With reference to the comment regarding the police staff still awaiting a list of consultants, lobbyists and other representa- tives of Great Western, I believe Council was previously advised shortly after I was several weeks ago by the negotiating repre- sentatives for Great Western, that Mr . Verlyn Jensen was the only representative for their organization at the present time . In addition, with reference to the Securities Act investigation, I believe that this may be in reference to the previous articles which appeared in the Wall Street Journal regarding the financial controversies involving SCA headquarters . In any event, the police staff are completing their investigation, and a copy of their final report will be made available to you as soon as it is received . McDermott Subject: SCA SERVICES - BACKGROUND INVESTIGATION DETAILS The background investigation of SCA Services , Great Western Reclamation and their officers and directors is still in progress. We have obtained the names of officers and directors of SCA and Great Western Reclamation from Mr. Chester Jackson, who is the financial director for SCA Services ' Santa Ana office. On March 23rd we finally obtained the appropriate information on the individuals to allow us to conduct our investigation. At this time we are still waiting for Great Western Reclamation to furnish us a list of their consultants , lobbyist and other representatives. Attached is a list of officers and directors for both organizations . It should be noted that as of this time we have found no evidence or indication of any link with organized crime to SCA Services , Great Western Reclamation or their management personnel. SCA Services are presently under investigation by the Securities and Exchange Commission, 500 North Capitol Street, Washington D.C. 20549. The investigation involves violation of Section 17 (a) of the Securities Act of 1933 ("Securities Act") (15 U.S .C. 77g (a) ) and Section 10 (b) , 13 (a) and 14 (a) of the Securities Exchange Act of 1934 ("Exchange Act") (15 U.S.C. 78j (b) , 78m (a) and 78n (a) ) and Rules lOb-5, 12b-20 , 13a-1, 13a-13 and 14a-9 (17 C.F.R. 240. 10b-5 , 240 .12b-20 , 240. 13a-1, 240. 13a-13 and 240. 14a-9) promulgated there- under. (misuse of four million dollars) They list as the defendants SCA Services , Inc. , Christopher P. Recklitis , Berton Steir, Carlton Hotel Corporation, Nicholas V. Liakas , Anthony Bentrovato a/k/a/ Anthony Bentro, Lad Landfill, Inc. , and Stanton L. Kurzman. The allegations covered the time period of January, 1972 to August, 1975. Karger , DepUtj' Cit Attorney CA-- IL, I subje*, IMPACT OF AB 1938 ON OUR REFUSE_COLLECTION CONTRACT On January 1 , 1977 , Assembly Bill 1938 will become operative . This bill adds a chapter to the California Health and Safety Code re- lating to solid waste enterprises . It is a poorly drafted piece of legislation , in that it seems the Legislature desires to mandate a five year phase out of existing garbage service before a city can pro- vide alternative service, but the bill never comes out and says just that . Instead , it states in relevant part , "that if the solid waste enterprise has an exclusive franchise or contract then the solid waste enterprise shall continue to provide such services and shall be limited to the unexpired term of a contract or franchise or five years , which- ever is less . " The City ' s present contract with Great Western Reclama- tion expires within five years , and therefore the bill would seem to have no impact on our contract with them . However , certain language in the bill could be construed to mean that a city cannot contract for solid waste enterprises for a period of more than five years at a time . It does not seem however , that this is what the Legislature intended, and such construction would be of doubtful validity . As stated above , it seems that the Legislature intended to provide a five year phase out for existing garbage services , should a city wish to provide alternative service . Reading between the lines , the bill is designed to protect solid waste enterprises should a city desire , in the middle of a contract, to provide its own refuse collec- tion services . Until such time as Santa Ana desires to take such action , this bill would have no impact on our refuse collection contract . RICHARD RICHARD LEMON • Mr. Bruce Sprague City Manager City of Santa Ana I 20 Civic Center Plaza Santa Ana, California RE: Great Western Reclamation, Inc. - Expenses and Gifts to City'• Council Members • Bruce : Following a discussion with yourself of several weeks ago, as well as a subsequent conversation with 'Keith 'Gow, City Attorney, I have • been considering how we might seek to resolve the continuing prob- lem of the "alleged disqualification" of certain members of the City Council by reason of expenses incurred for members of the City Council on behalf of Great Western Reclamation, Inc. I had not reached a conclusion as to how to handle this matter when I had occasion to discuss this subject by telephone with Councilman Ortiz last week. As a result of that conversation, it was apparent to me that Council- man Ortiz is deeply concerned that there be something in writing from the company or its representatives confirming his belief that - he has not improperly received any gifts from Great Western Reclama- . tion, Inc. I have undertaken to examine the expense vouchers of Great Western • Reclamation, Inc. concerning all the members of the City Council for the past twelve (12) months. I am unable to find any records indicat- ing that Great Western Reclamation, Inc. paid or reimbursed any ex- penses for or on behalf of the Councilmen in the past twelve (12) months that cumulatively exceed Seventy Dollars ($70 . 00) for any in- dividual Council Member.
