ORDINANCE NO. NS -2952 <br />AN ORDINANCE OF THE CITY OF SANTA ANA ADDING <br />ARTICLE VII TO CHAPTER 35 OF THE SANTA ANA <br />MUNICIPAL CODE RELATED TO A TRANSACTIONS AND <br />USE TAX TO BE ADMINISTERED BY THE CALIFORNIA <br />DEPARTMENT OF TAX AND FEE ADMINISTRATION <br />The City Council of the City of Santa Ana does ordain as follows: <br />SECTION 1. Authority. The City Council and the Voters of the City of Santa Ana <br />enact this ordinance in accordance with the authority granted to cities by Article XI, <br />Section 7 of the California Constitution and Section 7285.9 of the California Revenue and <br />Taxation Code. <br />SECTION 2. Addition of article. Article VII is hereby added to Chapter 35 of the <br />Santa Ana Municipal Code to read as follows: <br />CHAPTER 35- TAXATION <br />ARTICLE VII. - TRANSACTIONS AND USE TAX, <br />Sec. 35-200. - Short title. <br />This article shall be known as the "Transactions and Use Tax" and shall be <br />applicable in the incorporated territory of the City of Santa Ana ("city"). <br />Sec. 35-201. - Definitions. <br />For the purpose of this article the following words terms shall have the <br />meaning given in this section: <br />"In the city" means and includes all territory within the city limits. <br />"Operative Date" means the first day of the first calendar quarter <br />commencing more than 110 days after the later of the adoption of this chapter and <br />the approval by the voters of the city of a measure approving the imposition of an <br />increased transactions and use tax; provided that, if the city shall not have entered <br />into a contract with the California Department of Tax and Fee Administration as <br />required by section 35-203. prior to such date, the operative date shall be the first <br />day of the first calendar quarter following the execution of such a contract. <br />Sec. 35-202. - Purpose. <br />This article of the Santa Ana Municipal Code has been adopted for the <br />following purposes, and directs that the provisions hereof be interpreted in order <br />to accomplish those purposes: <br />Ordinance No. NS -2952 <br />Page 1 of 8 <br />
