ORDINANCE NS-815 AMENDING SECTIONS 4118. AND <br />4118.1 OF THE SANTA ANA MUNICIPAL CODE <br />REGULATING KENNELS <br /> <br /> THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS <br />FOLLOWS: <br /> <br /> SECTION 1: That Part 1, Chapter 1 of Article IV of the Santa <br />Aha Municipal Code is hereby amended by amending Section 4118. and <br />Section 4118.1 to read in words and figures as follows: <br /> <br />SECTION 4118. Kennels, Fees. <br /> <br /> A license fee is hereby levied on all kennels in the City <br />which contain more than three (3) dogs. A kennel containing <br />only three (3) dogs shall obtain a license and pay the tax <br />therefor on each of said dogs individually. The kennel license <br />fees are fixed as follows: <br /> (a) For kennels containing more than three (3) but less <br /> than eleven (11) dogs, the sum of $10.00 per year or <br /> fraction thereof. <br /> (b) For kennels containing eleven (11) and less than <br /> twenty (20) dogs, the sum of $20.00 per year or <br /> fraction thereof. <br /> (c) For kennels containing more than twenty (20) dogs, the <br /> sum of $1.00 per dog per year or fraction thereof. <br /> <br />SECTION 4118.1. Kennels, Requirements. <br /> <br /> Ail pens must be securely enclosed with a wire fence not less <br />than six feet in height. All houses for sleeping must have a <br />floor elevated at least six inches above ground level, must have <br />a cement floor, must be tight against the elements, except for <br />the entrance, and must comply with the requirements of the <br />Building Code. At least 100 square feet of securely fenced run <br />area must be provided for each dog. <br /> <br /> No person shall allow the runs to become a nuisance in any <br />manner and all dog fertilizer and food scraps must be cleaned up <br />and removed at least once each day. All barking or howling dogs <br />shall be kept in an enclosed room with insulated walls to prevent <br />the travel of sound at an objectionable level from the kennel <br />building. <br /> <br /> No kennel which contains or is designed to contain more than <br />twenty (20) dogs shall be established or licensed when any part <br />of the kennel buildings or runs are closer than 500 feet to any <br />building used for human habitation, and no such kennel shall be <br />maintained or continued in existence or operation when any <br />building used for human habitation exists within 300 feet of any <br />part of the kennel buildings or runs, unless the number of dogs <br />contained therein is reduced to cc~ply with the paragraphs <br />hereinbelow in this Seqtion set out. <br /> <br /> No kennel which contains or is designed to contain at least <br />four (4) but not more than nineteen (19) dogs shall be established <br />or licensed if any part of the kennel buildings or runs are <br />closer than 300 feet to any building used for human habitation, <br />and no such kennel shall be maintained or continued in existence <br />or operation when any building used for human habitation exists <br />within 200 feet of any part of the kennel buildings or runs. <br /> No kennel shall be established, licensed, or maintained in <br />existence which contains only three (3) dogs when any part of the <br />kennel buildings or runs is closer than 200 feet to any building <br />used for human habitation. <br /> The residence of the kennel operator or owner shall not be <br />deemed a building used for human habitation within the language <br />of this Section. <br /> <br />-1- <br /> <br /> <br />
