THIS SECOND AMENDMENT TO AGREEMENT, made and entered into this —I `
day of Oc e-Se-'t , 1995, by and between the City of Santa Ana, a municipal corporation of
the State of California ("CITY") and Great Western Reclamation, a division of Waste Management
Collection and Recycling, Inc., a California corporation ("CONTRACTOR").
Recitals:
A. CITY and CONTRACTOR entered into that certain AGREEMENT FOR
COLLECTION AND HANDLING OF SOLID WASTES GENERATED,PRODUCED AND/OR
ACCUMULATED IN THE CITY OF SANTA ANA, dated June 30, 1993, by whish
CONTRACTOR was granted the exclusive right to collect and dispose of solid waste in the City
of Santa Ana (the "Agreement").
B. CITY and CONTRACTOR do now desire to amend the Agreement to modify the
method for determining the number of curbside units.
WHEREFORE, the parties hereto do hereby agree as follows:
1. That Section 20(a) of the Agreement is amended to read:
(a) The CONTRACTOR shall receive compensation from the CITY for supplying
curbside service. Effective October 1, 1995, said compensation shall be based on
the total number of units billed by the CITY for curbside service during that month.
CITY shall make billing records available to CONTRACTOR upon reasonable
notice for the purpose of auditing such records.
IN WITNESS WHEREOF, the parties hereto have executed this SECOND AMENDMENT
TO AGREEMENT the date and year first above written.

RECOMMENDED ACTION
Authorize the Mayor and Clerk of the Council to execute an amendment
to the agreement with Great Western Reclamation to determine the
number of curbside units used as the basis for Great Western
Reclamation' s compensation on a monthly basis.
DISCUSSION
In 1993 the City awarded a five year agreement to Great Western
Reclamation (GWR) to collect and dispose of the City's solid waste.
This agreement stipulates that the total number of curbside service
units shall be determined by the City on April 1st eachyear and
that this number shall be the basis for determining the compensation
paid to Great Western Reclamation for that year.
The City' s refuse collection is billed on an eight-cycle system;
the cycles are unequal in the number of units billed. This method
of determining the curbside unit count results in an estimate of the
number of units served by Great Western Reclamation for an entire
year based on the billing units active on April 1st.
To more accurately reflect the number of curbside units receiving
service, it is recommended that an amendment to the agreement with
Great Western Reclamation be approved to reimburse GWR based on the
actual number of units billed each month. Both parties agree that
this minor modification will improve the accuracy of reimbursements
made to Great Western Reclamation.

FISCAL IMPACT
This action will result in an exact direct relationship between the
number of units billed by the City for curbside refuse collection
and the units that are reimbursed by the City to Great Western
Reclamation.

RESOLUTION 95- 020
RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA ANA TO REVISE THE
CITY'S CURBSIDE REFUSE COLLECTION RATE
EFFECTIVE JULY 1, 1995
WHEREAS, the City of Santa Ana maintains a refuse collection enterprise to provide for curbside
refuse collection to residents of the City of Santa Ana and has adopted a refuse collection rate to provide
these services; and
WHEREAS, it is the policy of the City Council that the City of Santa Ana's refuse collection
enterprise be self-supporting and supported by charges made to the customers receiving refuse collection
services; and
WHEREAS, the State of California has imposed laws requiring each city to reduce the amount of
refuse disposed of in the landfills and to implement a recycling program; and
WHEREAS, the curbside refuse rate is comprised of several components, including gates fees,
collection and recycling and administrative fees; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SANTA ANA AS FOLLOWS:
1. On July 1, 1995 the refuse rate payable by the curbside customer shall be $14.99 per month.
2. Except as modified by this resolution, City Council Resolution 94-047 remains in effect.
