In 1989, the City Council adopted a resolution approving a freeway agreement with Caltrans to widen the I-5 Freeway. The agreement stipulated that, for any newly created or realigned local streets, the City would assume maintenance responsibilities upon construction completion, and would accept title ownership upon relinquishment by Caltrans. The 1-5 Freeway widening project was completed in the mid-1990s and Caltrans now wishes to delete these local streets from the State Highway System (Exhibit 1). Under the provisions of the Streets and Highways Code, the State is required to notify any City to whom it intends to relinquish a State highway at least 90 days prior to recordation of such relinquishment. Since these streets are in good condition and because the improvements have been in local use since the project completion, there is no need for the additional 90 -day delay. Therefore, City staff recommends waiving the 90 -day notice requirement. One of the identified relinquishment site would allow for the development of a proposed hotel on Main Street and the 5 Freeway. STRATEGIC PLAN ALIGNMENT Approval of this item supports the City's efforts to meet Goal #6 — Community Facilities & Infrastructure, Objective #1 (establish and maintain a Community Investment Plan for all City assets), Strategy G (develop and implement the City's Capital Improvement Program in coordination with the Community Investment and Deferred Maintenance Plans). The City Council of the City of Santa Ana hereby finds, determines and declares as follows: A. At various times, the State of California Department of Transportation ("State") has acquired title to certain segments of land abutting State Highway Route 5 to complete highway projects. B. The State wishes to relinquish its title to certain of these segments located within the City. These segments are depicted as segments 1 through 10 on Exhibit A, as attached and incorporated by reference. Upon relinquishment, all right, title, and interest in these parcels shall vest in the City. C. The parcels are in a state of good repair. D. Under Section 73 of the California Streets and Highways Code, prior to relinquishing any portion of a state highway to a county or a city, the State is required to give 90 days' notice in writing of its intention to relinquish to the board of supervisors, or the city council, as the case may be. E. The City of Santa Ana and the State have met regarding the relinquishment of the parcels in question and determined that the 90 -day notice requirement will prolong the process of relinquishment without benefit to the City or the State. Section 2. The City Council of the City of Santa Ana hereby waives its right to receive 90 days' written notice by the State of the State's intent to relinquish segments 1 through 10 depicted in Exhibit A. This Resolution shad take effect immediately upon its adoption by the City Council, and the Clerk of the Council shall attest to and certify the vote adopting this Resolution.
