HomeMy WebLinkAboutRESO 2018-01_2115 N MAIN STREETEXEMPT FROM FEES PURSUANT TO GOVERNMENT CODE § 27383 RESOLUTION NO. 2018-01 A RESOLUTION OF THE HISTORIC RESOURCES COMMISSION OF THE CITY OF SANTA ANA APPROVING THE CERTIFICATE OF APPROPRIATENESS, AS CONDITIONED, FOR THE PROPERTY LOCATED AT 2115 NORTH MAIN STREET (HISTORIC EXTERIOR MODIFICATION APPLICATION NO. 2017-01) BE IT RESOLVED BY THE HISTORIC RESOURCES COMMISSION OF THE CITY OF SANTA ANA AS FOLLOWS: Section 1. The Historic Resources Commission of the City of Santa Ana hereby finds, determines and declares as follows: A. Net Development Company ("Applicant"), representing the Jahangiri Family Trust, is requesting approval of Historic Exterior Modification Application No. 2017-01 to allow exterior modifications to the structure. B. The MacFarlane House is individually listed on the Santa Ana Register of Historical Properties as No. 122 and is categorized as Contributive. The structure was build circa 1910 and is a Craftsman/Bungalow style. The house features a cross -gable roof, braces with decorative round ends, rafter tails, and barsgebflards with rounded ends,_ narrow lap and _square butt shingle siding with wood windows and doors. C. Pursuant to Santa Ana Municipal Code Section 3Q-6, no exterior physical modifications, other than those identified by the Historic Resources Commission for administrative approval by city staff, shall be permitted with respect to an historic structure until the Historic Resources Commission approves such request at a duly noticed public hearing and issues a certificate of appropriateness. The Historic Resources Commission shall issue the certificate of appropriateness upon finding that the proposed modification(s) does not substantially change the character and integrity of the historic property. D. The exterior modifications proposed are to allow for the structure to be used as an eating establishment associated with a commercial development project. In particular, the key exterior improvements include: North Elevation: Removal of the non -original staircase and sealing the second floor door in place from the interior. Removal of the two center windows on the ground floor and replacement with two new glass panel wood doors that allow access to a new raised outdoor Resolution No. 2018-01 Page 1 of 6 EXEMPT FROM FEES PURSUANT TO GOVERNMENT CODE § 27383 dining deck. A wall would be added to the north of the structure to buffer the outdoor dining deck from the street. E. Pursuant to Santa Ana Municipal Code Section 30-6, the Historic Resources Commission held a duly noticed public hearing on January 25, 2018 for the request for exterior modifications to the MacFarlane House. F. Since the property is listed on the Santa Ana Register of Historical Properties, all exterior modifications are required to meet the Secretary of Interior's Standards for Rehabilitation. 1. The following Secretary of Interior's Standards are applicable: i. Standard 1: The property will be given a new use as an eating establishment that requires minimal changes to its distinctive materials, features, spaces and spatial relationships. ii. Standard 2: The removal of distinct materials will be avoided. Two windows on the north elevation will be replaced with doors to allow access in and out of the structure. The new doors will be placed in the same location as the windows to avoid the need for new or expanded openings. iii. Standard 3: The property will be recognized as a physical record of its time, place and use. Historic Property Preservation Agreement No. 2015-01 commits the owner to maintaining the property in a good state of repair and to rehabilitate the property as necessary to maintain its character and appearance. iv. Standard 4: Minimal changes to the exterior are proposed to retain and preserve the historic significance of the structure. V. Standard 5: The cross -gable roof, braces with decorative round ends, rafter tails, and bargeboards with rounded ends, narrow lap and square butt shingle siding and wood windows and doors will be retained and preserved with the exception of two windows that will be replaced with doors. vi. Standard 9: The new door and wood surrounds will be differentiated from the old and will be compatible with the historic materials, features, size, scale and proportion to protect the integrity of the property and its environment. Vii. Standards 10: The new raised outdoor deck and wall will be constructed independently from the MacFarlane House. The deck and wall will be 1 to 2 inches away to allow the siding to breathe and if removed the integrity of the historic property would be unimpaired. 2. Standards 6, 7, and 8 are not applicable. There are no repairs needed at this time to the structure. No chemical or physical Resolution No. 2018-01 Page 2 of 6 EXEMPT FROM FEES PURSUANT TO GOVERNMENT CODE § 27383 treatments are proposed. The resource will be protected and preserved in place. Section 2. Mitigated Negative Declaration (Environmental Review No. 2017- 96) and a Mitigation Monitoring and Reporting Program was prepared with respect to this project. The Historic Resources Commission has, as a result of its consideration of the record as a whole and the evidence presented at the hearings on this matter, determined that, as required pursuant to the California Environmental Quality Act (CEQA) and the State CEQA Guidelines, Environmental Review No. 2017-96 meets all the requirements of CEQA. Section 3. The Historic Resources Commission of the City of Santa Ana after conducting the public hearing hereby approves the Certificate of Appropriateness, as conditioned in Exhibit B, attached hereto and incorporated herein, for Historic Exterior Modification Application No. 2017-01. The Historic Resources Commission finds that the proposed modification(s) does not substantially change the character and integrity of the historic property. This decision is based upon the evidence submitted at the above said hearing, which includes, but is not limited to: the Staff report and exhibits attached thereto and the public testimony, written and oral, all of which are incorporated herein by this reference. Section 4. The Historic Resources Commission Secretary is hereby directed to file a certified copy of this Resolution with the County Recorder's Office after the adoption of this Resolution pursuant to Public Resources Code Section 5029. The Applicant must comply with the conditions listed below prior to exercising the rights conferred by the Certificate of Appropriateness (Historic Exterior Modification Application No. 2017-01). 1. Prior to the issuance of a certificate of occupancy, a plaque per City Standard shall be displayed on the exterior of the structure. 2. Prior to the issuance of a certificate of occupancy, landscaping shall be installed on site. A view corridor enabling the general public to see the Historic Property from the public right-of-way shall be maintained. The Applicant and any future Owners shall not be permitted to block the view corridor to the Historic Property with shrubbery, so as to prevent the viewing of the Historic Property by the public. r� L Resolution No. 2018-01 Exhibit B Page 6 of 6
