Recitals: A. CITY and CONTRACTOR entered into that certain AGREEMENT FOR COLLECTION AND HANDLING OF SOLID WASTES GENERA IED,PRODUCED AND/OR ACCUMULATED IN THE CITY OF SANTA ANA, dated June 30, 1993, by which CONTRACTOR was granted the exclusive right to collect and dispose of solid waste in the City of Santa Ana (the "Agreement"). B. CITY and CONTRACTOR do now desire to amend the Agreement to modify the method for determining the number of curbside units. WHEREFORE, the parties hereto do hereby agree as follows: 1. That Section 20(a) of the Agreement is amended to read: (a) The CONTRACTOR shall receive compensation from the CITY for supplying curbside service. Effective October 1, 1995, said compensation shall be based on the total number of units billed by the CITY for curbside service during that month. CITY shall make billing records available to CONTRACTOR upon reasonable notice for the purpose of auditing such records. Li Set Public Hearing For Continued to: FILE NUMBER(S): 4 *FY MANAGER _ RECOMMENDED ACTION Authorize the Mayor and Clerk of the Council to execute an amendment to the agreement with Great Western Reclamation to determine the number of curbside units used as the basis for Great Western Reclamation' s compensation on a monthly basis. DISCUSSION In 1993 the City awarded a five year agreement to Great Western Reclamation (GWR) to collect and dispose of the City' s solid waste. This agreement stipulates that the total number of curbside service units shall be determined by the City on April 1st each year and that this number shall be the basis for determining the compensation paid to Great Western Reclamation for that year. The City' s refuse collection is billed on an eight-cycle system; the cycles are unequal in the number of units billed. This method of determining the curbside unit count results in an estimate of the number of units served by Great Western Reclamation for an entire year based on the billing units active on April 1st. To more accurately reflect the number of curbside units receiving service, it is recommended that an amendment to the agreement with Great Western Reclamation be approved to reimburse GWR based on the actual number of units billed each month. Both parties agree that this minor modification will improve the accuracy of reimbursements made to Great Western Reclamation. 039 2 C.S.383 Amendment To Agreement With Great Western Reclamation October 2 , 1995 Page Two FISCAL IMPACT This action will result in an exact direct relationship between the number of units billed by the City for curbside refuse collection and the units that are reimbursed by the City to Great Western Reclamation.
