PUBLIC COMMENTS
• Irma Macias, commented that strong leadership from the City Council needed to solve
community issues such as homelessness; incoming City Manager has worked for the City
in other capacities, but not as a City Manager.

Councilmember Sarmiento, stated that Mayor not present and opposed to
signing contract although fiduciary responsibility; request that City Attorney
prepare an ordinance to authorize the Mayor Pro Tem or designee to execute
such documents; opined that matter may be violation of Code of Ethics and
Conduct.
Councilmember Benavides, concurred with Councilmember Sarmiento; need to
implement policy to avoid calling a Special Meeting to execute documents
approved by a council majority.
Councilmember Solorio, expressed support for policy that woud allow a
member of prevailing side to sign documents — blanket policy.

Councilmember Tinajero, concerned with possible violation of Code of Ethics;
noted that incoming City Manager was vetted through process dictated by the
City — democratic process.
Mayor Pro Tem Martinez, commented that City Council need to conduct the
people's business and avoid politizing decisions, follow Charter; all members
respect decisions of the council majority.
Councilmember Solorio, proposed substitute motion to approve policy that
would allow Mayor Pro Tem or designee to execute this and any future
contracts; noted that he was opposed to total contract amount.
City Attorney Carvalho, indicated that Charter includes authority in the case of
an absence, but no provision when Mayor present and dissented; referenced
2015 Case Law that may apply in this matter.
MOTION: Direct and authorize the Mayor Pro Tem and the Clerk of the
Council to execute the attached agreement appointing Raul Godinez as
the City Manager for the City of Santa Ana (AGMT. No. 2017-292).
