HomeMy WebLinkAboutRESO 2018-10_2000 W ALTON AVELS 3.12.18 RESOLUTION NO. 2018-10 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SANTA ANA APPROVING CONDITIONAL USE PERMIT NO. 2018-02 AS CONDITIONED TO ALLOW THE CONSTRUCTION OF A 44,997 -SQUARE FOOT CHURCH CAMPUS WITH 1,250 SEATS FOR CHRIST OUR SAVIOR CATHOLIC CHURCH LOCATED AT 2000 WEST ALTON AVENUE BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA ANA AS FOLLOWS: Section 1. The Planning Commission of the City of Santa Ana hereby finds, determines and declares as follows: A. David Pfeifer with Domusstudio Architecture, representing Christ Our Savior Catholic Parish (Applicant), is requesting approval of Conditional Use Permit No. 2018-02 as conditioned, to allow the construction of a new 18,601 -square foot church with 1,250 seats, a 15,775 -square foot parish hall, a 5,966 -square foot parish center and a 4,655 -square foot meeting and office building at 2000 West Alton Avenue. B. Pursuant to Section 4 of Specific Development No. 4 (SD -4), a conditional use permit (CUP) is required for churches and accessory church buildings and functions. C. Conditional Use Permit No. 2018-02 came before the Planning Commission of the City of Santa Ana on March 12, 2018, for a duly noticed public hearing. D. The Planning Commission determines that the following findings, which must be established in order to grant this Conditional Use Permit pursuant to Santa Ana Municipal Code (SAMC) Section 41-638, have been established for Conditional Use Permit No. 2018-02: 1. That the proposed use will provide a service or facility which will contribute to the general wellbeing of the neighborhood or community. Christ Our Savior Catholic Parish has been providing a place of worship and gathering and educational services to the community since 2008. The granting of this CUP will allow the church to expand its services and audience, as they have outgrown their current temporary facilities. The proposed facilities will support and directly benefit the public welfare physically, emotionally, and spiritually. The Resolution No. 2018-10 Page 1 of 7 planned facilities will offer greater worship, fellowship, and counseling, as well as provide community meeting facilities to meet this need. These types of uses become focal points and gathering places within a community, serving all. 2. That the proposed use will not, under the circumstances of the particular case, be detrimental to the health, safety, or general welfare of persons residing or working in the vicinity. Christ Our Savior Catholic Parish is not anticipated to create any detrimental impacts to persons residing or working in the area. All functions will be conducted within enclosed buildings. The proposed site plan was crafted to minimize noise impacts, if any, to the adjacent properties. Furthermore, the utilities and infrastructure necessary to support this facility exist and are adequate. The project will not impact the existing utilities or infrastructure. The project also meets all current Planning, Building, Fire, Police and Public Works standards. The proposed phasing of the project will also assist to mitigate disruption to the site and community, if any. As such, the project will not be detrimental to the public health, safety and welfare. 3. That the proposed use will not adversely affect the present economic stability or future economic development of properties surrounding the area. The proposed project will not create any negative or detrimental impacts on the economic viability of the surrounding area. The use will result in a positive addition to the community and will identify the site as a landmark of the city. The new facilities will not remove any job producing nor economically significant elements. The off - hour and weekend use patterns of churches can positively affect surrounding businesses by generating off peak hour customers and activity. 4. That the proposed use will comply with the regulations and conditions specified in Chapter 41 for such use. The project is consistent will all development standards identified under Specific Development No. 4 and the Santa Ana Municipal Code. Furthermore, the project was designed in accordance with Chapter 10 (Special Use Guidelines) and Section 12 (Religious Institution) of the Citywide Design Guidelines adopted by the City Council in 2006. 5. That the proposed use will not adversely affect the General Plan of the city or any specific plan applicable to the area of the proposed use. Resolution No. 2018-10 Page 2 of 7 The project will not pose any adverse effects on the General Plan designation of Low Density Residential (LR -7). The proposed church use is a permitted use within SD -4 subject to approval of a CUP by the Planning Commission. The project is consistent with both the general plan and the zoning of the property. The proposed project is a revitalization of an existing temporary church campus that has been established in the neighborhood for over 9 years. The services currently being provided to the community will be enhanced through the implementation of the project. The proposed project will allow the church to better serve the community and will not adversely affect the applicable land use plan. Section 2. In accordance with the California Environmental Quality Act (CEQA), the Project is subject to a previously prepared and certified Environmental Impact Report (Certified EIR No. 2000-01 / State Clearinghouse No. 2001031004). Pursuant to Section 15162 of the State CEQA Guidelines, the City of Santa Ana has determined the following: 1. There are no substantial changes to the Project that would require major revisions of the Certified EIR due to new significant environmental effects or a substantial increase in severity of impacts identified in the Certified EIR. 2. Substantial changes have not occurred in the circumstances under which the Project is being undertaken that will require major revisions to the Certified EIR to disclose new significant impacts. 3. There is no new information of substantial importance which was not known at the time the EIR was certified indicating any of the following: a. The Project will have one or more new significant effects not discussed in the Certified EIR; b. There are impacts determined to be significant in the Certified EIR that will be substantially more severe; c. There are additional mitigation measures or alternatives to the Project that would substantially reduce one or more significant effects identified in the Certified EIR; and, d. There are additional mitigation measures or alternatives which are considerably different from those analyzed in the Certified EIR that would substantially reduce a significant impact identified in the Certified EIR, but the project proponents declined to adopt. The Applicant agrees to indemnify, hold harmless, and defend the City of Santa Ana, its officials, officers, agents, and employees, from any and all liability, i claims, actions or proceedings that may be brought arising out of its approval of this project, and any approvals associated with the project, including, without limitation, any environmental review or approval, except to the extent caused by the sole negligence of the City of Santa Ana. Section 4. The Planning Commission of the City of Santa Ana after conducting the public hearing hereby approves Conditional Use Permit No. 2018-02 as conditioned in Exhibit A attached hereto and incorporated as though fully set forth herein for the project located at 2000 West Alton Avenue. This decision is based upon the evidence submitted at the above said hearing, which includes, but is not limited to: the Request for Planning Commission Action dated March 12, 2018, and exhibits attached thereto; and the public testimony, written and oral, all of which are incorporated herein by this reference. Date: `e'' V- u Commission Secretary City of Santa Ana Resolution No. 2018-10 Page 5 of 7 Conditions for Approval for Conditional Use Permit No. 2018-02 Conditional Use Permit No. 2018-02 is approved subject to compliance, to the reasonable satisfaction of the Planning Manager, with applicable sections of the Santa Ana Municipal Code, the California Administrative Code, the California Building Standards Code, and all other applicable regulations. In addition, they shall meet the following conditions of approval: The Applicant must comply with each and every condition listed belowrip or to exercising the rights conferred by this conditional use permit. The Applicant must remain in compliance with all conditions listed below throughout the life of the development project. Failure to comply with each and every condition may result in the revocation of the site plan review, variance and tentative parcel map. A. Planning Division Conditions: 1. All proposed site improvements must conform to the Site Plan Review approval of DP No. 2016-40. 2. Any amendment to this conditional use permit, including modifications to approved materials, finishes, architecture, site plan, landscaping, parking, and square footages must be submitted to the Planning Division for review. At that time, staff will determine if administrative relief is available or if the conditional use permit must be amended. 3. The Applicant shall comply with the Mitigation Measures within the Mitigation Monitoring and Reporting Program prepared for the project. 4. Applicant must submit a construction schedule and staging plan to the Planning Division for review and approval. The plan shall include construction hours, staging areas, parking and site security/screening during project construction. 5. A detailed landscape plan must be reviewed and approved by the Planning Division prior to issuance of any building permits. The landscape plan shall conform to the Citywide Design Guidelines and the City's Water Efficient Landscape Ordinance. 6. After project occupancy, landscaping shall be maintained to include the minimum level of plant materials installed at the time of occupancy as required by the approved plans. A Public Art Plan must be submitted to the Planning Division for review and approval prior to issuance of a building permit and the art work must be installed prior to issuance of a certificate of occupancy. 8. A copy of these conditions of approval shall be kept on the premises at all times and made available to any City employee upon request. 9. The number of persons allowed inside the facility may not exceed the maximum occupancy allowed by the California Building Code (CBC). The maximum occupancy shall be issued by the City's Building Official upon approval of building permit and shall be clearly posted at all times in accordance with the requirements of the CBC. 10. The Christ Our Savior Catholic Church Parish shall maintain a monthly schedule of events, which it shall post on its website. The schedule of events on the website shall be updated regularly. B. Orange County Fire Authority Conditions: 1. Prior to approval or issuance of a grading permit or building permit, whichever comes first, the Applicant shall submit plans and obtain approval of the following: a. Fire master plan (service code PR145) b. Architectural (service codes PR200-PR285) C. Underground piping for private hydrants and fire sprinkler system (service code PR470-PR475) d. Fire sprinkler system (service codes PR400-PR465) e. Fire alarm system (service code PR500-PR520) f. Hood and duct extinguishing system (service code PR 335) Resolution No. 2018-10 Page 7 of 7 I
