REL:nr <br />11-3-76 <br /> <br />ORDINANCE NO. NS-1337 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA APPROVING <br />AMENDMENT APPLICATION NO. 750 FILED BY H. VON <br />PACKARD AND FLOYD L. PACKARD REZONING PROPERTY <br />FROM THE C1 (GENERAL COMMERCIAL) DISTRICT TO <br />THE R1 (SINGLE-FAMILY RESIDENCE) DISTRICT, AND <br />AMENDING SECTIONAL DISTRICT MAP 10-5-10 <br /> <br /> WHEREAS, the Planning Commission has given notice of <br />and duly held a public hearing on Amendment Application No. 750, <br />filed by H. Von Packard and Floyd L. Packard to rezone property, <br />generally located on the south side of Westminster Blvd. between <br />Fairview Street and Mar-Les Drive from the C2 (General Commercial) <br />District to the R1 (Single-Family Residence) District, and said <br />Commission has recommended approval of said application; and <br /> <br /> WHEREAS, the City Council regularly held a public hear- <br />ing on said reclassification on published notice required by law, <br />and does now find that the public necessity, convenience, and <br />general welfare require that the said property be reclassified <br />from the C2 (General Commercial) District to the R1 (Single-Family <br />Residence) District, and that such new classification will not be <br />detrimental to the surrounding property; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA <br />ANA DOES ORDAIN AS FOLLOWS: <br /> <br /> SECTION 1: That the real property in the City of Santa <br />Ana, County of Orange, California, described as follows: <br /> <br /> That portion of the Northeast quarter of the Northeast <br /> quarter of Section 10, Township 4 South, Range 10 West, <br /> in the Rancho Las Bolsas, as said Section is shown on <br /> a map recorded in book 51, page 12 of Miscellaneous <br /> Maps, records in the office Of the County Recorder of <br /> said County, described as follows: Beginning at a point <br /> on the North line of said Section, West 420 feet from <br /> the Northeast corner thereof; thence South 436 feet par- <br /> allel to the East line of said Section; thence West <br /> 100 feet parallel to the North Line of said Section; <br /> thence North 436 feet parallel to the East line of said <br /> Section to the North line of said Section; thence. East <br /> 100 feet along said North line to the point of beginning; <br /> EXCEPTING THEREFROM the North 193 feet thereof, <br /> <br /> is hereby reclassified from the C2 (General Commercial) District <br /> to the R1 (Single-Family Residence) District, and that Sectional <br /> District Map 10-5-10 is hereby amended to show said reclassifica- <br /> tion, in accordance with Exhibit A.A. 750-A. <br /> <br /> SECTION 2: Neither the adoption of this ordinance nor <br /> the repeal hereby of any ordinance shall in any manner affect <br /> the prosecution for violation of ordinances, which violations <br /> were committed prior to the effective date hereof, nor be con- <br /> strued as affecting any of the provisions of such ordinance re- <br /> lating to the collection of any such license or penalty or the <br /> penal provisions applicable to any violation thereof, nor to <br /> affect the validity of any bond or cash deposit in lieu thereof, <br /> required to be posted, filed or deposited pursuant to any ordi- <br /> nance and all rights and obligations thereunder appertaining <br /> shall continue in full force and effect. <br /> <br /> <br />
