohol ordinance, requested staff to make sure there are conditions reflective of the sensitive uses around the site to the north and east. MOTION: Continue the matter to October 10, 2016 in order to obtain analysis/statistics report from the Police Department with dates and times and review previous conditional use permit for the property. A project overview was provided by Ivan Orozco, Assistant Planner I. Chairperson Verino opened the public hearing. Maria Diaz, applicant, spoke in support of the project. A project overview was provided by Nathalie Vazquez, Management Intern. Chairperson Verino opened the public hearing. There were no speakers and the hearing was closed. Commission discussion ensued on the condition of the center, the owner of the center, dispensary, parking lot and the business owners intentions for the use. MOTION: Continue to September 26, 2016 and bring applicant to meeting to pose questions. PLANNING MANAGER UPDATES Candida Neal Noted included in binders was the list of approved Planning Commission projects. PLANNING COMMISSION MINUTES 3 SEPTEMBER 12, 2016 r Circulation Element Update — Provided an update on the Circulation Element noting the city is coordinating some of the traffic counts and the new Santa Ana Mobility and Safety information and will come to Commission the middle of 2017. Introduced Mandl O'Connor who is assisting the Planning Division in day-to-day operations. 6. PLANNING COMMISSION MEMBER COMMENTS Commissioner Bacerra • Welcomed Commissioner Mendoza. Chairperson Verino • Welcomed Commissioner Mendoza & Nathalie Vazquez. • Reported Yo Sushi had signs on their windows in violation of their conditional use permit (CUP) after the approval of alcoholic beverages and was handled by Code Enforcement. Reported Northgate Market on 17th Street has products outside of the store which is in violation of their conditional use permit. Commission discussion ensued on the revocation process. Ms. Neal suggested placing item as a Work Study Session item for a future meeting and invite Code Enforcement to clarify what their current standard procures is with multiple violations and put together ideas of how to make the process of enforcing CUP conditions.
