Resolution No. 2021-12 <br />Page 1 of 7 <br /> <br />RESOLUTION NO. 2021-12 <br /> <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE <br />CITY OF SANTA ANA APPROVING CONDITIONAL USE <br />PERMIT NO. 2021-04 AS CONDITIONED TO ALLOW ON- <br />PREMISES SALE AND CONSUMPTION OF ALCOHOLIC <br />BEVERAGES AT EURO CAFFE RESTAURANT LOCATED <br />AT 3950 SOUTH BRISTOL STREET <br /> <br /> <br />BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA <br />ANA AS FOLLOWS: <br /> <br />Section 1. The Planning Commission of the City of Santa Ana hereby finds, <br />determines, and declares as follows: <br /> <br />A. Samuel Ruiz, business owner of Euro Caffe Restaurant (“Applicant”), on <br />behalf of BSG West Bristol, LLC (“Property Owner”), is requesting approval <br />of Conditional Use Permit (CUP) No. 2021-04 to allow the sale of alcoholic <br />beverages for on-premises consumption at an existing restaurant located <br />at 3950 South Bristol Street. <br /> <br />B. Santa Ana Municipal Code (SAMC) Section 41-196 requires approval of a <br />CUP for establishments wishing to sell alcohol for on-premises <br />consumption. <br /> <br />C. On May 10, 2021, the Planning Commission held a duly noticed public <br />hearing on CUP No. 2021-04. <br /> <br />D. The Planning Commission determines that the following findings, which <br />must be established in order to grant a CUP pursuant to SAMC Section 41- <br />638, have been established for CUP No. 2021-04 to allow the sale of <br />alcoholic beverages for on-premises consumption at 3950 South Bristol <br />Street: <br /> <br />1. That the proposed use will provide a service or facility, which will <br />contribute to the general well-being of the neighborhood or <br />community. <br /> <br />The sale of alcoholic beverages for on-premises consumption <br />at the subject location will provide an ancillary service to the <br />restaurant’s customers by allowing them the ability to <br />purchase alcoholic beverages with their meal. This will <br />thereby benefit the community by providing a restaurant with <br />an additional and complementary food related amenity. <br />Operational standards applicable to the alcoholic beverage <br />control (“ABC”) license and conditions of approval will mitigate <br />any potential impacts created by the use and will ensure <br />that the use will not negatively affect the surrounding <br />community. <br />
