HomeMy WebLinkAboutGREAT WESTERN RECLAMATION, INC.1971 CONTRACT FOR REFUSE COLLECTION THIS AGREEMENT made and entered into this 6TH day of December , 1971, by and between the CITY OF SANTA ANA, a municipal corporation, and GREAT WESTERN RECLAMATION, INC. , a corporation; WITNESSETH Specific reference is hereby made to the contract entered into by and between the parties hereto on thel2th day of August, 1963 and all subsequent amendments to that contract. Said contract is hereby amended in the following particulars. 1. Section 2 (f) of the specifications is hereby amended to read as follows: "Preparation of Refuse All refuse shall be placed in containers adequate to eliminate overflow or contamination of surrounding areas . Individual containers must not weigh in excess of 15 pounds empty or have a capacity exceeding 35 gallons . Total combined weight of container and contents shall not exceed 50 pounds. Cardboard or wood cartons, acceptable as temporary containers, will be considered as trash and will not be returned to the user. Any cardboard or wooden cartons, not specifically used as a temporary container, must be broken down, flattened and tied in bundles with strong cord or wire heavy enough to act as a handle or shall be placed in acceptable containers. Cardboard, papers, magazines, palm fronds, tree limbs, brush, weeds and similar dry materials must also be tied in bundles with a heavy cord or wire strong enough to act as a handle or may be placed in acceptable containers. Any such bundle or item may not exceedfour feet in length, 18 inches in thickness or weigh in excess of 40 pounds. Oil drums, grease drums and similar metal containers; paper grocery bags; broken wooden boxes and crates; broken or wet cardboard boxes; any container with sharp, rough or jagged edges which may hamper or injure the handler are not acceptable as refuse containers and will not be picked up or emptied. Discarded household items, broken down to the specified size and weight easily handled by one man, may be considered as refuse. All kitchen waste, ashes, hair clippings, floor sweepings and similar materials must be well and securely wrapped to protect the public health and safety. Hot ashes will not be collected. There will be a load limit of 50 pounds per container with contents and 200 pounds (including container) for each refuse service stop. " 2. Section 2 (k) of the specifications is hereby amended to read as follows: - 1 - "Maintenance of Schedules Presently existing routes, schedules and times for collection of garbage and trash shall be maintained, but may be changed by authorization of the Director of Public Works and after at least one week' s advance notification by the Contractor to the occupants of buildings in the area where the changes are to be made. All collections from residential areas shall be made between the hours of 6:00 a.m. and 8:00 p.m. , and collections from commercial and industrial locations other than multi-family residential units or from locations immediately adjacent to residential units may start at 3: 00 a.m. " 3. Section 2 (m) of the specifications is hereby amended to read as follows: "Standards for Collections Equipment used by theContractor for collection and hauling of garbage and trash shall be such as to assure, in the opinion of the Director of Public Works, that adequate standards of collection will be maintained. It is the declared interest of the City that the Contractor be able to provide a wide variety of containers to meet the capacity requirements of commercial and multiple residential users . Equipment used shall be water tight. Complete metal operating covers must be a part of the design of equipment employed. No material shall be permitted to leak, fall or be spilled onto City streets, alleys or highways. Any such leakage or spills occurring shall be immediately corrected and the area cleaned. Equipment used must employ adequate safety conditions for operating personnel and must be maintained in good mechanical condition. All collections shall be made as quietly as possible and no unnecessarily noisy trucks or equipment shall be used. Employees of the Contractor who are unnecessarily noisy or who violate the provisions of the State Motor Vehicle Code and/or any applicable City Ordinance in the collection of said materials shall be dismissed upon the demand of the Director of Public Works. " 4. Section 2 (n) of the specifications is hereby amended to read as follows: "Containers Containers used in commercial and multiple dwelling areas shall be of a design and size to contain, at all times, the contents therein in such manner as to promote best possible housekeeping conditions. Maintenance of con- tainers supplied by the Contractor shall, at all times, be maintained by him in well-kept appearance. Users shall be responsible for the cleanliness, sanitation and deodorizing of rental containers . Residential containers, including the lids thereof, shall be replaced where found. Containers and lids shall not be left in the street or on neighboring or adjoining premises. Garbage containers shall not be thrown from the truck to the pavement or in any way damaged by rough handling. - 2 - n . ' The City reserves the right, upon submission of proof by the owner, to withhold sufficient compensation under the contract to adjust any claim for refuse containers damaged by the wilful or careless acts of the employees • of the Contractor. " 5. Section 3 (c) of the specifications is hereby amended to read as follows: "Complaints The City shall receive and record all complaints and communications from persons or businesses being served under the provisions of this agreement. At least oncO each work day, or more frequently, if in the opinion of the Director of Public Works or his representative, the number of complaints show a trend toward a significant increase above that to be anticipated in normal growth of the service, the Contractor or his agent shall personally appear at the Office of the Director of Public Works, or such other location as may be directed by the Director of Public Works, for the purpose of receiving the records of such complaints and communications . The Contractor shall, within twenty-four (24) hours there- after, report in writing to the Director of Public Works as to the action taken or other disposal made of each complaint. " 6. Section 3 (b) of the specifications is hereby amended in the following particulars: the termination date of this contract shall be October 31, 1978. 7. Section 4 (a) of the specifications is amended in the following particulars: the following words and figures are added thereto: "In addition to the contract unit price plus any cost of living increases as provided in Section 4 (b) , Compensation Readjustments, the following amounts per active water meter per month shall be added on the dates indicated: August 1, 1971 $0.15 May 1, 1972 0 .04 May 1, 1973 0.04 May 1, 1974 0.04" I IN WITNESS WHEREOF, the parties hereto have set their hands the day and year as is written above.
