COMMISSIONER COMMUNICATION DISCLOSURE (REGARDING AGENDIZED
PROJECTS):
Commissioner Bacerra disclosed communication with James Gartner on Agenda Item No.
1. Commissioner Gartner disclosed he will abstain and recuse himself from his project,
Agenda Item No. 1.

Commissioner Alderete arrived at 5:35 p.m.
1. CONDITIONAL USE PERMIT NO. 2016-36 AND VARIANCE NO. 2016-07
(Applicant: James Gartner, 4414 Westminster Ave LLC — 4412 Westminster Avenue)
Commissioner Gartner recused himself and departed meeting.
Matter continued from the October 10, 2016 Planning Commission meeting to
October 24, 2016; and from October 24, 2016 to November 28, 2016 meeting.
Legal notice published in the Orange County Reporter on September 30, 2016 and
notices mailed September 29, 2016.
A project update was provided by Vince Fregoso, Principal Planner. He addressed
the Planning Commission concerns and described modifications made to address
those concerns. In addition, he requested a condition be added to require the
applicant provide growing vines on the south side of the wall bordering the
residential property. Chairperson Verino opened the public hearing. Sherry Davis
and James Kinney, mobile home residents, spoke in support of the project. William
Prescott, property owner and applicant, spoke on modifications made to the project,
additional noise study, the addition of sound wall and the planting of Italian cypress
trees on the mobile home side. Mr. Prescott answered questions and spoke in
support of the project. There were no additional speakers on the matter and the
hearing was closed.
AMENDED MOTION:
1. Adopt a resolution approving Conditional Use Permit No. 2016-36 as
conditioned.
2. Adopt a resolution approving Variance No. 2016-07(a) as conditioned to
allow a reduction in required setbacks.
3. Adopt a resolution approving Variance No. 2016-07(b) as conditioned to
allow the building to exceed the allowable height.
4. Add condition to plant growing vines and Italian Cypress trees on the
mobile home park side of the block wall along the southern property line.

Ms. Neal introduced Escarlet Mar who began with the Planning Division as an Intern,
and will be graduating with her Bachelor's degree in Urban Regional Planning and
was recently promoted to a Planning Technician.
A project overview was provided by Escarlet Mar, Planning Technician. Chairperson
Verino opened the public hearing. There were no speakers on the matter and the
hearing was closed.
Vice Chairman Bauer & Commissioner Bacerra requested the type of alcoholic
license be specified in future the staff reports.

A project overview was provided by Escarlet Mar, Planning Technician. Chairperson
Verino opened the public hearing. Commission discussion ensued on condition and
possible improvements to the monopine. Gregory Mercier answered questions and
spoke in support of the project noting he would be agreeable to continuing item in
order to communicate with his client and bring back recommendations. There were
no other speakers on the matter and the hearing was closed.

Continue the item to the January 9, 2017 meeting.`

"Original Motion was to continue item to the December 12, 2016 meeting with Gartner in
opposition (6:1). Ms. Neal later requested item be continued to the January 9, 2017
meeting as the applicant was not available to attend on December 12, 2016.
Commissioners then modified motion with Commissioner Gartner changing his vote to aye.

• General Plan Update Status — Reported that staff completed an application for a
SCAG (Southern California Association of Governments) sustainability grant that
will support one detail identified for urban growth.
