CITY and CONTRACTOR entered into that certain AGREEMENT FOR COLLECTION AND HANDLING OF SOLID WASTES GENERATED, PRODUCED AND/OR ACCUMULATED IN THE CITY OF SANTA ANA, dated June 3, 1993, by which CONTRACTOR was granted the exclusive right to collect and dispose of solid waste in the City of Santa Ana (the "Agreement") . B. CITY and CONTRACTOR do now desire to amend the Agreement to increase the program surcharge from five percent to six percent. WHEREFORE, in consideration of their mutual and respective promises as set forth in the Agreement, and subject to the terms and conditions of the Agreement as hereby amended, the parties hereto do hereby agree as follows: 1. That Section 10 of the Agreement is amended by replacing the words "five (5%) percent" with the words "six (6%) percent" wherever they appear. 2. That Section 24 of the Agreement is amended by adding subsection (c) thereto, to read as follows: " (c) INCREASES IN PROGRAM SURCHARGE: Should any increase in the solid waste program surcharge specified in Section 10 of this Agreement occur during the term of this Agreement, CONTRACTOR shall be permitted to pass through to both its bin service customers and its roll-off service customers the amount of such increase." DISCUSSION The agreement with Great Western Reclamation (GWR) requires GWR to pay five percent of their gross receipts to the City as a program surcharge) fee to cover administrative, billing and support costs for the refuse collection enterprise. The program surcharge fee is assessed on gross receipts collected from GWR' s customers - businesses and multi-family residents receiving bin and roll-off services. A fee increase of one percent is being recommended under separate action to cover cost-of-living expenses in the City' s curbside collection program. A similar increase is proposed with this action to cover cost-of-living increases in the City' s bin and roll-off refuse collection program. FINUMBER(S): Fees CIN MANAGER �'=-=--=•- RECOMMENDED ACTION Adopt a resolution establishing the refuse collection rate effective July 1, 1994 and providing for adjustment of the rate based on changes in disposal, collection and recycling charges. DISCUSSION The City' s refuse collection rate is comprised of several components. The rate includes a gate fee component which the City indirectly pays to the County of Orange for disposal services at the landfill . Gate fees are determined by the County. Board of Supervisors and are beyond the direct control of the City. There will be no increase in the gate fee on July 1, 1994 . The refuse collection rate includes a collection and recycling component which the City pays directly to Great Western Reclamation. Charges and adjustments for collection and recycling services were determined by a competitive RFP process in 1993 and reflected in a subsequent agreement with Great Western Reclamation. The City implemented the first two phases of its recycling program last year without a rate increase. Effective July 1, 1994 , the rate for collection and recycling will increase to support the implementation of the final phase of the City' s recycling program which is required by state mandate. The refuse collection rate also includes administrative fees to support the City' s billing operation and administration of the refuse and recycling program. Administrative fees reflect only a cost of living increase. 155 5G C.S.363 Public Hearing to Consider Adjustments to the Refuse Collection Rate July 5, 1994 Page 2 Increases as they occur must be passed on to the curbside refuse customer if the refuse collection enterprise is to remain self- supporting. Staff recommends approval of a resolution that sets the refuse rate effective July 1, 1994 and provides for the adjustment of the rate as changes in refuse disposal, collection and recycling become effective. FISCAL IMPACT The increase required to pay for the final phase of the City' s recycling program is estimated at a cost of $550 , 600 in fiscal year 94-95. The increase due for cost of living adjustments is estimated to cost $30 , 100 in the 94-95 fiscal year. Both are contractual obligations of the agreement with the City' s refuse contractor and were effective July 1, 1994 . The rate payable by the curbside customer will be $12 . 82 per month. Ross Rod Colonia Executive Director Executive Director Public Works Agency Finance & Management Services JGR/TLC/W08kg 156 kit RESOLUTION 947047 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA PROVIDING FOR ADJUSTMENTS TO THE CITY ' S CURBSIDE REFUSE COLLECTION RATE WHEREAS, the City of Santa Ana maintains a refuse collection enterprise to provide for curbside refuse collection to residents of the City of Santa Ana and has adopted a refuse collection rate to provide these services; and WHEREAS, it is the policy of the City Council that the City of Santa Ana' s refuse collection enterprise be self-supporting and supported by charges made to the customers receiving refuse collection services; and WHEREAS, the State of California has imposed laws requiring each city to reduce the amount of refuse disposed of in the landfills and to implement a recycling program; and WHEREAS, the City selected a refuse contractor to perform refuse collection and recycling services following a formal RFP process in 1993 and selected the lowest cost proposal; and WHEREAS, . the curbside refuse rate is comprised of several components, including gate fees, collection and recycling and administrative fees; and WHEREAS, the landfill component of the rate is determined by the County Board of Supervisors and the collection and recycling component is determined by separate agreement with the City's refuse contractor; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS; 1. On July 1, 1994 the refuse rate payable by the curbside customer shall be $12.82 per month. 2. The curbside customer' s refuse rate shall thereafter be adjusted as required by any adjustment to the gate fee and/or in accordance with the agreement for refuse collection.
