This notice is being <br />sent to those who live or own property within 500 feet of the project site or who have expressed an interest in the <br />proposed action. We encourage you to contact us prior to the Public Hearing if you have any questions. If you <br />challenge the decision on the below matter, you may be limited to raising only those issues you or someone else <br />raised at the public hearing described in this notice, or in written correspondence delivered to the Planning <br />Commission or City Council of the City of Santa Ana at, or prior to, the public hearing. <br /> <br />Planning Commission Action: The Planning Commission will hold a Public Hearing to receive <br />public testimony, and will take action on the item described below. Decision on the Site Plan Review <br />and Addendum to the Environmental Impact Report decision is final unless appealed to the City Council <br />within 10 days of the decision by any interested party or group. Recommendation on the Density <br />Bonus Agreement matter will be forwarded to City Council for final determination. <br /> <br />Location: 114 East Fifth Street and 117 East Fifth Street in the Transit Zoning Code (Specific <br />Development No. 84), Downtown sub-zone <br /> <br />Proposed Project: The applicant, Toll Brothers Apartment Living, is proposing to demolish an <br />existing building and parking lot located at 114 East Fifth Street, and remove a surface parking lot <br />located at 117 East Fifth Street in order to construct a mixed-use development project consisting of 220 <br />rental units and 12,350 square feet of commercial space on a total of 2.78 acres. In order to facilitate <br />the project, the applicant is requesting approval of (1) Site Plan Review No. 2019-01 and (2) Density <br />Bonus Agreement No. 2019-01. In addition, the applicant is requesting approval and adoption of an <br />addendum to the Environment Impact Report (EIR) for the Transit Zoning Code Project (SCH NO. <br />2006071100) and re-adoption of a mitigation monitoring and reporting program. <br /> <br />Environmental Impact: In accordance with the California Environmental Quality Act (CEQA), the <br />Planning Commission of the City of Santa Ana hereby finds, determines, and declares that based on <br />the substantial evidence set forth in the record, including but not limited to the 2010 EIR and the 2019 <br />Addendum, an addendum is the appropriate document for disclosing the changes to the subject <br />properties, and that none of the conditions identified in Public Resources Code section 21166 and State <br />CEQA Guidelines section 15162 requiring subsequent environmental review have occurred. <br />Meeting Details: This matter will be heard on Monday, September 23, 2019 at 5:30 p.m. in the <br />City Council Chambers, 22 Civic Center Plaza, Santa Ana, California 92701.
