Tfl : CITY Of SWITfi CALIFORNIA June 17, 1971 Please address replies to: MEMO TO: City Council FROM: City Manager SUBJECT : GREAT WESTERN RECLAMATION CONTRACT Accompanying this memo are communications from Mr. Tom Blackman, President of Great Western Reclamation, Inc. I am sure you are aware that they recently settled a union bargaining contract which very materially increases the operating costs of Great Western as well as most of the other major contractors for city refuse collection in Orange County. You will also know that Mr. Blackman has asked for a rather large number of amendments to his existing contract to the point that in my opinion it would be impossible for us to even comment upon, let alone make recommendations upon, all of these items by this Council meeting. We have, however, made a rather extensive check on his unit increases in costs as well as kept in close communication with the other major affected cities . It is my strong opinion that equity of treatment of the contractor will demand that he obtain at least a 15per month in- crease per water meter. I do not declare this to be a final figure, and certainly we have no recommendations on the many other items in question; neither does Mr. Blackman accept the 15 figure as from his position an adequate one to compensate him for his increased costs . However, his contract was retroactive to the 1st of May, and unless he gets some temporary relief, he will be operating at a serious loss disadvantage. It is for this reason that we are recommending that the Council authorize the 15c figure over and above his present payment rate to be effective during the months of June and July during which time we will undoubtedly complete our studies of the matter and. will be ina position to recommend to the City Council answers to Mr. Black- man' s request for consideration of changes in his contract as well as make recommendations to the Council as to what we believe to be to the best interest of the City. ge7117 rk 11 in !nl (/ /.a cJc Fes. ane � �r _ Jz e Carl J. March 24 , 1969 , and September 22, 1970, for a period of five (5) years commencing November 1, 1974 , subject to the following changes and amendments: 1. Article II of the contract is amended by Changing Per unit $ 78 to read per unit $1.00 effective June 1, 1971. The per Unit,price` would be further changed as follows : Effective' Date Amou t May 1, 1972 $1', 07 May 1, 1973 1x.12 May 1, 1974 1. 17 With such amendment and applying Section 4 of the specifications to the contract relating to the adjustment, the per unit price effective June 1, would be $1.27 . 2. Section 2 (f) Pages 3 and 4 of the specifications is hereby amended to read as follows : Preparation of Refuse All refuse shall be placed in containers adequate to eliminate overflow or contamination of surrounding areas . Individual containers must not weigh in excess of 15 pounds or have a capacity exceeding 35 gallons , and total weight, including contents , will not exceed 50 pounds . Cardboard or wood cartons , acceptable as temporary containers , will be considered as trash and will not be returned to the user. Small cardboard :i ? City Council Page Two June 14 , 1971 cartons will not be considered as a container and must be broken down. Cardboard, papers , magazines, palm fronds , tree limbs , brush 'or weeds must be securely tied in bundles with heavy cord or wire . This shall be strong enough to act as a handle, and may not exceed 40 pounds , be not more than four feet long or 18 inches thick. Oil drums , grease drums and similar containers , grocery bags , broken wooden boxes or crates, broken or wet cardboard cartons , any containers with rough or jagged edges, which may injure the handler, are not acceptable as trash containers and will not be 'emptied or picked up. Occasionally discarded household items , broken down to size, will also be -considered as refuse. 3. Section 2 (k) , page 5 , of the specifications is hereby amended in thefollowing particulars : Maintenance of Schedules At line 6 thereof the words '6 : 30 a.m. " are deleted and the following is substituted, "5 :00 a.m. " . The following words are to be added, "Collections from Commercial and Industrial areas may start at 3100 a.m. " 4 . Section 2 (m) , page 5 , of the specifications is hereby amended in the following particulars : Standards for Collections At line 7 thereof the words , "and maintained in a manner to eliminate objectionable odors emanating therefrom" are deleted. 5 . Section 2 (n) , page 6 , of the specifications is hereby amended in the following particulars : Containers At lines 5 and 6 thereof the words , "and sanitary condition" , are deleted. At lines 6 , 7 and 8 , the words , "The Contractor shall provide washout facilities for cleaning, disinfecting, City Council Page Three June 14 , 1971 and de-odorizing containers on premises when necessary" are deleted and the following is substituted, "Sanitary conditions of container is user responsibility. " 6 . Section 3 (6) , page 7, of the specifications is hereby amended in the following particulars : Complaints At line 3 thereof the words , "At least twice each work day" are deleted and the following is substituted, "At least one each work day. " Line -6 the words "the records of such complaints and communications" are deleted and the following is substituted, "for the purpose •of receiving bona fide complaints against the Contractor. " The following words are to be added, "These are complaints that the Sani - tation Inspector has verified as to be the responsibility of the Contractor" . 7 , Section 4 , Payments by City, (a) Basic Computation, is amended in the following particulars : The period. after the word month in line 10 is changed to a semicolon and there is added thereafter, "provided however that each duplex family residence served by a single active water meter shall for the foregoing purpose be computed as 1. 8 active water meters , each triplex family residence served by a single active water meter shall for the foregoing purpose be -computed as 2 .6 active water meters , all single family residential units not having an individual active water meter shall be computed as an active water meter and each space in a trailer or mobile park shall for the -foregoing purpose be computed as an active water meter. Each commercial unit occupying identifiably separate space shall constitute a unit and for the foregoing purposes: (1) Service at the first basic level of service, to wit: not more than two (2) 35-gallon containers not exceeding 50 pounds each shall be treated as two :(2) active water meters ; tse City Council Page Four June 14 , 1971 (2). Service at the •sadond basic level of service,' to wit: more than two (2). but not more than six (6) 35-gallon containers , no container to weigh, including contents , more than 50 pounds each and the total weight including containers , not to exceed 200 pounds shall for the foregoing purpose be computed as four (4). active water meters . Any commercial unit requiring more than six (6) 357-gallon containers will be required touse bin serv.ice. " A new Article V is to be added to the 'contract between the 'City and contractor as follows.: Article V, Renegotiation. Contractor has a union contract which expires April l7 , 1975 . Contractor and City acknow- ledge that contractor will berequired to negotiate a new union contract to be effective April 18 , 1975 . Upon execution of the new union contract to be effective April 18 , 1975 , contractor and City shall renegotiate the per unit price provided for in Article 'II of this contract. In order to amend Section 4 , Payments by City, as described above , Section 3830 .6 , Collection Practices, of the Santa Ana Municipal Code (as defined in Ordinance NS-823, effective November 15 , 1965) should be amended in the following particulars : • (2) Limitation on Quantity. (a) Residential - The word "triple*" should be added following the word duplex in line 2 . (b) Commercial, Multi-Family and Industrial - This should be amended to read as follows : Commercial , industrial and residential buildings containing four or more units. The amounts collected from each refuse service stop shall be known as a "basic level of service". The three basic levels of service are follows : '' City Council Page Five June 14 , 1971 1. The first-'basic level: of service is not more than two (2). 35-gallon containers , no container to weigh, including contents ,' more than 50 pounds each and total weight including container not to. exceed 100 pounds per service stop. 2. Thesecond basic level of service, not more than six (6.) 35-gallon containers , no container to weigh, including contents.,` more than 50 pounds each and total weight including container not to exceed 200 pounds per service stop. 3. The third basic level of service shall beany refuse service stop requiring more than six (6) 35-gallon containers , which service will be required to use a bin. Respectfully, GREAT WES.
