RESOLUTION NO. 2016-097
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA ANA LEVYING AN ASSESSMENT FOR THE
DOWNTOWN SANTA ANA BUSINESS IMPROVEMENT
DISTRICT FOR CALENDAR YEAR 2017
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS
FOLLOWS:
Section 1. The City Council of the City of Santa Ana hereby finds, determines
and declares as follows:
A. On February 6, 1984, the City Council, by Ordinance No. NS -1715,
established the Downtown Santa Ana Business Improvement Area pursuant to
California Streets and Highways Code Sections 36500, et seq. (the "BID Law").
B. On November 15, 2016, the City Council received the 2017 Annual Report for
the Downtown Santa Ana Business Improvement District (the `Report').
C. On November 15, 2016, the City Council adopted Resolution 2016-085
approving the Report and setting a public hearing for December 20, 2016, at
which time protests could be made to the proposed levy of the 2017 annual
assessment for the Downtown Santa Ana Business Improvement District (the
"Annual Assessment').
D. On December 20, 2016, at the time and place called for in Resolution 2016-
085, the City Council conducted a duly noticed public hearing at which written
and oral protests to the proposed Annual Assessment were made and
considered as provided in Streets and Highways Code section 36524 and 36525.
E. Qualifying written protests constituting a majority of the owners of the
businesses paying the Annual Assessment were not received at or before the
conclusion of the public hearing.
Section 2. The 2017 Assessment Report is hereby confirmed, and the levy of
an assessment for the calendar year 2017 in accordance with Attachment B of the
Report, a copy of which is attached hereto and incorporated herein by reference, is
hereby approved.
